TONIGHT'S DANA POINT CITY COUNCIL MEETING
Tonight at 6:00PM the Dana Point City Council, the officially responsible government agency responsible for administration of the new Dana Point Harbor Local Coastal Program (LCP) will meet to review and likely approve revised language drafted by the Long Beach Coastal Commission Staff.  This language was required based upon stipulations made by the Commissioners during their review and approval of the LCPA (the "a" here is for amendment) last October.  Subsequent to tonight's City Council action, the language must then go back to the Commissioners for their final consideration in the June timeframe.


We have reviewed the 144 page document. (Click Here To Read)  Frankly there is nothing we have found in the revised language itself that warrants additional boater concern.  We will however be present this evening to speak to another, closely related issue:  The current scope of the landside expansion plan is unaffordable in today's economic conditions and were it scaled back somewhat (for example by elimination of the proposal additional 10,000 square foot restaurant pad) not only would it become affordable but it would eliminate the single significant boater concern on the landside.  Namely, the 14% reduction in dry storage and boat launch land surface area.   Further, we feel such a reduction in scope would position landside redevelopment to move ahead on a much faster track.  Why is that important?  Fast tracking will create badly needed Southern Orange County jobs while reducing construction costs by an additional 40%, according to OC Treasurer Chriss Street, via reduced profit margins now being reflected in government contract bids.
OC HARBOR PATROL FUNDING

As you know from our prior eNews Bulletins, the Dana Point Boaters Association is closely monitoring progress in Santa Ana regarding issues associated with the role and funding of OC Harbor Patrol, especially the operating unit based here in Dana Point Harbor.  But there is another angle we have been working on that you need to be aware of:

Starting this fiscal year, 3.7 million dollars is being illegally misdirected from the Tidelands Trust (OC Accounting Fund 108 which is Dana Point Harbor).   This 3.7 million dollar annual withdrawal represents over 20% of gross boater slip and dry storage rents today, and worse, this number is expected to grow even more next year due to unfunded County worker pension commitments.


We say "misdirected" because the Harbor Patrol provides a majority of its services outside Dana Point Harbor so Dana Point boaters should not be expected to fund these operations in entirety.   We say "illegal" because of directly applicable case law.  This very issue was settled by litigation in 1982.  As we have said, over and over, "Money earned in the Harbor must stay in the Harbor!"

 

This illegal misdirection has a dramatically negative impact on recreational boating opportunities in Dana Point Harbor, as evidenced by over 130 current slip vacancies.  We're not nuclear scientists of course (we're just boaters) but it seems obvious to us that if these funds were not illegally misdirected, then slip and dry storage fees could be immediately be reduced by over 20%.

Harbor WatchWe have discussed the Harbor Watch here before as this is a program that we believe is very, very good for our harbor, besides being fun to participate in.

KEEP AMERICA FISHING ACTION ALERT

Last fall, President Obama's Interagency Ocean Policy Task Force released its Interim Report regarding a new national ocean and Great Lakes policy. The Task Force, led by the Chair of the White House Council on Environmental Quality (CEQ), is charged with developing a national policy for conserving and managing the United States ocean, coastal and Great Lakes resources.  

 

Not only did the Interim Report ignore responsibly regulated recreational fishing as a key activity, but decisions made under this national policy could be used to unnecessarily close areas of saltwater and freshwater to recreational fishing. We have yet to see if the final report recognizes recreational fishing and balances sustainable uses with resource conservation.
