LEED AP Legacy Status to be Inactive

with Launch of LEED 2012

As I am involved with the LEED 2012 Regionalization Indiana Chapter Task Force, I have attempted familiarized myself with the various drafts (18 variations of LEED in 5 basic categories by my latest count).  One interesting issue I have taken note of is the evolving language for IP Credit 2: LEED Accredited Professional (that's "IP" for "Integrated Process" - one of the new credit categories).

In the first draft of LEED 2012, IP Credit 2 stated:


At least one (1) principal participant of the project team shall be a LEED Accredited Professional (AP) with a specialty most appropriate for the project.
In addition, two (2) individuals representing primary disciplines on the project are required to be LEED APs (any specialty) or Green Associates.

 

This was interesting because there is no language addressing those LEED APs who have decided to not sign on with the GBCI Credential Maintenance Program (CMP) and assume a specialty (e.g., LEED AP BD+C, Homes, ND).

I signed on with the CMP back in 2009, but I know of several LEED APs who are electing not to join the CMP and assume the "Legacy" status (which is a glorified synonym for "inactive" in this case). The way I read the credit language, IP Credit 2 will exclude LEED APs with Legacy status from being recognized as active LEED Accredited Professionals.

 

I thought it would be appropriate to at least allow LEED APs with Legacy status to be recognized as one of the two secondary LEED AP representatives on a project along with Green Associates (as stated). A colleague and I drafted such proposed language and submitted it to USGBC. We did not receive a response, but perhaps that is because it was about to become a moot point. In the newly released second draft of LEED 2012, the IP Credit 2 language simply reads:

My assessment is that this language is likely to stick. So, to all LEED APs who have yet to join the CMP: Please do so immediately if you intend to continue serving as an active LEED AP on projects pursuing LEED certification.

It is now clear that LEED APs with Legacy status will be phased out from participating as active LEED Accredited Professionals starting with LEED 2012.

LEED 2012-Public Comment Now Open

 

USGBC has opened the second public comment period for the proposed 2012 update to its LEED green building rating system. The comment period, which will close on September 14, 2011, is the next step in the continuous improvement process and on-going development of the LEED program.

So now the kids are in school, we are getting some break in the heat (although I think we're on a heat wave right now).  I hope everyone is doing well as we prepare for the seasons to change.
 

I would like to thank the Northeast Branch of our Chapter for hosting their Annual Golf Outing last week.  I was able to play in the outing, and they really did put on a nice event, raising awareness in the Ft. Wayne area of what the USGBC Chapter is all about.  Great job!
 

As we move into September, I am starting to think about the Greenbuild Conference that is just around the corner.  This year it will be held in Toronto on October 4-7.  I have attended Greenbuild for each of the past four - it has been both fun and educational each time.  I'm really looking forward to it again.  The Chapter (as in years past) will be hosting a reception for the folks coming in from Indiana.  The details are being finalized, but please consider stopping by if you are in Toronto.
Finally, the Chapter continues to focus on planning for the Greening the Heartland 2012 conference, which we are hosting next year on May 16-18, 2012.  If you know of anyone who would like to take advantage of the many sponsorship/exhibit opportunities to reach people on both a local and regional level, please do not hesitate to contact us.

CHIP Grants Conserving Hoosier Industrial Power (CHIP)


A new round of funding for Indiana commercial or industrial facilities planning energy efficiency upgrades to existing facilities has been released. The Conserving Hoosier Industrial Power (CHIP) program provides grants from $100,000 to $500,000 to help pay for large-scale energy efficiency upgrades or retrofits. 2011 Application Due Date: September 23

 

In order to be considered for a CHIP grant, the proposed project must be located in Indiana, and demonstrate measurable improvements in energy efficiency, result in a reduction in energy demand, or implement an energy recycling process. Eligible project technologies include: lighting, lighting controls/sensors, chillers, furnaces, boilers, heat pumps, building insulation, windows, doors, energy management systems/controls, energy efficient compressed air, pumps and motors.


 CHIP is a competitive grant program, with applications being accepted between August 24, 2011 and September 23, 2011. While no local cost match is required, applicants may use leveraged funds to complete project funding. 

 

New Power Solutions

is working with large industrial clients on submission of grant applications for approval through this state program, our goal is 40 submissions.  We have been working with Knauf one of the larger donators to USGBC on the state level, in getting an application submitted for the Vairday Power System and Energy Efficient Lighting retro-fit at one of their plants, more specifically plant #3 in Shelbyville.

EPA regulations kick up some dust -coal dust!

In response to a 2008 court decision, the EPA has finalized rules requiring Indiana and 26 other states to cut power plant emissions that cause air quality problems in downwind states. It estimates that 400 to 2,000 premature deaths will be avoided in Indiana in 2014 because of reduced pollution.

The EPA is also expected to decide soon whether to tighten national air quality standards to reduce ozone from power plants and other sources. Depending on the new level allowed, more than two dozen Indiana counties could be out of compliance and face restrictions on business activities until ozone levels are reduced.

Purdue Solar Decathalon Update

Looking at INhome, short for "Indiana home," one wouldn't assume that it is net zero or even necessarily green, if not for the solar panels mounted on its roof. It looks like a quintessential Midwestern home, and that is exactly what Purdue University students intended for their 2011 Solar Decathlon entry. Ext 2

 

The Purdue Solar Decathlon team is aiming for a LEED Platinum rating through a variety of strategies. The home's exterior is clad in HardiePlank cement board siding over structural panels filled with blown-in polyurethane, resulting in an R-24 wall rating. The home's envelope is air-tight and will require little caulking during onsite assembly, and a series of overhangs will help to minimize heat gain in warm months.

 

For the interior, the team chose finishes that contain pre-consumer or post-consumer recycled content,

low-VOC paints, energy-efficient CFL and LED lighting, Energy Star appliances, and WaterSense toilets. Int1

 

INhome is divided into three overlapping rectangular modules - an attached garage, an open living/dining area, and separate bedrooms. The combined living and dining area features a vaulted ceiling and clerestory windows that maximize daylighting and make the home feel larger. The focal point of the living space is the "biowall," planted with English ivy, mint, and philodendron. It ties into the return vent of the HVAC system, naturally filtering the air.   Read More...

Update re Gifford, et al v. U.S. Green Building Council
Lawsuit against USGBC Dismissed!

On August 17, 2011, the U.S. District Court in New York dismissed the lawsuit filed against the USGBC by Henry Giffords, which had brought claims of false advertising under the federal Lanham Act and deceptive trade practices and false advertising under New York State Law.  The lawsuit contended that the plaintiffs were losing customers to professionals accredited by the USGBC due to the allegation that the USGBC misled customers into believing that LEED-certified buildings are more energy-efficient than non-certified buildings. 

The court dismissed the lawsuit because it found that the plaintiffs lacked "standing," meaning that the plaintiffs could neither show that the USGBC and the plaintiffs were direct competitors, nor that the alleged false advertising had harmed them.  The court dismissed the federal false advertising claims "with prejudice" meaning that the plaintiffs are barred from filing a new suit on those claims and simultaneously dismissed the state false advertising claims as well.

It takes a community to grow a USGBC Chapter

 

We here in Indiana, as members of the USGBC, exist as a collaboration of educators, investors, manufacturers and requisite representatives. Many of us are recognized as visionaries and builders, engineers and designers and all of us share hopes for a better tomorrow for our children, our grandchildren, and our communities today.  Together we must weather both the economic storms and natural disasters hitting us from all sides.  We are in the unique position to offer our communities guidance that will ensure the clean-up ahead of us includes better choices, collaborative design decisions and informed development decisions addressing both new construction, restorations or renovations.  The USGBC is here as a collaborative to address the needs of change in our built environment.    

 

We can use our role as a USGBC chapter to collaborate with our community leaders  in making a direct and positive impact on needed change within our immediate communities.  Being involved not only brings awareness of those unique needs defined by sustainable growth but can also help create opportunities for effective problem solving.
