Homestead Act - Fact or Fiction
There are some misconceptions about the Homestead Act - what is does and does not protect you from. The Declaration of Homestead should be included in all home purchases. If you do not have it, it's easy to file the appropriate paperwork.

What is the Homestead Act?
The Homestead Act protects your principal residence from being sold to pay an unsecured debt. Unsecured creditors would include credit card companies and any party that does not take collateral for the debt.
How much am I protected for?
$500,000 per residence, per family for the primary residence only.
What types of things are not covered by the Homestead Act?
- Federal, State or Local taxes, liens or assessments
- Mortgages
- Nursing Homes
- Child Support
Does the Homestead Act provide liability protection?
No. The Homestead Act is not a replacement for Homeowners or Personal Umbrella Coverage.
How do I file my Homestead?
File the Declaration of Homestead with the Registry of Deeds in your County. The filing fee is $35.
Applications are available online with the Secretary of State's Office. We always recommend that you consult with your attorney first to discuss the benefits of the Homestead Act.
