This week's newsletter contains several important pieces of information.
 
First, there are multiple community events taking place - Friday Burgess Peterson is holding their re-scheduled Fall festival and EACA and the Friends of Brownwood Park are sponsoring a Community Night at the Brownwood Rec Center (see immediately below). Saturday continues our Halloween weekend festivities in East Atlanta with the ever-popular EAV-O-WEEN.
 
This issue of the newsletter also contains a public safety update from East Atlanta Security Patrol.
 
Additionally, you will find a full overview and a link to a proposed distance exemption ordinance affecting our business district. Please take the time to read through and provide any comments you have, or send in your questions.

Burgess-Peterson Academy Fall Carnival - RESCHEDULED!
Friday, October 30th - 3:00 to 6:00 p.m.
Come out and celebrate at Burgess-Peterson Academy! We will be hosting our annual Fall Carnival on Friday, October 30th, from 3:00-6:00pm. Please come out and join in the fun. We will have games, jumpies, and lots of goodies for kids of all ages. All monies raised will be used to support innovative ideas and programs for the children of Burgess-Peterson Academy.  Drafted Distance Exemption Ordinance in East Atlanta Village
As you all know, there has been an on-going effort for several years to modify the current distance restrictions placed on businesses which sell alcohol for on-premises consumption.  Specifically, the effort has been to make it possible for businesses to offer live musical entertainment, which they are currently precluded from doing by the ordinances.  The proposals represent the combined efforts of business owners, residents, and neighborhood leadership to craft a balance which would allow for such live performances and at the same time ensure that interests of other businesses and residents are adequately protected.
 
Area Covered by Ordinance: Glenwood Ave: Joseph to Haas. Flat Shoals Ave: Metropolitan to May.
 
General Conditions - Applicable to all business which seek to use the exemption, whether they have a live performance scheduled or not.

  • Have people stationed outside of the licensed premises making sure that no person left with any alcohol or beverage container.
  • Place refuse receptacles directly in front of the licensed premises to allow for trash to be deposited.
  • The business would agree to respond in writing to any concerns regarding its operations.
  • The physical structure would be maintained in good repair.  The grounds of the premises would be swept daily. Exclusive enclosed and screened Dumpster for each business.
  • If there was a noise complaint stemming from the performances, the business would agree to enter into a process to resolve the issue.
Live Performance Conditions - Applicable only to businesses which are having live performances.
  • Hire an off-duty Police Officer to patrol for parking violations at least two hours after any performance begins and for noise, litter, vandalism, and similar violations at least one hour before and after closing time.  This would be a total of four hours per night per performance.
  • Have exclusive parking available during the time of any performance with a ratio of one parking space per four potential attendees at the event within 400 feet of the facility or have valet service available.
  • No later than 8:00 AM on the day following any performance, all glass bottles, plastic cups, aluminum cans, cigarettes, matches, and cigarette packs would be collected.
Benefits to Businesses -
  • The distance requirements set forth in Section 10-88(a) & (b) shall not apply.
  • Alcohol can be sold on Sunday until 3:30 A.M. Monday, rather than ceasing on 12:00 P.M. on Sunday.
  • Alcohol can be sold until 3:30 A.M. Monday - Saturday,  rather than ending at 2:30 A.M. on Monday - Saturday;
  • When there is a Special Event which has a Temporary Alcohol License, alcohol can be transported between the event and any Licensed Premises next to the event, if both the Special Event Applicant and the Licensed Premises agree;
  • When there is a Special Event which has a Temporary Alcohol License any business next to the event can expand the boundaries of its licensed premises into the temporarily licensed premises so that the two overlap, if both the Special Event Applicant and the Licensed Premises agree;
  • Outdoor music is permissible, but it is not permitted to be audible at a distance more than 100 feet from the property line of the licensed premises at which it is being played;
  • Bars, which could not otherwise sell alcohol on Sunday, can do so if they have a Ticketed Performance taking place on that day;
Process for Seeking Exemption
  • Business Submits Application for Exemption to License & Permits Unit.
  • Review by Neighborhood Planning Unit of Application.
  • Special Panel Convenes to hold Public Hearing to review Application.
    • Special Panel made up of: Director of the Bureau of Planning, Commissioner of Public Works, Presiding Officer of Neighborhood Planning Unit, and the Atlanta Police Zone Commander.
    • Special Panel considers following factors in determining whether to grant a request for an exemption, and if so, under what additional requirements to impose:
      • The unique geographical circumstances of each business relative to other commercial and to residential properties.
      • Impact of criminal activity;
      • Impact of traffic;
      • Impact of parking;
      • Impact of patrons walking to and from vehicles;
      • Impact of debris & litter; and,
      • Impact of noise.
  • Exemption would automatically renew, unless complaint made, and then Special Panel would review complaint to determine appropriate course of action.
General Information
  • The Ordinance shall operate for a period of three years at which time it will cease to be in effect.  At that point the community will have the opportunity to determine whether they wish to re-enact the Ordinance, or allow it to expire.
Attached please find the revised version of the Alcohol Distance Exemption.  It has been revised based on the comments received during the course of the committee's meeting as well as input from multiple other sources.  Also attached is a map with the specified areas.

 EASP Update
As always seems to be the case, the months of September and October have been very high periods of crime in East Atlanta.  September had the highest number of burglaries recorded in the years since EACA began tracking crime.  And in early October we experienced perhaps the worst single week of burglaries ever recorded.  Fortunately,
there has been a drastic reduction in crime the past couple of weeks.  One of the reasons would seem to be a marked increase in police presence between the hours of 3 pm and 3 am.  This has led to a significant reduction in all crimes.  With only about five reported car break-ins during the past four weeks, we're at the lowest levels for this annoying crime in many years.
 
Burglaries are another story, and even the increase in patrols was not doing much to solve the problem.  However, some recent arrests seem to have turned the tide in the past couple of weeks, along with a reallocation of APD overtime units and East Atlanta Security Patrol (EASP) resources toward more daytime patrols.  However, we should not relax and think that all of our problems are solved.  Here are some additional steps that we encourage all residents to be taking:

  1. If you see suspicious people or vehicles, please call 911 and then call or text the East Atlanta Security Patrol at 404-429-8815.  Sending an e-mail to your neighbors is smart, but quickly contacting 911 and the EASP gives us a chance to respond to crimes quickly.  Don't worry if the call is not an emergency, the police and the EASP want you to notify them of suspicious activity before it becomes a crime.  You do NOT need to be a member of the EASP to report crimes or suspicious activity.
  2. Be wary of all strangers visiting your home or the homes of your neighbors.  If you aren't sure if it's worth a call, it probably is.  At the very least, you alert the police and the EASP of a possible problem before a crime occurs.
  3. If you have a burglar alarm, turn it on.  Whether at home or away, turn it on.  And that includes activating motion sensors when you are away.  If you have a pet, discuss with your alarm company what options exist to prevent your pet from triggering the alarm, or simply keep your pet in areas of the house where the motion sensors can't see it.  Most significant burglaries occur when no alarm is on.  If an alarm is on when burglars enter your home, they will often be scared away or take a couple items and leave quickly.  And if you haven't upgraded to a wireless alarm system, consider doing so.  Phone lines do get cut by more savvy burglars, which disables alarms tied to a regular phone line.  It's even a way to save money, as wireless alarms have allowed many residents to discontinue their home phone service from BellSouth, a far greater savings than the $5-7 monthly cost of adding wireless monitoring.
  4. Never assume that information you give to a police officer responding to a 911 call is being translated into action.  One of the reasons we encourage people to call the EASP after calling 911 is to make sure that information is passed on to future shifts of both the EASP and APD.  It's sad that we must check up on the police and do some of their job for them, but that's a reality.  If you assume that the officer responding to your call will make sure that information gets passed on to all of Zone 6 or even the next shift's beat officer, you may be disappointed.
  5. Be sure to inform the EASP if you will be out of town.  With the holiday season approaching, we will see burglaries of homes while people are away for Thanksgiving and Christmas.  EASP members can e-mail a single form with the dates and times of their trip, and have extra patrols performed by EASP officers, APD and Safe Watch volunteers.  If you wish to become an EASP member during November, be aware that you need to sign up by Sunday, November 1st.
  6. As discussed at our last EACA meeting, we encourage residents to join the Twitter groups that are set up in our community.  There is no cost to join, other than standard text messaging rates.  The two that seem worthwhile, whether you live within the city of Atlanta or unincorporated Dekalb County, are eav911 and EASP.  Neither group sends out more than 5-10 messages per month.  The eav911 group is focused mostly on immediate, actionable alerts where residents can be watching for a suspicious person or vehicle.  Residents are also encouraged to send alerts to the community if they see suspicious activity.  The EASP group is used occasionally for urgent alerts, but is more to inform residents of updates to the EASP website that may pertain to topics such as a bond hearing for an area criminal, a violent crime that seems worthy of immediate reporting, or even an area or street where residents need to be alert due to recent criminal activity.  Beginning in November, select APD and EASP officers will be trying out membership in these groups.  We'll have some feedback at upcoming EACA meetings as to how well this trial is going.  EACA is also working on a similar arrangement with Dekalb County Police officers.
Finally, we want to remind all residents to be aware of their surroundings and to be cautious even on their own property.  This report from Monday, October 19th came from the new lofts at Moreland and Ormewood.  Do not open the door for anyone you don't know, day or night.
 
On October 19th at 2:00 pm, two black males knocked on a door and asked the resident to sign a census form.  When the victim stated he was about to leave and didn't have time the suspects produced a gun and forced their way into the apartment.  Both victims were forced to lie on the ground and had their property taken.  One of the suspects fired one round at the victims, which struck the floor.  Both suspects then left the area in a white, newer model Chevy Malibu which was being driven by an older black female.  The suspects were described as two black males; one was about 5'11" and 170 pounds wearing a hat, blue jeans and a blue coat and the other was about 5'10" wearing a white dress shirt and khaki pants.

 EACA Seeking New Leadership
EACA is actively seeking new leadership for next year.  Current President Jelena Crawford will not be eligible to return next year and current Secretary Lea Johnston will be welcoming her firstborn into her family.  This is a great chance to improve your neighborhood in areas such as Public Safety, Code Enforcement, Land Use and Zoning, Education and Transportation to name just a few.  Elections will be held at the December 14th EACA meeting for all four officer positions, including Vice President and Treasurer.

 Beltline Corridor Environmental Study Fall Public Meetings
MARTA and ABI are holding a series of meetings in No vember 2009 to present progress-to-date and solicit feedback from the public on the analysis of potential transit and trails routes. The purpose of the meetings are to:
  • Inform the public of the study status;
  • Present results of the evaluation process; and
  • Solicit feedback regarding the evaluation results to inform upcoming decision-making.

Revisions of the technical evaluation process will take place using the information and responses gathered from the public meetings. This insight along with ad ditional technical work will help to bring the BeltLine Corridor Environmental Study to completion with a Tier 1 Environmental Impact Statement (EIS). The final Tier 1 EIS in turn aids the decision-makers in the selection of a preferred transit and trails route.
 
Feedback Desired from the Community
Public meetings get the community involved in the study process and help to collect vital information that to use in the study's planning, design, and engineering outcomes. One of the BeltLine's long-standing objectives is to get the people of Atlanta involved in the entire BeltLine process, from inception to operation.
