 Judge rejects NIGC's role in controversial casino case

The National Indian Gaming Commission lacked the authority to allow a Nebraska tribe to open a casino at a controversial site in Iowa, a federal judge ruled on Friday. In what appears to be the first case of its kind, Judge Charles Wolle said the regulatory agency shouldn't have determined whether the Ponca Tribe could build a casino in Carter Lake, Iowa. That decision lies with the Department of the Interior and the Bureau of Indian Affairs, the 11-page ruling stated. Feds halt ouster of San Pasqual tribal members12/1/2008, North County Times
The San Pasqual Band of Mission Indians' efforts to expel about 80 of its members was thwarted last week by the federal government, which concluded that the Valley Center tribe did not provide enough evidence to justify removing members of the Alto family from its rolls. In a letter to the tribal chairman, the U.S. Bureau of Indian Affairs said the descendants of Marcus R. Alto Sr., who died in 1988, should remain official members of the tribe.

VALLEY CENTER - The Bureau of Indian Affairs has denied the San Pasqual Indian band's bid to eject about 60 members, but said the tribe can appeal the decision about the disputed members' ancestry. Many tribes determine membership issues on their own, but San Pasqual's constitution gives the BIA that responsibility.

A Lame Duck session may begin Nov. 17/18, there is speculation of a  'Lands Ominbus bill' to be introduced by Senator Harry Reid. It will carry approximately 160 bills that have previously passed the House, as well as Senate Bills. MORE AS IT EVOLVES. 
 

H. R. 2963 - ENROLLED Congressman Issa Transfers without regulatory environmental process 1,178 ac. in Riverside and San Diego Counties to the Pechanga Band.  AMENDED TO INCLUDE: 
No Gaming. Maintained as open space and construction consistent with this purpose.
No existing right of ways or right of use prior to the date of enactment are affected. 
H.R. 3490 -REPORTED TO SENATE Congressman Radanovich Declares that specificed federal lands are to be held in trust by the US for the benefit of the Tuolumne Band of Me-Wuik Indians  for non gaming purposes.
H. R. 5680 REPORTED TO SENATE Congressman Grijalva - A bill to extend leases for Morongo and transfer money to CRIT.
