USCIS EXTENDS I-485 FILING PERIOD UNTIL 8- 17-07!!

As a follow-up to our earlier Law Alert regarding the Department of State reinstating the original July Visa Bulletin making all employment-based filing categories current again, the USCIS has announced revised processing procedures for adjustment of status applications. Beginning immediately, the USCIS will accept employment-based applications to adjust status filed by aliens whose priority dates are current under the original July bulletin. Even though the original bulletin only allows filing for the month of July, the USCIS has extended the filing deadline to compensate for the filing time missed as a result of the earlier reversal. I-485 applications can now be filed through August 17, 2007. The USCIS also confirmed that applications already filed with the USCIS will be accepted.

Note, the CIS fee increases taking effect on 7/30/07 will apply to all cases filed on or after 7/30/07 including I-485 filings.
