Employers who pay their non-exempt employees on a semi-monthly basis or twice a month must ensure timely payment of wages as defined by the Fair Labor Standards Act. 

 

Labor performed between the 1st and the 15th must be paid for between the 16th and the 26th day of the month during which the labor was performed, and labor performed between the 16th and the last day of the month, shall be paid for between the 1st and 10th day of the following month. 

 

It is important for employers to evaluate their payroll schedule to ensure compliance.  Penalties for failure to pay wages in a timely manner may be assessed.

Several questions arose from the recent newsletter I submitted on July 5th announcing the increase to the IRS mileage reimbursement rate. I thought that I would share those questions with you just in case you may have had similar questions.


1.) What agency requires an employer to reimburse an employee for costs associated with using their personal vehicle for company business?

The Department of Labor has implemented California Code of Regulations which outlines the requirements of employers as it relates to Travel Expense Reimbursement. 

 

2.) What is mileage reimbursement?

The sum paid to an employee to indemnify the employee for the necessary costs incurred in operating vehicles provided by the employee for work, excluding the mileage driven commuting from home to work with some exceptions.
