UPDATE to October 20, 2011 Article:

NLRB Implementation of Final Rule Requiring Employers to

Post NLRA Rights Poster Postponed until April 20, 2012

 

Unionized and non-unionized employers subject to NLRB jurisdiction now have until April 30, 2012 to post the NLRA rights poster described in the October 20, 2011 article below. The NLRB postponed implementation of the posting rule from January 31, 2012 until April 30, 2012 due to a request made by Judge Amy Berman Jackson of the United States District Court for the District of Columbia in connection with consolidated lawsuits brought by the National Association of Manufacturers and the National Right to Work Legal Defense and Education Foundation.  Those lawsuits were filed against the NLRB in September by the United States Chamber of Commerce, National Association of Manufacturers, and National Right to Work Legal Defense and Education Foundation.  The Plaintiffs in those suits have alleged that the Final Rule exceeds the NLRB's authority, violates the First Amendment by compelling employer speech and is arbitrary and capricious under the Administrative Procedure Act.
