Environmental Risk Management: JKJ Moves In
by: Brad Maurer

With the new federal government taking the helm in January 2009, there are a lot of questions about environmental liability and whether it will continue to grow as it has in the last 10 years.

Volatile oil prices and election campaigns have attracted attention to energy and environmental protection.  As a result, there is a renewed national interest in environmental issues.  The insurance industry has long toiled with its position on insuring environmental liabilities because they are so different than typical accidents.

Who is Liable?
  • The Superfund law holds owners of properties liable for the expense of cleaning up contamination that may have occurred a long time ago - even if the contamination occurred before they owned the property!  This liability is much different than an automobile accident where the incident is current, well documented and the remedies are routine.
  • In addition to Superfund liability, the wave of claims for lead paint, asbestos, radon, indoor air quality and now mold liabilities have driven most insurers to exclude coverage for any environmental condition.

JKJ understands that environmental insurance coverage gaps pose a serious threat to its policyholders and have developed an expertise in identifying environmental liability threats, managing and even insuring these risks with quality insurers who have developed environmental insurance programs.

JKJ is your resource for any concerns about your business and its impact on the environment.

Safe Travels:
Road Rules to Follow
by: Steve Ambrose

Did you know?

  • A study has shown that the distracted driver exhibits the behavior of a person with a Blood Alcohol Content of 0.8, intoxicated.
Our exposure to the unsafe driver is of concern for everyone.  We are exposed on our way to and from work, visiting clients, as seen by JKJ's own Risk Control Engineers, transporting our families and conducting personal business.  It is our responsibility as much as our neighbors to partake in safe driving habits.

One thing seen ad nauseam is the distracted driver
  • Drifting into our lane as they eat their burger/donut
  • Talking on the phone
  • Reprimanding or caring for children
Likewise, we have all had an experience with the aggressive driver
  • Zipping from lane to lane
  • Cutting off people who choose to travel at a safe distance

Everyone needs to consider these types of behaviors when driving.  This brings to mind a story...

When giving my sons their driving lessons several years ago, I tried to impress on them that they were getting the keys to a 3,000+ pound bullet that requires their undivided attention.  We are the pilots of this 3000+ bullet and we need to respect that.

One additonal thing to consider when driving is following the 2-3 second rule.  The 2-3 second rule is picking a marker and counting the # of seconds you pass that marker versus the car in front of you.

PLEASE DRIVE SAFELY...as if your life depends on it, because it does.

Bruce's Babble: Live in This Moment of Time
by: Bruce White

When I was a kid, I could not wait to get older!  Now that I am older, I tell all kids to enjoy their time as a kid because, before they know it, they are going to be older and wish they were still a kid!

My Grandmother once told me a story about my Uncle George...

The day Uncle George started his first job; he was having lunch with his boss.  Uncle George kept looking at his watch during lunch not wanting to miss too much of the day from the office.  His boss asked him for the watch and then his boss dropped it into a glass of water on the table.  His boss told him, "Live one day at a time! Do not look back and grieve over the past for it is gone; and do not be troubled about the future, for it has not yet come. Live in the present, and make it so beautiful it will be worth remembering."

Alexander Rose, a futurist, stated "I think the only time that matters is the time that each of us experience as individuals. Time is as variable as the human range of experience."

When I sit down with my children and talk for an hour, it seems like a minute, but if I am sitting in my dentists' chair for only a few minutes, it seems like an hour.  Our personal view of time shows us all that time is, what you make with it, and maybe more importantly, whom you share it with.

I know that I always feel like I do not have enough time in the day to get all of the things done that I need to get done.  But I have the same amount of time as everyone else!  I just need to enjoy the time that I have, with the people that I enjoy sharing it with, and live in this moment of time!

Multinational Insurance: An Expanding Exposure
 by: Brian Laurinaitis

Any company that has operations in more than one country is exposing themselves to sources of loss that are much different than those typically experienced by a solely domestic operating company.  The smallest of multinational operations require a specific analysis for obtaining international insurance.

From the simple task of salespeople traveling abroad to using a foreign company as a distributor, international exposures are present.  JKJ has always prided itself on proactively venturing beyond the issues of policies and rates to thoroughly understand our clients' organization, culture and unique needs.  This is demonstrated by our firm's commitment to:
  • Enhanced program design
  • Reduced premiums
  • Ensure service satisfaction
JKJ has taken this approach to another level with the recent developments in our International Insurance Department.

JKJ is an active member with UNIBA (
http://www.uniba-partners.com) who is an independent global network providing insurance brokering, risk management and employee benefit solutions to businesses and organizations in over 110 countries.

Our involvement with UNIBA is to:
  • Make global resources readily available to assist JKJ's client base.
  • Create joint initiatives with international associates to ensure that the same beliefs and values are shared amongst the group, throughout the world.
  • Identify areas of conversation, better comprehend how and why limits & coverages were negotiated and initiate discussions about the coordination between the global and domestic policies.

JKJ recognizes that the extent of the exposures companies face varies both domestic and internationally.  We will specifically look at international perils that may not be covered by a traditional insurance program by:

  • Evaluating your existing domestic insurance program
  • Coordinating and assessing global policies
  • Implementing risk management procedures
JKJ works cooperatively with your company as a consultant and is a constant source of knowledge.  It is our belief that we have a direct impact on the success of your company by becoming a reliable asset to your business operations.  If you should have questions or want more information about the international initiative of Johnson, Kendall and Johnson, Inc., please do not hesitate to contact us.

Moving Insurance:
Coverage Basics
by: George Pester

No matter how careful you are in choosing movers, accidents happen.  Boxes can be bumped, dropped or shift during transit and no amount of research will guarantee the safe arrival of your goods.  Moving insurance provides coverage for personal belongings during a move.

Decoding "Valuation"
Valuation is the predetermined limit of liability as stated on the moving contract or bill of lading.  Although valuation is part of a moving contract, it is not related to the actual value of your goods and is not insurance.  The t
hree types of valuation are listed below.

Declared Value
The value of your possessions based on the weight of the shipment times a specific amount per pound (ex. goods=15k lbs x $1.50/lb=$22,500).

Lump Sum Value (assessed value)
If your household goods do not weigh much, but are valuable, you may need insurance that is based more on cost than weight.  This means you can purchase insurance for a specific amount per $1,000 of value.  This must be declared in writing on the bill of lading.

Full Value Protection
This coverage includes lost, damaged and destroyed property. The coverage will pay for the repair or replacement of the goods.  Usually there is a minimum coverage amount and applicable deductibles.
