Florida Supreme Court
 

As most of you are aware the firm has been challenging the local Pay or Appear Program in the appellate courts of Florida. The Florida Supreme Court, Local Rules Advisory Committee was ordered to complete a recommendation as to whether the Pay or Appear Program was formed with proper jurisdiction. On July 8, 2010 the Florida Supreme Court, Local Rules Advisory Committee by majority vote concluded that the Administrative Order sanctioning the Program was improperly entered and it should have been done through the more stringent local rule process. Since Chief Judge Cary continues to refuse to suspend the Pay or Appear Program, even after the Committee's recommendation, the firm has filed an Application for a Constitutional Stay Writ in the Supreme Court. If the Supreme Court issues the writ, operation of the Pay or Appear Program would be suspended indefinitely.
