Our September meeting was excellent.  Thank you to member and host, TileShop, for the great venue, food, and panel of speakers.  A special thanks to Claudia Hacker for orchestrating this meeting, and thanks to the industry panel of Riley Doty, Danielle Di Pianto, and Rick Moale for a very informative and passionate discussion about the topic, "Significant Factors in Choosing Grout," which stimulated great interaction between the audience and the panel. 
  
As we were preparing our Co-President's message this month, we were reflecting that San Francisco and the Bay Area is embarking on one the biggest weekends ever.  Fleet Week, with the Blue Angels precision flying team, the Bluegrass Festival, America's Cup Racing, the Giants and A's Playoff Baseball, the 49ers football game, the Italian Heritage Parade, and a multitude of other events will push

the limits on tourism and entertainment enthusiasts.  Any one of these events is enough by itself to gain massive attention and interest.  We are fortunate to live in an area that can offer a multitude of these types of events.

Not to draw any type of comparison, but the next two events that our Chapter will be conducting are huge for us.  Right around the corner next week is our 7th Annual Golf Tournament and Dinner.   We would like to recognize and extend a huge thank-you to Adam Haedt, Tournament Chairman, and the rest of the Golf Committee, for their efforts in preparing for this event.  Not only will it be a fun day of golf, but we will have a spectacular dinner party, live music by our very own Bill Essert's JazKatz band, and an amazing array of items that we will be raffling off.  We also would like to acknowledge our Club Pro Sponsors Cambria USA and Stone Etc. for their efforts in making our annual event a success.  It's not too late!  There is still time to sign up for golf and/or attend the dinner party.  We are expecting another huge turnout. 
  

 

Next month, we have our Annual REMMIES and Leadership Awards Dinner, which will be held on November 14 at the Sir Frances Drake Hotel.  All submitted REMMIES projects have been reviewed and voted on by a distinguished panel of judges.  This is a wonderful event that our Chapter hosts and is a great evening to support the members of our Chapter and our sister Chapters in Diablo Valley and the North Bay, recognizing exceptional work in the industry.  In addition, we honor and recognize the leaders in our Chapter over the last year.  The evening also includes our annual election of Officers and Board of Directors for the coming year.  Please show your support and plan to attend.  NARI National President, Dean Herriges, MCR, CKBR, will be attending the event and will be swearing in our new Officers and Board of Directors. 

 

We would also like to acknowledge one of our newer members who recently submitted her candidacy for the Chapter's Board of Directors -  Alisa Hoffman of Design, Set, Match.  It is great for the Chapter to have new, enthusiastic members get involved.  We all benefit from having new perspectives and energy joining the Chapter's leadership.  We strongly encourage those of you who have an interest to submit your Declaration of Candidacy form, which you can obtain from our Executive Director, Judy Tufo.  Please call Judy at (415) 391-2886 or email her at judy@sfbanari.org.  The deadline for submission of forms is Friday, October 12.

 

Our Board meetings are open to both new and long-time members to attend and would be a great introduction to those, in particular, who are new to the Chapter and are potentially interested in getting involved.

2013 Contractor of the Year (CotY) Program

CotY Program for Projects Finished Between July 1, 2011-November 30, 2012

    

 

 

 

 

NARI members across the nation are invited to compete for the prestigious 2013 CotY Awards in recognition of their achievements for remodeling projects finished between July 1, 2011 and November 30, 2012.   Each year, NARI has both first-time entrants and seasoned participants that go home with Regional and National Awards.

New NARI Member Benefit - Home Depot Rebate Program

NARI has a great new program that can earn money for you! As you may know, NARI has a relationship with The Home Depot.  We want to  leverage this relationship to put money back in your pocket. 

 

As part of the program, you can receive a 2% rebate based on purchases you make at The Home Depot.  All NARI members in good standing are eligible for this rebate.  The 2% rebate is paid by The Home Depot directly to you twice per year.  In order to begin earning your rebate, you must be enrolled in the program and then register the accounts you use or plan to use to pay for items at The Home Depot (i.e. credit cards, checking accounts, and keytag accounts). To make it as easy as possible for you to take advantage of this rebate, we have put together three simple options to get enrolled and register your accounts:

  

      Go to:   https://cpr.homedepot.com 

  • Follow the on-screen instructions or refer to the Program Enrollment Guide (link is below).
     
  • Call the toll free number (866) 333-3551, and a Home Depot Support Center associate will enroll you and register your payment information (their support center will call this "tenders").  Please be sure to tell the representative that you are in the NARI Program.
     
     
  • If the Home Depot Support Center has not received a call from you and you are not enrolled nor registered any tenders, they will call you to complete the enrollment process!

We wanted you to know about this process so you could register immediately and start earning your rebate.  This is one of the most valuable benefits you receive as a NARI member, so if you have not completed steps 1 or 2 as outlined above, you should expect a call from The Home Depot Support Center team.  If you receive a call from The Home Depot Support center, you should know: 

  • The representative will tell you they are calling about the NARI rebate program
  • They will ask for your company name, address phone, email etc.
  • They will give you a user name and password
  • They will ask to register your "tenders".  This means that they will ask you for the credit card, checking, and keytag account numbers you currently use or plan to use at The Home Depot.

In order to ensure you are speaking with an authorized account representative, please ask them for the verification code.  The code is "NARI402". This is for your protection, so you can feel safe providing this information over the phone. It's your verification that they are authorized to call you. 

Once the code is confirmed, you know that you may safely share your credit card information.  The representative will not ask you for the "CID" number on your card so do not share that information. 

 

All credit card and bank account information is immediately encrypted by the system. It is stored and accessed by processes that are audited and compliant with PCI (Payment Card Industry) standards for security and privacy so your information is safe.

Tendering The Claim to Your Commercial

General Liability Insurance Carrier

This is a short, general and remedial article revisiting an always important topic.  In the past, I have discussed it in more depth.  But with the economy improving and more work out there, we are seeing more  claims. 

 

Notice Required.  So, you received a notice of claim made by the property owner.  What to do?  Or more properly, what should happen next? 

 

The first and most important step is to notify your commercial general liability insurance carrier of the claim.  This should be done as soon as possible. 

 

In the event of a claim or lawsuit, one should immediately forward every demand, notice, summons or other documents received to their carrier.  The typical commercial general liability policy contractually requires the contractor to promptly notify the carrier about potential claims as well as actual claims. 

 

The Two Basic Obligations.  Commercial general liability insurance policies create two basic obligations for the carrier: first, to defend claims within the policy, and second, pay damages if warranted.  "Defending a claim" in real world terms almost always means providing its insured with legal counsel.  This is the broader duty of the two - and perhaps the more important.  It is not unusual at the end of the day for the attorney fees to be greater than the settlement itself. 

 

The Tender.  When making a "tender" - conveying a claim to the insurer - it is always best to do so in writing, thus creating a paper trail.  The tender should be brief, but provide the relevant information.  Your insurance carrier should follow up with you regarding the tender.  Additionally, it is advisable to provide your carrier with all additional documentation you receive regarding the claim.   

 

"Slow Hand" Carriers/What To Do.  It has been the experience of some of my clients who are recent claimants that their carrier is slow and/or reluctant to accept a tender for no apparently good reason.  Thus, follow up calls and letters may be necessary. 

 

Sometimes taking it up a level helps speed the process; you can always request to speak with a supervisor if the claims representative is slow.  And a friendly, bracing letter from your counsel - including references about a carrier's fiduciary duty - often works wonders in getting the matter properly and promptly handled.

 

Once the tender has been made to your carrier, you must now allow them to investigate and retain coverage counsel on your behalf.  You are generally required to use the attorney that the insurance company chooses, but usually they are pretty good.  (Disclosure: my son is one of those fellows.)  Since the insurance company is footing the bill, the insurer is for all intents in charge.  Participation and cooperation from you the insured to your carrier is required, and always makes sense.

 

This Can Be Complicated - Talk to Your Own Attorney.  With all respect to the insurance industry, carriers can be slow or balky when the tender comes in.  Thus it is always a good idea to talk to an attorney.  Such a discussion can be especially important at the front end of the process to ensure it is promptly accepted.
