The California Coastal Commission ruled that the goal of dock reconstruction must be NO LOSS OF SLIPS.  If not feasible, then no more than 155 slips may be eliminated.

POSSESSORY INTEREST TAX UPDATE

Many of you had filed an appeal through Depasquale, Kelly & Co. for the 2008 year.  The appeals hearing was held October 6th, and the results were disappointing.  The appeals board declined to eliminate or reduce the tax for those represented by DKC, therefore there will be no change in the amount you were assessed and paid for the 2008 year.

While not the optimal result, it should be noted that the 2008 and later years did contain an approximate 30% reduction in value for expenses that were not made part of the valuation in the first year, 2007.  This expense  was, as you probably recall, a direct result of the successful 2007 appeal andreduction should continue in the future to reduce valuations. 

There were a number of members who filed appeals for the 2009 year.  Although the 2008 decision is not binding on latter years, it is not helpful.  DKC will represent boaters in one final attempt to overturn or further reduce the tax, with the appeals date yet to be determined.

Since the 2008 appeal did not produce a refund for boaters, DKC will not be presenting bills due to the contingent nature of the fee arrangement.  We do thank them for their efforts once again.
