Tipton Solar Project Earns National Recognition

Source: Green Business Network press release

Date March 11, 2011

Abound Solar's plans to open a solar module manufacturing operation in Tipton, Ind. received national recognition yesterday as a winner of Trade & Industry Development magazine's 6th annual Corporate Investment and Community Impact Awards (CiCi).

The project was chosen from hundreds of applications as one of the top 15 in the Corporate Investment category for the Colorado-based company's more than $300 million planned investment and anticipated creation of 850 jobs in the facility previously constructed in partnership with Chrysler for the German transmission maker, Getrag.

"Economic development is exceedingly competitive, especially in a tough economy. The publishers of Trade & Industry Development know an award-winning project when they see it and this recognition further underscores the fact that Indiana's business climate can attract the most sought-after investments in the country. We are honored that Abound Solar chose our state for its significant and game-changing community investment," said Mitch Roob, Secretary of Commerce and chief executive officer of the Indiana Economic Development Corporation.

"We are very pleased that the state of Indiana received one of our 2011 CiCi Awards for the Abound Solar project in Tipton," said Gavin T. Petty, managing editor of Trade & Industry Development. "The project was included in our Corporate Investment division, and represents a $300 million investment. It
is also quite notable for the 850 jobs that will be created, and for the fact that this project represents a significant footprint in the growing field of alternative energy and economic diversification for Tipton."

How the Climate Crisis Threatens Our Health and What We Can Do about It

Proclaimed "a landmark" by Al Gore, this eye-opening book reveals the complex links between global warming and cholera, malaria, Lyme disease, asthma, and other health threats.
A brilliant collaboration between health and disease expert Paul R. Epstein, MD and award-winning Hoosier science journalist Dan Ferber, Changing Planet, Changing Health is much more than a primer on climate change. Connecting stories of real people with cutting-edge scientific and medical information, this book presents the first in-depth, on-the-ground investigation of the health risks posed by climate change. In concise yet accessible language, these experts describe the web of connections that link global warming to declining human and environmental health. Along the way, they offer insight and inspiration for shaping a healthy global future.

USGBC National News

Just The Facts: an update on USGBC litigation

Source: Russell M. Webb III
            Drewry Simmons Vornehm, LLP
            Carmel City Center

Summary of Gifford, et al v. U.S. Green Building Council (USGBC)
(U.S. Federal Court, Southern District of New York)

In October 2010, Henry Gifford sued the USGBC for violation of federal anti-trust laws, unfair competition under the Lanham Act, deceptive trade practices, false advertising, wire fraud, and unjust enrichment relating to the USGBC's creation, use and promotion of its Leadership in Energy and Environmental Design (LEED)
certification program.

Among Gifford's allegations were the contentions that the USGBC fraudulently misled stakeholders with claimed benefits of third-party verification, higher lease rates, enhanced resale values, potential tax credits, energy and utility cost savings, and the ability to offer financial benefits to tenants, such as operating cost savings, improved worker productivity and health, and risk management benefits.  This original action was brought as a class action suit on behalf of all persons who paid for LEED certification, all persons who design energy efficient buildings, all taxpayers whose tax dollars were spent on the cost of LEED certification of public projects.

In February 2011, the plaintiffs in Gifford filed an Amended Complaint, which no longer seeks class action status and narrows the action to injunctive relief and damages for false advertising under the Lanham Act and deceptive trade practices and false advertising under New York State Law.  The basis for the lawsuit continues to be that the plaintiffs are losing customers to professionals accredited by the USGBC due to the allegation that the USGBC's false advertising and deceptive trade practices mislead customers into believing that LEED-certified buildings are more energy-efficient than non-certified buildings.  As this action is still early in the pleadings stage, all we have to examine at this point are the allegations of the plaintiffs.
Stay tuned to this issue as it will be interesting to review the substantive response from the USGBC.

We Need Your Help

Any amount of time you can spend helping USGBC-IN would greatly be appreciated. Our message for sustainable living can only make an impact when your actions make it real and you make the difference in your own communities.

Volunteer activities can be ongoing requiring a few hours of your time per month.  in program organization, advocacy opportunities, media communications, and collaborative events.  There are several events and projects that would benefit from just a few hours of your time.
