2009 H1N1 Cases Are Now Recordable On The OSHA 300 Log

OSHA announced that work-related cases of 2009 H1N1 are now recordable. Employers are responsible for recording cases of 2009 H1N1 illness if all of the following requirements are met:
  • the case is a confirmed case of 2009 H1N1 illness as defined by CDC;
  • the case is work-related as defined by 29 CFR 1904.5; and
  • the case involves one or more of the recording criteria set forth in 29 CFR 1904.7 (e.g., medical treatment, days away from work).
Note: This recording criteria applies to all establishments covered by 29 CFR 1904.
This is a change in policy regarding H1N1 flu recording. OSHA has always required that work-related cases of communicable diseases such as tuberculosis and Hepatitis A be recorded. Cases of the common cold and flu were exempt from the recordkeeping requirement, and until now, cases of H1N1 flu did not have to be recorded.
