Is your business as hot as the weather? Congratulations to all the winning contractors who are getting a jump start on the fiscal year-end business push.  This see-saw of a year has been even more complicated than usual because of the "informal" spending freeze in some areas and the spending push in others.
 
The federal government is going to execute more contracts in the next three months, from today through September 30, than they have all year to date. Step up now, start responding to the RFPs and RFQs, and order in your caffeine supplies because those serious about winning federal contracts  will be pulling quite a few all-nighters in the coming weeks and months to meet the response deadlines.

The opportunities are vast, and remember, trends show that over 9% of contracts have just one bidder! This amounted to over $30 Billion in one-bidder contracts last year-don't hesitate to respond if you think you can win.

A recent Washington Technology article stated: "...Ashton Carter, undersecretary of defense for acquisition technology and logistics, outlined his new initiatives for garnering the 2 percent to 3 percent net growth needed to fund the war, without increasing budgets, by eliminating some overhead costs and transferring the savings to combat capabilities....Defense contractors need to "look at their activities, practices and processes, and see where you can identify savings." Parity in Small Business Contracting
 
 
Parity is a long-held policy that the SBA's small business programs are to be treated the same, with no one program preferential to another. A recent GAO decision has overturned this, finding the HUBZone program to have priority over the other small business programs. WIPP, along with the SBA, disagree with this decision to separate HUBZones from other small business programs. WIPP has been active in seeking a legislation to restore parity, and legislation is currently pending in Congress (S.3190 and H.R. 3729). Federal Contractors Employee Hiring Requirement
       

 When President Obama signed Executive Order 13495, Non-displacement of Qualified Workers Under Service Contracts, he established a federal policy under which contractors looking to obtain existing federal contracts for the same or similar services at an existing location must agree to offer employment to certain persons employed by the predecessor contractor.    
 
The Department of Labor ("DOL") published proposed regulations implementing this order on March 19, 2010.  Under the proposed regulations, a successor to a government contract cannot fill any job to complete a contract without first making good faith offers to qualified employees of the predecessor contractor.  Failure to comply with the regulations may cause the contractor to be debarred for up to three years.  In addition, the DOL is authorized to investigate violations and order sanctions and remedies, including payment of lost wages for employees that should have been hired.
