topBill to Treat Use Tax Payers Fairly Signed into Law

 

House Bill 5543 was signed into law by Governor Snyder. The Bill was proposed as a means to alleviate the current audit practice of allowing use tax audits going back up to 10 years.

 

Over the past several years, taxpayers have been surprised and caught off guard by use tax audits with assessments going as far as 10 years back even though taxpayers may have filed returns during these periods. This has been caused by the Michigan Department of Treasury's aggressive interpretation of the related statutes. For example, the Department deemed that a return was not filed by the mere absence of a written zero on the use tax line of a sales, use, and withholding return; thus not starting the statute of limitations which would otherwise limit the years that the Department could review. The passage of HB 5543 clarifies that the filing of a return includes the filing of a combined, consolidated or composite return, whether any tax was paid and whether or not the taxpayer reported any amount on the use tax line, including zero. Therefore, as long as the taxpayer has timely filed their sales and use tax returns, the Department will not be able to go back 10 years to conduct use tax audits.
