The correspondence between the Solicitor of the Department of the Interior and the National Indian Gaming Commission indicate a difference of opinion over who has what authority in making land determinations for gaming. The two letters below make clear the need for public comment on NIGC's recently announced extension of a comment period on "After Acquired Lands for Gaming". This is a vital issue to California. Judge maintains stay granted to challengers of proposed Gun Lake Casino 9/9/2008, mlive.com State of Michigan - Associated Press A CASE TO FOLLOW: WASHINGTON -- U.S. Supreme Chief Justice John Roberts last week refused to throw out a stay granted in August by the U.S. Court of Appeals that prevents an Allegan County tribe from securing land for a reservation for its proposed Gun Lake Casino. Roberts' action means Michigan Gambling Opposition will have the time needed to file a case with the high court challenging the constitutionality of how tribal reservations are created. (See- Michigan Gambling Opposition v. Dirk Kempthorne , the dissenting opinion is of interest.
Prosecutors say no improvements made on Duroville despite court order9/8/2008, The Desert Sun Federal prosecutors pushing for closure of a dilapidated desert mobile home park over health and safety violations told a judge today that plans and modifications promised by the facility's managers months ago haven't been made -- despite court-imposed deadlines. But the management team at the Desert Mobile Home Park in Thermal -- better known as ``Duroville'' -- said proposed work had been put on hold because government objections to park operations had prevented an already - approved $3 million bank loan from being issued. ``There are concrete actions in evidence at the park,'' said Mark Adams, attorney for the nonprofit Duroville Renaissance Crop., which has tentatively taken over managing the mobile home park. ``The only people who don't see progress are people who haven't been there in four months.'' Adams and other parties interested in the fate of Duroville appeared before U.S. District Judge Stephen G. Larson for a status hearing on recent steps taken to improve conditions at the 40-acre facility located on the Torres-Martinez Desert Cahuilla Indian Reservation

Class III Tribal State Gaming Compact Process9/2/2008, Federal Register SUMMARY: On July 2, 2008, the Bureau of Indian Affairs (BIA) proposed a rule to establish procedures for Indian tribes and States to submit Tribal-State compacts and compact amendments, governing the conduct of class III gaming activities on the tribe's Indian lands located within that State, for review and approval by the Secretary of the Interior (see 73 FR 37907). This notice extends the comment period for that proposed rule by 20 days, to September 22, 2008.
NIGC Announces Extension on Comment Period for After-Acquired Lands Policy9/4/2008, National Indian Gaming Commission Washington, DC September 4, 2008 - National Indian Gaming Commission (NIGC) Chairman Philip N. Hogen announced today that the agency is extending the time period for comments on how the NIGC should handle its decisions under the after-acquired lands provision of the Indian Gaming Regulatory Act (IGRA), 25 U.S.C. § 2719, in light of the Department of the Interior's new regulations on that topic (73 FR 29354). In an August 11, 2008, letter to tribal leaders, Chairman Hogen had asked for input on the issue by September 5, 2008. That timeframe has now been extended to September 30, 2008.

EPA sent reponses directly to the states on August 19 and tribes on or around August 20, 2008, and plans to make final designation determinations for the 2006 24 hour PM2.5 National Ambient Air Quality Standards.
