Royal Assent for Crime & Security Act 2010
  Early morning alcohol restriction orders a step closer last orders


The Crime & Security Act 2010 has now received Royal Assent and once commenced (by order) will introduce new powers to licensing authorities to allow the making of 'Early morning alcohol restriction orders'.

The Act (with exceptions) will come into force on such day as the Secretary of State may by order appoint

The Act amends the Licensing Act 2003 to insert sections 172A - 172E, giving licensing authorities the power to make 'early morning alcohol restriction orders, and setting out the procedures to be followed in making such an order, as well as providing for variation and revocation of orders, together with exceptions.

An order made under this section effectively overrides any premises licence, club premises certificate or TEN authorising the sale or supply of alcohol between 3am and 6am, regardless of whether any premises licence, club premises certificate or TEN is in place before or after the order is made.

  Taxi Accessibility Regulations could follow London HCV


The Equalities Act 2010 (commencing at section 160) deals with accessible vehicles and enables the Secretary of State to make regulations governing the specification of vehicles used as taxis to ensure that it is possible for disabled persons:

  1. to get into and out of taxis in safety
  2. to do so while in wheelchairs
  3. to travel in taxis in safety and reasonable comfort
  4. to do so while in wheelchairs

Control of numbers of licensed taxis: exception (section 161)

Section 16 of the Transport Act 1985 will be subject to Section 161 of the Equality Act 2010. This means that in certain circumstances, section 16 of the Transport Act 1985 (which allows a licence to ply for hire to be refused in order to limit the number of licensed carriages) will not apply .
