 President's Message
Richard Wieder
Fall is in the air and your board has worked over the summer to bring you some of the finest CE and lunch/dinner programs in recent history. For the combined total of 84 people that attended either the CE or lunch program or both, they told us that our first "Kick Off" meeting was filled with valuable information and a sanctuary for our fellow insurance agents. Our new location at the Fort Lauderdale Country Club is very upscale and the food was wonderful. If saving money on taxes is important to you, please register for our special meeting on October 11th, where you have a hot breakfast and a presentation by the Bradford and Company for Tax Strategies for the Self-Employed Insurance and Financial Advisors. We have almost reached our seating capacity for this meeting, so if you want to attend, please respond today. Our next general membership meeting will be held on October 17 and will also be an exciting meeting as our Legislative Agenda prior to the November elections. Listen and ask questions of the candidates who attend. This meeting is a joint meeting with the Independent Insurance Agents of Broward County, so please make your reservation today. Lowell Richard from Blue Cross Blue Shield will be presenting a two-hour CE course on Health Savings Accounts. We will also be honoring our members with 15 to 19 years of NAIFA membership to thank them for their membership and support of our association and the insurance industry. We look forward to seeing you on October 11 and October 17 and please make your reservation today. If you are on the fence about coming to our next meeting, please call me at 954/650-8486 and give me an opportunity to tell you why "it pays to be a member" and attend our meeting. Be well, and again, thank you for your membership and support of our association.

COMMUNITY SERVICE UPDATE |
Submitted by Lorene Roberts Community Service Chairperson lorenerob4375948@aol.com Calling All NAIFA-Broward Association Members! We sure hope you had a fun-filled and adventurous Summer, spending time with your loving families and creating new memories! Now it's time for us to get back to work. Unfortunately there are many people in our communities without families, food, clothing and basic necessities. Vacations are non-existent and most importantly they are without HOPE. This is where NAIFA-Broward is prepared to help. We are HOPEFUL for your continued support on our Community Service efforts throughout this coming year. This year, we will continue our food, basic necessities and toy drives for the upcoming Holiday Season. We will be adding the Wounded Warrior Project to our list of charities. If any of you are familiar with projects that you would like us to look into or support, we welcome your ideas and input. Thank you all for participating. These Community Service projects could not take place without your continuing support and generous donations. |

Membership Report |
Joseph Chalom, CLU, LUTCFMembership Chairperson No NAIFA... No Industry!?!
The mantra from the NAIFA National leadership is that if the National Association of Insurance and Financial Advisors stops advocating for the nearly 300,000 insurance agents and financial advisors, radical changes will legislate and regulate us out of business. Frankly, I do not know what would happen. However, we do know that absent advocacy radical changes occurred across the pond in Great Britain and other countries. We do know that NAIFA is will known and well respected in our state capitols and inside the beltway. Legislators and regulators often seek out NAIFA's thoughts prior to enacting legislation or regulation. Why you ask? The answer is simple. NAIFA is considered the voice of the agent. Admittedly it helps that NAIFA is the only financial service organization with deep grassroots reach. The simple truth is our members vote and our clients vote. We make a difference! However, there is only strength in numbers. Although we advocate for nearly 300,000 insurance agents and financial advisors, only about 43,300 agents are footing the cost of our lobbying efforts. Not Fair! I agree. You can help level the playing field by sponsoring one new member. How do you sponsor a new member? Easy. Sign up online at www.naifa.org or contact myself or any member of our leadership team to help. The Challenge Is On!
We are well on our way to making our membership quota for the 2012-2013 membership year. However, we really need your help. Sponsor and or join the membership committee today. We are making membership fun this year. We have several incentives and a challenge. Each member who sponsors a new member to NAIFA-Broward will receive a gift. The NAIFA-Florida Membership Committee announced a contest to be awarded to the membership chair with the greatest percentage increase in membership, providing they exceed their member quota. If NAIFA-Broward wins this contest, I have elected to raffle off the gift valued at $1,300.00. The member who sponsors a new member will be entered into the raffle each time they sponsor. For example, if you sponsor 5 members, your name is entered 5 times. The more you sponsor, the better your chances of winning this prize. Look for more details at www.naifa-broward.org and in future issues of The Courier. It Is A Matter Of Pride!
During the last membership meeting I challenged NAIFA Miami-Dade Membership Chair Don Brown that NAIFA-Broward will have the best percentage membership growth. Winner of the contest has agreed to buy the loser dinner at a posh restaurant in South Florida. I really need your help to guarantee that NAIFA-Broward wins! NAIFA is the ONLY organization whose primary mission is to advocate for insurance agents and financial advisors in multiple disciplines including; life, health, annuities, securities and property and casualty on both the state and federal levels of government. Although advocacy remains the single most important thing NAIFA does, it has morphed into something much greater. The mind boggling benefits of membership offer members the opportunity to save tangible dollars in their budgets. Excellent examples are Errors and Omission Insurance, the Travel Center and CopyTalk. A complete list of benefits can be found at www.naifa.org. If you are passionate about our profession and our association please join the membership committee. We have positions available that require minimal time commitments. Please contact me at (954) 340-1588 or joe@retirementcouncil.com if you have any questions. |

Health Insurance Update |
Submitted by Steve Needleman NAIFA-Broward Health Chair
The last few weeks have been very busy in the health insurance arena. In June, the Supreme Court upheld the Patient Protection and Care Act, also known as ObamaCare. The law was challenged because it requires all U.S. residents to purchase health insurance, or be subject to a tax. The Supreme Court ruled that this is a tax, and therefore Congress can legally impose this tax. Another part of the law required all states to extend Medicaid to all persons earning less than 400% of Federal Poverty Level (FPL) or else lose Federal Medicaid funding. This part of the law was found to be unconstitutional. States may refuse to expand Medicaid eligibility and still keep their current Federal Medicaid funding.
Here are a few of the changes already in effect:
Most Preventive Care is covered at no cost.
No lifetime maximums
No pre-existing conditions for children under age 19
Summary of Benefits and Coverage (SBC's) required. This will be phased in starting 9/23/12.
Woman's Health coverage at no cost
W-2's required to show cost of health care for companies issuing more than 250 W-2's.
Here are a few of the changes scheduled to for 2014:
Exchanges will be available for individuals and Small Groups (under 50 lives) to purchase health insurance.
Government subsidies will be available for individuals to purchase health insurance from the Exchange if they earn less than 400% of the Federal Poverty Level and don't have health insurance offered by their employer.
Individuals must have health insurance, or pay a tax.
No pre-existing Conditions for any one.
It is impossible to summarize 2,700 pages of legislation in a short article, so stay informed so you can be a valuable resource to your clients.

Multi-Line Report |
Submitted by Lee Gorodetsky Florida Rep. Hits Citizens for 'Rushing' Surplus Loan Proposal
A plan by Florida's state-backed property insurer to loan private insurers millions of dollars in surplus in exchange for removing policies has not been properly vetted and is a sweetheart deal for a few insurers, a Florida official has charged.
Citizens Property Insurance Corp. voted earlier this month to loan up to $350 million of its $6 billion in surplus to private insurers with the goal of moving up to 300,000 policies to the private market. Citizens Depopulation Committee Chair Chris Gardner said the plan could represent a major jumpstart in the insurer's depopulation rate that has hovered around 100,000 annually. "I believe the way this program is conceived, it could lead to a renaissance of the Florida market," said Gardner. However, state Rep. Frank Artiles, R-Miami-Dade, is charging that the plan is being rushed into without adequate oversight and a full understanding of its implications.
In a letter to Insurance Commissioner Kevin McCarty, Artiles took Citizens to task for not releasing the full details of its surplus note program until just days before the Citizens board gave its seal of approval. He also questioned whether Citizens even has the statutory authority to implement the plan.
"The legislature never delegated an unfettered right to Citizens to use its surplus in any manner it chooses to adopt," wrote Artiles.
Artiles has also launched a one-man investigation into the role the Tower Hill Group and American Integrity Insurance Co. had in developing the plan.
Under the program, qualified insurers could receive up to $50 million in the form of a 20-year surplus note. For the first year years, insurers only have to pay the interest on the notes based on the U.S. Treasury 10-year bond rate, which is currently around 1.8 percent.
American Integrity has indicated it would consider removing 50,000 policies from Citizens and the Tower Hill Group through its subsidiaries another 130,000. Between the entities, they could receive $200 million of the $350 million program, an amount that Artiles says "represents an alarming concentration of risk."
Artiles is asking Citizens and state regulators to hand over all correspondence, financial reports, and other information involving Tower Hill and American Integrity.
"At a time when Citizens is raising rates, reducing coverage, and telling Florida residents to pay more for less, Citizens has selected to deliver a $350 million gift to a few insurance companies," wrote Artiles.
Citizens President Barry Gilway has said that the surplus note program has various financial safeguards including that insurers would have to retain policies for at least 10 years and the minimum total insured value an insurer must take to qualify for the program is at least $5.5 billion.
The participating insurers must also be actively writing property insurance and have a risk based capital ratio of 300 percent and minimum surplus of $25 million. They must also have in Florida direct written premiums of at least $50 million and enough reinsurance to cover a one-in-100 year and two one-in-10-year probable maximum losses.
"We shouldn't be depopulating if we are not moving this business to financial insecure companies," Gilway has said.
Chief Financial Officer Jeff Atwater has urged Citizens to be thorough and to exercise due diligence before it hands over any money to a private insurer. "I'm glad they're pausing and they're going to come back and show this is mathematically the right thing to do and there is a marketplace interest in taking these accounts," Atwater told reporters following a Cabinet meeting last week.
While some state officials are looking to put the brakes on the surplus note depopulation programs, some of Florida's largest pro-business groups have been expressing their support. Associated Industries of Florida, Florida Tax Watch and Americans for Prosperity-Florida have all issued statements supporting Citizens and its efforts to reduce the potential assessment burden on all state policyholders.
"Our organization fully supports the depopulation of Citizens," said Abigail MacIver, Prosperity-Florida's director of policy, in a statement. "The focus needs to continue to be on ways we can help reinvigorate the private market, which is willing and able to take on insurance risks without burdening Florida taxpayers."
