We have arrived in a new era for the United States. Already, I have heard some people complain about "how it is going to be" and bemoan the fact that things are going to change, and they worry about the danger in change. To them I answer: "You will get exactly what you expect."
You, on the other hand, may be more like me and expect the opposite: A year full of opportunity for those who have the right attitude, work hard, work smart and prove that they can do the job that needs to be done. No complaints, but no excuses either.

U.S. Chamber Lawsuit Challenges Massive Extension of E-Verify Program to Federal Contractors
WASHINGTON, DC-The U.S. Chamber of Commerce today challenged the legality of requiring federal contractors and sub-contractors to use the Department of Homeland Security's (DHS) E-Verify system. Joining the U.S. Chamber as co-plaintiffs in the lawsuit are the Associated Builders and Contractors, the Society for Human Resources Management, the American Council on International Personnel, and the HR Policy Association. "This massive expansion of E-Verify is not only bad policy, it's unlawful," said Robin Conrad, executive vice president of the National Chamber Litigation Center (NCLC), the Chamber's public policy law firm. "The Administration can't use an Executive Order to circumvent federal immigration and procurement laws. Federal law explicitly prohibits the secretary of Homeland Security from making E-Verify mandatory or from using it to re-authorize the existing workforce."

Significant New FAR Contractor Compliance & Disclosure Program and Requirements
The Federal Acquisition Regulation Council recently published a final rule on "business ethics and disclosure" with an effective date of December 12, 2008. While I am not an attorney, you need to contact your attorney if you have or are pursuing federal contracts greater than $5 million or with a performance period greater than 120 days because every government contractor must perform self-reporting and prove compliance regardless of your business size or the type of goods or services you supply.
As the McCarthy, Sweeney & Harkaway, PC newsletter states: "...It ushers in a new era in compliance and for all government contractors. It must be taken very seriously and fully implemented..."

Email Warning: I recently received an email that offered email addresses for 55,000 federal buyers. You probably have also received it because these people spam everyone. The email stated "..qualified small business government contractors free access to over 55,000 unique federal contacts..."
Please be aware that the first time you send an email out to 55,000 government employees, you and YOUR DOMAIN name WILL BE BLACKLISTED and prohibited from sending emails to government addresses. I have heard from a number of contractors who tried to email (spam) the government buyers, and they are now paying the price of NO ACCESS. Do not fall victim to this ploy. If you do want to utilize email marketing to government buyers, please make sure you have asked and received permission first and send emails sparingly. |
3% Government Withholding Relief Coalition Update
Chris Braddock of the US Chamber of Commerce has provided the following summary of the meeting regarding the 3% Government Contracting Tax.:
The House Ways and Means Committee released a press release outlining their portion of the stimulus bill.
It includes a "One year deferral of withholding tax on government contractors." As we discussed yesterday, this is what we had heard the House was moving toward, instead of full repeal, primarily because of the "cost" to repeal. US IT Markets: Down, Not Out Given the seemingly unceasing tide of bad economic news, Forrester's recent projections for the information technology (IT) market have to count as good tidings. Forrester is projecting business and government IT spending to grow by 1.9 percent in 2009. This is a big drop from 2008's growth rate of 4.8 percent, but it's still an (albeit small) increase. Forrester also projects a two percent rise in 2009 software sales, and little or no growth in computer equipment and IT services sales. This slowing performance is worrisome, but it is still strong when compared to the major downturns that occurred in the aftermath of the dot-com bust in 2001 and 2002 when the IT market absorbed declines of 15 to 20 percent.

Report States that 45% of Small Business Fear Sales Drop  A new poll from the National Federation of Independent Business Research Foundation takes a look at how small businesses are responding to the current credit crisis. Not surprisingly, surveyed business owners are glum, with thirty-four percent agreeing that their business has been significantly" affected, and, within this group, twenty-six percent agreeing that the downturn threatens their business' survival. The largest group of owners (45%) cited lost sales as their primary concern, followed by uncertainty over overall business conditions, which was cited by 23 percent of respondents.
