New Changes to Stormwater Runoff Regulations are in Effect

Revisions to NR 151 (Runoff Management) became effective January 1, 2011. The revisions add and modify performance standards that address runoff pollution from construction sites, developed urban areas, and transportation facilities.

The rule modifies the construction site performance standards to:

  • Apply prescriptive erosion control standards for construction sites of less than one acre.
  • Incorporate USEPA non-numeric effluent limits.
  • Effective in 2013, revise the sediment reduction standard to a maximum discharge of 5 tons/acre/year.

The rule revises the post-construction stormwater management performance standards by:

  • Removing the exemption from the total suspended solids standards of redevelopment sites with no increase in exposed parking or roads.
  • Adding the 1-year, 24-hour design storm for the peak flow control standard.
  • Adding a mid-level infiltration standard for sites with moderate impervious area to previous area development.
  • Revising the definition of highly susceptible wetlands that require a 75-foot setback.

The principle change to the developed urban area performance standard is the inclusion of a process that permitted municipalities can use if they cannot meet the total suspended solids reduction of 40% by 2013, allowing up to a 10 year extension if a stormwater management plan is developed and followed.
