While there are many creative caveats to having production business in New Mexico, film is, at its core, an economic development program. And one that works.

 

Each year, more local film crew are trained, more local businesses provide goods and services to the industry, and the economic impact of film in our state deepens.

 

Since the incentives were enacted six years ago, there has been more than $450 million in direct production spending in Albuquerque alone, and total direct spend in the state has surpassed $1 billion. The longer we have film as a part of our economy, the more integrated it becomes into our lives - and the harder we have to work to protect it.

 

New Mexico is continually lauded from within the industry, and by other states, as the one's who "get it right."

His previous lives include teaching Cinematography, and producing and directing the feature films Suckerfish and Security. He escaped the world of large scale corporate events and trade shows to focus on TV and film rigging. He is currently one of the house head riggers at the Santa Ana Star Center through IATSE Local 423.

Movies made in New Mexico have filled theaters over the last few months, with many performing well in the Box Office, and garnering solid reviews! . . .  Crazy Heart grabs several Golden Globes and looks on its way to great recognition at the Oscars, while New Mexico resident and musician Ryan Bingham gets plenty of attention, and probably a Grammy, for his song for Crazy Heart called "The Weary Kind". They even named a day after him in New Mexico (Ryan Bingham Day) . .  The Book of Eli gets plenty of press, and does well at the box office, too ($112m+). . . Legion, in a similar post-apocalyptic vein as Eli, does ok at the till ($39m), and sparks lots of talk about how little things like God and Armageddon are popular topics for the screen. . .  Also playing were Jackie Chan's The Spy Next Door, Steve Buscemi and St. John of Las Vegas, as well as Did You Hear About the Morgans. . .  And, New Mexico's own Wes Studi had a main role (as Eytukan) in Avatar. Very cool. . . The New Mexico film incentives went through the wringer at the Legislature. Several bills were aimed at capping or cutting our program - one of the most successful incentive programs in the country - but supporters of film came out in full force to protect their industry. That support quickly killed Dennis Kintigh's (R) HB 52, while SB236 and SB248 - that aimed to cap the incentive program - were tabled. These bills show we still have work to do in improving the image of the film industry in NM, and insuring that all are fully aware of the economic impact film brings to our state. The industry knows us as having the most stable and successful film program, but we need to work harder to convey the message at home. What are you doing to improve the film climate in New Mexico? A big thank you to the thousands who faxed, called, and emailed the Legislative committees and individual Legislators, as well at the many who attended Film and Media Day at the Roundhouse! . . . Some great new pictures are in the production pipeline in New Mexico, including Thor, starring Natalie Portman, True Grit, a Coen Brother's remake of a classic John Wayne western, another season of In Plain Sight, Knockout, starring Gina Carano, Michael Douglas, Ewan McGregor, and some other really big productions not quite ready to be announced. . . Sad news in the New Mexico film community. Extras casting director and well known film personality Gwyn Savage of FilmSavage.com passed away in January. Condolences to friends, family, and her associates. Gwyn helped hundreds of New Mexico actors get their first break on set while casting for Breaking Bad, Did You Hear About the Morgans, Gamer, Spirit, Beerfest, and many more. . . Screenwriting and development consultant Ambyr Davis gets picked up to teach classes at Santa Fe Community College. . . Thirty year stage and screen veteran Price Hall teaches his ongoing, weekly  "Actor's Lab" workshops Mondays and Tuesdays in ABQ. "You'd find this class in LA or New York." Check it out! . . . Santa Fe Studios still hangs in the ethers, but is looking closer to being a reality every day! The New Mexico State Board of Finance recently approved a restructuring of a land sale that gives Santa Fe Studios the right to start building. Construction could start as soon as April, 2010. An economic development study conducted by a Santa Fe County contractor anticipates future tax revenue alone would average around $3.7 million per year. . . MovieMaker Magazine names Albuquerque #1 place for Indy filmmakers to "Live, Work, and Make Movies in 2010," beating out LA and NY. . . The world's first hydrogen-powered movie truck is produced right in Santa Fe! The Climate Kitchen, a full-service crafty truck, can run for up to 2 weeks entirely on water and solar for heat, fuel, light, ovens, and power. This a major development for the renewable power industry, and we're thrilled that the first commercial application of this technology is for New Mexico movie sets. Coming to a location near you this Spring. . .crewnewmexico.com member Sophia Bungay of Nogal Canyon Media has a new website up and running, and they're looking for those interested in getting involved in several independent projects!. . . Film Works for New Mexico

If you are reading this, you're likely a supporter of New Mexico's film industry. As an avid supporter of the industry and an attorney at the Rodey Law Firm, I try to promote the industry in the professional, governmental, legislative and private networking circles in which I move.

 

Unfortunately, I find plenty of people who are on the fence about the film business.  They believe that the state has no idea whether or not the industry provides an economic benefit and they wonder why the film business should get preferential treatment over other business.  I've developed some talking points that I'd like to share with you.

 

First, some simple math on the gross receipts tax rebate.  The number of dollars the state gives to film makers as part of this rebate should be multiplied by four to find out how much money was spent here. For instance, if the state gives out $50 million, then $200 million was spent here. And this is primarily new money coming into the state, not just us recirculating our dollars. Plus, all of the movie's outstanding bills have to be paid before the rebate is issued, encouraging our residents to get paid first and quickly for their goods and services.

 

Second, I've heard Texas used as an example of how to kill a film industry with an incentive cap. Here are the facts. According to the Texas Film Commission, Texas implemented a 5% capped incentive program in 2007 which significantly hurt their film industry.  Last year, Texas increased its film incentive to 15% and removed the cap and they are seeing positive results. We don't need to reinvent the wheel. If the cap didn't work in Texas, it's not going to work here.

 

Finally, to those who question why this industry should receive preferential treatment, my answer is that this industry is perfect for New Mexico because it already incorporates environmentally sustainable practices learned in California. It is an industry that doesn't have to pump water out of our rivers and aquifers (unlike manufacturing plants, oil and gas drilling/processing, resorts, casinos, golf courses, etc.,) and is continually searching for ways to be more green, dynamic, and sustainable.

So whenever you are talking to people who don't work in the industry, sprinkle your conversation with a couple of these talking points. Let's do our part to educate voters and keep film working for New Mexico!

Interview With climate kitchenAlbuquerque Film Liaison, Ann Lerner

If you've ever shot in Albuquerque, you likely know Ann Lerner. As the Film Liaison for the city, she's at the heart of the film boom and works directly with productions to ensure a smooth shoot. Ann took some time out to shed a little light on her job, the impact of film on the culture and economy of ABQ, and some favorite anecdotes from her time on set. . .

CREW: Albuquerque was recently ranked the #1 50% Off!film location in the country by Movie Maker, and is often in the top 3 in surveys by Variety Magazine. That's pretty impressive, considering there's many places that are trying to attract film. To what do you attribute this success? 


AL: I think it's a combination of things.  First, of course, are the generous state film incentives offered to filmmakers, and a rebate program that is easy to use.  Secondly, we have an infrastructure that is ahead of the rest of the United States.  Look at ABQ Studios, the largest studios in North America, located right here in ABQ!  We have grip and light companies, catering companies, camera houses, Filmmaker Production Services, a 25,000 sq ft. prop/costume/drapery shop, Star Waggons, just to name a few. . . the list is amazing. (I apologize to those I didn't single out.) Other factors that work to our advantage are 310 days of sunshine, close proximity to Los Angeles, the plethora of locations the city can double for (recently, in Crazy Heart, ABQ doubles for Phoenix and Tucson); and, probably most importantly, an amazing "Film Friendly Attitude" towards filming in the city.


CREW: The NM film industry is highly dependent financial incentives, and upon the support of the residents and legislators of New Mexico. What message would you like to convey to everyone about the incentives, and how they ultimately impact the economy?


AL: Forty-two states now offer filmmakers some kind of incentives to come film in their states. Twelve states offer incentives that are higher than the 25% that New Mexico offers. Why? Because films bring in new dollars to the economy, they employ local crew and talent, they pay high wages, and it's an industry that is creative and non-polluting.  The direct spend to the city of ABQ over the past six years is $450 million. Direct spend! No multiplier! It thrills me to see local filmmakers buying houses and new cars, and spending the money that they are making locally.


CREW: Tell us a little bit about your job. What exactly does the Albuquerque Film Liaison do on a given day?  


AL: I read scripts, and send out digital pics to potential production companies to entice them to come take a look.  When they do come to ABQ, I drive them around and show off our city.  Once here to shoot, I help them with any number of things to make their life easier. I also give speeches to various groups, to talk about why the film industry is exploding in New Mexico. Community outreach is very important in maintaining a film friendly city.  And I act as a conduit - connecting people who may want to have their house used as a location, for example; or a citizen who might want to be an extra on a film.  It's really very varied.  And I am never bored. 

CREW: What little secret about shooting in ABQ do you wish everyone knew about?

 

AL: Our one-stop film permitting process, led by Carrie Wells, Assistant Film Liaison, is absolutely the best in the nation.  It makes shooting here really easy.

Secrets of a Successfully Insured Production

If the dirty little secrets of production insurance are worrying you, stop worrying - and start asking questions. That's the only real secret to a successfully insured production. You can explore all the options in the world with your insurance agent, but unless you ask the right questions to begin with, the disconnect between what you think you're getting and what you're really getting can become costly.

Let's start by taking a look at the most common types of coverages for film and video production insurance, and outlining some of the important exclusions. To ask informed questions you'll need to know the basic coverage definitions, especially those that relate to general liability (often misunderstood), property, inland marine, workman's comp and specialty coverages.

It's this simple: if you understand the needs behind the different types of coverage, you'll be able to ask the questions that help correctly insure your production.

 

Where Do I Get a Policy that Covers Everything?

 

Sorry. There's not an insurance policy on earth that covers every eventuality. Expect your insurance to cover the major causes of loss that are typical and can be predicted; that's why the insurance company works so hard to make a complicated legal document explaining what is - and is not - covered. But every claim is unique. And the world is a crazy place where extenuating circumstances can make clarity of coverage seem frustratingly impossible. Accept the fact that there is always the possibility of a one-time event that won't be covered no matter what insurance policy you buy. In the eventuality of a major claim involving a lawsuit, it can come down to who has the better lawyer and can sway the judge or jury. That's just the way it is.

Now for the good news. You can prepare to cover your production as securely as possible by working with an agent who can explain your coverage options. Don't leave it to the agent to do the understanding or make the decisions. You must do that. An agent probably can't predict whether you'll be covered if the noise of your production traumatizes llamas on a neighboring ranch, but he or she can tell you what is covered, and for how much. The more homework you've done, evaluating your needs and possible eventualities, the better information you'll get - and the less risk you'll be exposed to.

 

How Do I Know What to Cover and What Not to Cover?

 

The state of New Mexico and most municipalities require a $1 million general liability minimum limit in order to obtain film permits.

Larger productions (budgets over $200,000) often buy package policies that include a number of what are called "producer's risk" coverages. One of these production package policies may have general liability limits of more than $1 million per occurrence, with a $1 million total maximum payout per policy period.  A producer's risk package often includes coverage for the total budget, if necessary, to re-shoot an entire production. Smaller productions tend to pick and choose the actual coverages (called lines of business) they are most likely to need. Your lines of business will be added to your core general liability policy.

Large productions tend to factor their liability and producer's risk insurance premiums at around $15,000 per $1 million of budget, not including workman's comp.

            Nationwide (U.S. and Canada) general liability coverage for short-term, one-time productions with budgets under $1 million starts at a minimum premium of $500 that covers up to 10 contiguous days of principal photography, and goes up from there.

The Climate Kitchen is a bold step in the creation of both zero-emission vehicle technology and clean, renewable power production. With the ability to create its own power and then utilize that power as both fuel for the vehicle and end-user electricity, the Climate Kitchen is a step in reinventing how movie sets and production vehicles use and create power.

The Kitchen is a full service "Craft Service" truck, conceptualized by long time NM "Crafty" Jeane Champion, her business partner Michael Bowen, and designed by Henry Herman CEO of Jetstream Wind, Inc. Approximately 4,350 gallons of diesel fuel can be used per movie set, per day, to power the generators and trucks that make location shooting possible. This can result in up to 96,522, pounds of CO² being released into the high desert each day, for each production. By eliminating the need for fuel, the Climate Kitchen not reduces the cost of remote production, but also the carbon footprint.

This state-of-the-art 35' kitchen on wheels will be the first clean energy, non-polluting, highly economical craft service kitchen in the world. Not only does it incorporate recycled materials in the construction, it is hip and cool, with wi-fi, an oxygen bar, lap-top stations, flat-screen TVs for viewing dailies, and bins for bulk natural foods.

Solar panels top the truck, and have the ability to extend out (like wings) creating both the energy required to co-power the kitchen while also providing shade. A small amount of water fed into the power system will separate the hydrogen and oxygen from the water molecule. The hydrogen will be stored and fed back to the Kitchen as clean, zero-emission electricity and gas. Voila.
