The Value of NARI Membership It's Time for Rebuilding Together

Thanks again to our March meeting host, Earthsource Forest Products, and our featured speaker, Chip Doyle of Sandler Training, for an excellent Chapter meeting. Despite the stormy weather, it was an outstanding evening in an interesting venue with a wonderful and interactive program. Chip really engaged the audience, and there was active participation with guests and members alike. It was another excellent Chapter meeting.
The majority of the Chapter membership should have received their annual Membership renewal package. We hope that those of you who have not already positively responded have full intentions of renewing your membership, and we strongly encourage you to be sure to renew during April.

never want to lose sight of the basic value a NARI membership has to offer our members. There is access to an excellent cross section of LOCAL experts that collectively can give you a good insight as to how the local industry is performing. What better way to keep your finger on the pulse of the remodeling industry than to pick up the phone and reach out to your fellow NARI members. Ask them how their business is performing. There are always opportunities to cross promote members' businesses. We want you to continuously find value in your membership. Some of the real value in membership is by attending Chapter meetings, networking at those meetings, and the educational opportunities that are offered. Another real and growing value that affects your bottom line is by working with other NARI members. There is increasing value of NARI members working with each other, and that network is continuously growing.
It's April, which means it's time for the annual National Rebuilding Day with Rebuilding Together. This year, we are partnering with Rebuilding Together Oakland. There are still plenty of volunteer opportunities available for those interested. Please see the article later in this Newsletter for further details on how to volunteer for this extremely worthwhile program. We need you!

Fabulous Meeting at Earthsource Forest Products
Big thanks are in order to the entire staff at Earthsource for hosting a wonderful Chapter Meeting. We really appreciated all the extra effort to accommodate our members and guests, despite the inclimate weather.
The atmosphere inside the Urban Jungle Showroom was jumping, despite the bad weather! We had a lively crowd of enthusiastic members and guests, with lots of good networking going on.
Our sincere thanks to our presenter and SFBA NARI Board Member, Chip Doyle, from Sandler Training, who gave an absolutely fabulous presentation on best practice s for lead generation and sales. Chip captivated his audience with a wonderful interactive program; despite the poor weather conditions, members and guests alike stayed for his entire presentation and even participated in a post-presentation evaluation. Thanks Chip!

Generate Leads With Photography | | |

How many times have we heard that a picture is worth a thous and words? Good photos generate emotional impact and thats what you need to grab the attention of your prospective clients. I can also safely say that your primary source of new business is referrals. I've been giving some thought to how you can use photography to generate referrals. Some of these ideas I've heard from talking to my clients and some are simply ideas I'd like to throw your way.
Here are some ideas:
Share photos of the finished project with your client. Encourage them to put the photos on Facebook. If they share the photo with their friends, you will reach more people. Your return on your time and money will likely be much higher than direct mail, or other forms of advertising.
Set up a Twitter account for your next project. Make sure your client follows your twitter postings. You can share progress photos this way, for example, a photo of tile being installed. You can even use your smartphone to snap the photo and send the tweet. The homeowner will likely show the photo to co-workers or neighbors, and you can encourage him to send the tweet to his contacts. This will give you more exposure and turn your clients into sales people working on your behalf.
Put a photo on a note card and use the note card as an invitation to send on behalf of the homeowner for an open house. Get the mailing list from the homeowner and send the invitations hi his/her behalf. This, of course has to be coordinated with the home owner, but it's an excellent way to get your name in front of prospects.
Use an on-line e-mail distribution service such as Mail Chimp or Constant Contact to stay in touch with your clients and prospects. Send out an email on a regular basis, perhaps every month or two. Include a photo of a recent project, and a short story, written to capture the attention of the reader.

Please check it for accuracy, including address, phone number and email address information, as well as the most correct category specialty information. As a reminder, Standard Web Package allows you to have 5 category choices, and the Enhanced Web Package allows you 10 category choices.

New Laws for 2012 That Affect You

With the new year fully launched, contractors must be mindful of the new laws impacting the construction industry. There are many new laws. There are also many lists of these new laws - including one on the Contractors State License Board website. But the following discussions are about what I consider to be the several important new statutes the working contractor needs to be mindful of. Please note the following changes take effect on July 1, 2012 unless otherwise noted.
Changes to Mechanics' Lien Laws. The California Legislature has revised and renumbered the Mechanics' Lien laws. (Why I don't know.) They can now be found in California Civil Code Sections 8000 to 9566. These changes are the second round of changes to the California Mechanics' Lien law. The first changes took effect in January 2010.
Terminology regarding mechanics' lien has changed. For example, "direct contractor" is used in place of "original contractor"and is defined as "a contractor that has a direct contractual relationship with an owner" (Civil Code §8016); "Materialman" has also been replaced with "material supplier" (Civil Code §8028). The once used "20-day Preliminary Notice" is now referred to "Preliminary Notice."
Civil Code §8416 - The "proof of service affidavit" must establish service on the property owner. It is required that the affidavit show the name of the owner or reputed owner of the property, and the title or capacity in which the person or entity was served.
Civil Code §8132 - 8138 - Statutory waivers and releases have been revised. (Such provisions will also apply to subcontractors.)
My Comment. Failure to both serve the mechanics' lien and the proof of service affidavit on the owner will cause the mechanics' lien to be void and unenforceable. This is tricky stuff; be sure to get it right. Business & Professions Code §7125.5 - Contractors renewing license must certify workers' compensation status. Upon renewing, an active contractor licensee with an exemption for workers' compensation insurance on file with the Contractors State License Board must either recertify the licensee's exemption or to provide a current and valid Certificate of Worker's Compensation Insurance or Certificate of Self-Insurance.

This bill would also provide for retroactive license renewal for otherwise acceptable license renewal when the documentation is provided within 30 days after notification of the renewal rejection.
Business & Professions Code §7125 - Workers' compensation carriers must report cancellation of policy to the Contractors State License Board.
Workers' compensation insurers are now required to report to the Contractors State License Board a licensee whose workers' compensation insurance policy is canceled and found through audit or investigation that the contractor made material misrepresentation.
Willful or deliberate disregard and violation of workers' compensation insurance constitutes a cause for disciplinary action by the Registrar.
Business & Professions Code §7145.5 - Contractors State License Board may discipline contractors for failing to pay Board of Equalization liabilities. Registrar may refuse to issue, reinstate, reactivate, or renew a license or may suspend the license of a contractor for failure to resolve outstanding liabilities.
My Comment. These statutes should help the State of California chase those scofflaws who presently make our dreadfully costly workers' compensation system even more costly.
Independent Contractors. Labor Code §2256.8 - Stiff new penalties for willful misclassification of employees as independent contractors. The Labor and Workforce Development Agency is now authorized to issue fines for the willful misclassification of employees as independent contractors, the Board will be notified of violations by licensed contractors. Disciplinary action will be taken against violators, and notice of violation must be posted on websites.
My Comment. Is California as a governmental entity finally going to chase some of these bad guys? This is another tool if it wishes to.
Small Claims Court (effective January 1, 2012). Civil Code of Procedure §116.221 - The maximum amount an individual is now allowed to recover is $10,000. Businesses are still capped at $5,000. However, the limit on businesses does not apply to sole proprietors.
My Comment. This is good for the consumer, but not so much for your typical law abiding contractor, who is incorporated. And it makes for even more confusion. Our friends in the Legislature should simply increase the limits for everyone.
