Kiwanis Providing UCF Scholarships
The Kiwanis Club of Avalon Park will be awarding two UCF scholarships at the August 5th meeting at Eastside Bistro. The club hosted their annual golf tournament in April to raise funds to get the scholarship started this year along with helping with their large variety of community and youth service programs. Kiwanis and Key Club Clean-up Cocoa Beach
On Saturday, July 17th, the members of the Kiwanis Club of Avalon Park joined forces with the Timber Creek Key Club students at Shepard Park in Cocoa Beach. Families from both groups joined in the effort to clean up a large stretch of the beach. It was a beautiful morning and a great turnout. It was part of the "Keep Brevard Beautiful" program the County has.

Bankruptcy: May Be the Fresh Start You Need
With the current state of the economy several people have questions about bankruptcy and what it entails. Paula Leite, an attorney with Beechner & Englert, PL located in Avalon Park, helps people understand the bankruptcy process every day.
Consumers generally file either a Chapter 7 or a Chapter 13 bankruptcy. If you are eligible to file a Chapter 7, you are looking to liquidate your debt. You are able to keep some property and may have to let other property go. You can keep exempt property including your homestead if your mortgage is current. A Chapter 13 bankruptcy is a type of reorganization. The debtor proposes a plan to pay creditors over a 3 to 5 year period. Generally, the debtor keeps property and the creditors get less money than they are owed.
Everyone has their own unique situation which should be analyzed to determine whether a Chapter 7 or Chapter 13 is best. For example, if you are unable to pay your bills and you have a home worth $200,000, a first mortgage of $220,000 and a second mortgage of $75,000, and you want to keep your house; filing a Chapter 13 bankruptcy may be the appropriate because you may be able to get rid of the second mortgage.
On the other hand, if you want to surrender your home and you have a lot of unsecured debt (like credit cards and similar items) then Chapter 7 may be more appropriate. However, there is a two part test to be eligible for a Chapter 7. First, there is the "means test" which subjects you to an income based test. People with primarily business debts, including investment properties, may file a Chapter 7 bankruptcy regardless. The second test known as the "abusive test" allows the bankruptcy Court to dismiss your case if the Court finds that you have the ability to pay back a significant portion of your unsecured debts.
Many people worry that if they file bankruptcy they will ruin their credit. Filing bankruptcy will remain on your credit for up to 10 years. However, if you are considering bankruptcy your credit score may be low due to high debt and/or delinquent payments. After receiving a discharge most people are a better credit risk because they no longer owe debt to many creditors. In most cases bankruptcy provides a fresh start.
