"I Still Have A Dream"
 
Welcome!  As our very busy summer rolls into fall, I am honored to be considered once again, "a Super Lawyer."  In these trying times, clearly, victims of civil rights violations and employment discrimination require nothing less.  And so, we continue to beat the drum for justice, and sound the alarm against injustice.  I'm proud to continue to partner with strong organizations like the Legal Aid Society - Employment Law Center of San Francisco, and to represent historic heroes like Lt. Col. James C. Warren.  In this era of "the new Jim Crow" the challenges are greater than ever.  But in the words of Dr. King, "I still have a dream," and "now is the time to make justice a reality for all God's children."

Just SUPER! Pamela Y. Price Selected as a 2011 Northern California Super Lawyer

For the eighth straight year since 2004, Bay Area Civil Rights Plaintiff's Attorney Pamela Y. Price has once again been selected as a Northern California Super Lawyer for 2011  through peer recognition and professional achievement.

 

Each year, Super Lawyers magazine names the top five percent (5%) of attorneys in each state who are nominated by their peers, vetted and chosen through a selection process that is recognized and approved of by Courts and Bar Associations across the country. The Super Lawyers comprehensive selection process is a detailed attempt to produce a list of lawyers who have attained high peer recognition, meet ethical standards, and have demonstrated a high degree of achievement in their field. Using a rigorous, multiphase rating process, each candidate is evaluated on 12 indicators. 

 

Selections are made on an annual state-by-state basis. The list of 2011 honorees was published in the August issue of Super Lawyers magazine (www.superlawyers.com ).  

 

Now celebrating over twenty (20) years advocating for justice, Pamela and her Firm have established a track record in state and federal trial and appellate courts, becoming known for representing several high-profile sexual harassment, racial and employment discrimination cases. 

 

Attorney Price's signature case is a victory in the United States Supreme Court in Morgan v. Amtrak, 232 F.3d 1008 (9th Cir. 2000), 536 U.S. 101, 112 S.Ct. 1516 (2002) Racial Discrimination - Verdict: $500,000 (2004). Her most recent victory in June 2011 is Fobbs et. al. v. New Haven Unified School District et.al, United States District Court (2011) Racial Harassment - Settlement: $725,000. (See article below.)

Legal Aid Society 95th Anniversary Luncheon

 
The Legal Aid Society--Employment Law Center (LAS) of San Francisco celebrated its 95th Anniversary at its annual luncheon in San Francisco on July 14, 2011. Price And Associates was pleased to support the organization's ninety-five year commitment to the principle of equal access to justice and vitally important work for social justice as a luncheon Patron.

The Keynote Address was given by Paul M. Smith of Jenner & Block LLP, who has argued thirteen times before the U.S. Supreme Court, including the landmark case Lawrence v. Texas, which changed the landscape of LGBT rights. Smith won the American Bar Association's 2010 Thurgood Marshall Award, is a former board member and Chair of the National Board of Directors of The American Constitution Society, and is Co-Chair of the Board of Directors of Lambda Legal. Fobbs v. New Haven Unified School District $725,000 Settlement  

 

Among Price And Associates' recent achievements is a $725,000 settlement in the Fobbs, et al v. New Haven Unified School District (NHUSD), et al class action lawsuit in June 2011. 

 

The class action lawsuit was filed in state and federal court under Federal and State civil rights laws on behalf of Alvett Fobbs (the named plaintiff in this case) and six (6) families, including twelve individual students or former students, and a class of African-American students attending school in Union City. The intention of the suit was to stimulate the District into taking strong measures to protect African-American students and stop the gang-inspired racially-motivated attacks in their Union City schools, which they have failed to do over many years.

 

On Thursday, June 23, 2011, Attorney Pamela Y. Price held a press conference at the NAACP offices in Hayward to announce the terms of the $725,000 settlement reached which included thirteen (13) remedial policies and programs to be implemented by the District in an effort to curb racial violence against African-American youth in their schools.

 

"The violence against African-American youth in Union City has been going on unchecked for years, and it has to stop now," said Attorney Price. "Students have been afraid to walk to school or use public transit due to the random violence against them. It is my hope, and that of the community and the families affected, that the $725,000 settlement will spur the District to forcefully implement the remedial steps that have been negotiated to alleviate the atmosphere of violence that incubates in their schools."

 

A related, but separate lawsuit, Fobbs v. Union City Police Department, is still pending.

Tuskegee Airman Lt. Col. James C. Warren Wins Victory for "Young Eagles" to Soar

Lieutenant Colonel James C. Warren won his latest battle and the right to continue teaching "Young Eagles" how to fly at the Nut Tree Airport in Solano County.

 

During World War II, over 1300 Black military aviators were trained at an isolated training complex near the town of Tuskegee, Alabama and at Tuskegee Institute (now known as Tuskegee University), which earned them the moniker as "Tuskegee Airmen."

 

Now retired, Col. Warren owns a small plane and rents a hangar at the Nut Tree Airport in Solano County.  As an aviator of many years' experience, he wished to facilitate flight lessons, taught by professional flight instructors, as a community service for young people who would not normally be able to afford the cost of flying lessons. Upon learning that Col. Warren was interested in providing this service to young people, the Nut Tree Airport asked him to comply with all rules and regulations that apply to a "Fixed Base Operator." The red tape and costs involved would exponentially increase costs and prohibit his ability to offer free lessons.


Lt. Col. Warren felt that he was being treated differently than others who provided flying lessons on a pro bono basis. He sought counsel and retained Price And Associates for help.

Lt. Colonel James C. Warren is a national treasure!  A former Tuskegee Airman, he retired from the US Air Force at the Lieutenant Colonel rank. "Colonel Warren," as we fondly call him in the office, has had a life-long love of aviation.  As a teenager, he knew he wanted to be a pilot.  He enlisted and was assigned to the Tuskegee Air Base. He didn't become a pilot but, undeterred, he  trained and flew as a navigator during World War II. Recalled in 1952, he flew missions in both the Korean and Vietnam Wars. During his Air Force career, he was awarded the Distinguished Flying Cross with two oak leaf clusters ("OLC"), the Air Medal with 11 OLCs, and the Meritorious Service Medal with three OLCs.

 

Colonel Warren never gave up his dream of being a pilot. In 2010, showing the same grit and determination that took him from a childhood of poverty in the South to Tuskegee, he passed the Federal Aviation Administration pilot's test. He was then 86 years old!

 

Colonel Warren wants to pass on his love of aviation to young people.  He formed a nonprofit foundation to introduce poor youth to flying.  Using his Beechcraft, he trained young people at the Nut Tree Airport in Solano County.  Col. Warren found licensed instructors who used his plane.  For some reason the County didn't like this arrangement. They sent him a "cease and desist" letter, as if he had committed a major aviation infraction.

 

With the help of Price And Associates, the Colonel was able to resolve the lawsuit in a way that enables him to continue his mission of helping poor youth to understand and love aviation.

This is not the only fight Col. Warren has waged against injustice.  While in the Army Air Force, during World War II, he and other black officers were forbidden from using the "white" officers' club at Freeman Field in Indiana.  Lt. Col. Warren and other Black officers resisted being segregated.  They went into the officers' club and demanded service.  They persisted in their demands although they were ordered by a superior to stop.  They refused to sign a document that had them agreeing to be segregated.  Eventually the matter was resolved, but not without fallout for the participants, who believe they were forever labeled as "trouble makers" by the Air Force. Lt. Col. Warren has written a book about this experience, "The Tuskegee Airmen Mutiny at Freeman Field."
