Regulatory Fairness Hearing for Small Business

Tuesday, January 22, 2008

Austin, Texas

The U.S. Small Business Administration will be hosting a Regulatory Fairness Hearing to provide small business owners the opportunity to express concerns regarding federal regulatory enforcement compliance practices.

WHO:    SBA National Ombudsman Nicholas Owen, members of the Region VI Regulatory Fairness Board and representatives of Federal regulatory agencies will hear issues and comments about Federal regulatory enforcement and compliance.  Small business owners, representatives of trade associations and community business leaders are invited to comment about compliance and enforcement regulations by Federal agencies and to learn more about the impact of federal regulations on small businesses.

WHAT:   To create a more cooperative regulatory environment among Federal agencies and small businesses, Congress has directed the SBA and the Office of the National Ombudsman to hold Regulatory Fairness forums.  Issues addressed at this forum will be directed to the appropriate Federal regulatory agency for a higher-level review of the fairness in the enforcement action.  In many instances, the National Ombudsman's action has resulted in Federal agencies reducing or waiving penalties and/or compliance actions in cases of unfair or excessive regulatory enforcement.

BUSINESS TERM OF THE WEEK
CAPTIVE MARKET:

A captive market is a group of consumers who have limited choice in terms of the products they can select/purchase (no choice)! This type of market was common during the production era when there was a limited supply of goods (and great demand). It occurs when the market is monopolistic, thus there is only one supplier in the marketplace. This is more likely to occur with digital products (Microsoft is a good example of this). It can occur when a marketer has achieved significant lock-in for its installed based. Thus the switching costs for the consumer to try a competing product become prohibitive.
