Supreme Court upends tribal and federal understandings of IRA Tribes may seek congressional fix  By Rob Capriccioso Story Published: Feb 27, 2009   WASHINGTON - The Supreme Court has ruled in Carcieri v. Salazar that tribes not under federal jurisdiction as of 1934 cannot follow a longstanding land into trust process administered by the U.S. Department of the Interior. The ruling, which results from a suit involving the Narragansett Indian Tribe of Rhode Island, is at odds with many tribal, federal and legal understandings of the Indian Reorganization Act.

S. 338  Letters of Support -- Keep them coming!  This is federal legislation requiring the Lytton Band of Pomo to use the two-part determination process intended by IGRA.  This provides greater scrunity by the public and local government. Restores the management of the size and scope of gaming to the State of California.



REGION: Local tribes seeking federal stimulus funds-Bill set aside more than $3 billion for tribes nationwide   By EDWARD SIFUENTES - February 25, 20097:54 PM PST ∞ NorthCounty Times Tribes in San Diego and Riverside counties will be looking to get a share of billions of dollars set aside for Indian Country in the federal economic stimulus package approved earlier this month by Congress.Although some local tribes have become wealthy through their gambling megaplexes, poverty persists in other tribes in the region that have no casinos.
 
CITY COUNCIL 'EMBARRASSED' WITH RICHARDSON'S VOTE ON TRIBAL LETTER
Feb. 26, 2009 - Santa Ynez Valley Journal.  But the kudos were often followed by angry feedback from council members for Richardson's "no" vote on the Santa Ynez Band of Chumash Indians' request that SBCAG submit of letter of recommendation, on behalf of the tribe, for federal economic stimulus transportation funds.
The Chumash Tribe wants to use the funds for transportation improvements on the reservation. He said the available federal funding is for all Indian tribes throughout the United States, whether they have casinos or not, and the Chumash, who make revenue off their casino, have the money to pay for the improvements they might need on their land.

State Legislation:
HR 9: Price - Resolved by the Assembly of the State of California, That the week of March 1 to March 7, 2009, inclusive, be recognized as National Problem Gambling Awareness Week and the agencies and organizations described above be commended for their concerted effort to raise public awareness of problem gambling; and be it further  
SB 126: Cedillo - Legislation is also needed to clarify that existing law requires that all charitable bingo must be played using a tangible card and that the only permissible electronic devices to be used by charitable bingo players are card-minding devices.  
AB 293: Mendoza - (not sure of the intent of this bill)So far, addresses definitions etc.  This is a wait and see.
 
Federal Legislation:
