NARI is steadily becoming a major force in the remodeling industry. NARI members received a notice earlier this week from National regarding Congress' consideration of legislation that would restore the "opt-out" provision to the EPA's Lead Renovation, Repair & Painting (LRRP) rule. The leadership of NARI's Government Affairs was seeking the opinions of NARI's 7,000+ members to assist with the development of a position on this important legislation. NARI is rapidly becoming a "mover and shaker" in Washington and has the ability to shape and influence policy that directly relates to the construction and remodeling industry. We have certainly come a long way, and we continue to climb!

Wonderful Meeting at Blue Plum Design
Our sincere thanks and appreciation to Scott and Kori Martin, Sharon Mor Katz, and the entire Blue Plum Design staff for hosting a fabulous Chapter Meeting. The Blue Plum showroom provided a unique setting and the food and beverages were excellent and delicious. Scott and Kori also had champagne flutes with for members and guests to drink from that lit up and glowed with multi-colors, creating lots of smiles and laughter, adding a playful element to the evening. A great time was had by all.
Scott's presentation on "Designer Kitchens for Less Money" provided excellent and timely information on kitchen designs that was beneficial for members and guests alike, and we thank him for his interesting presentation, including the information on new LED technologies. Thanks so much Scott.

We had two companies at our February Chapter Meeting make "Marketing Moments" presentations! Early registering member companies have a opportunity to market themselves in a couple of minutes or less with this program. This is done spontaneously throughout the networking/dinner hour of the meeting by a SFBA NARI Board or Committee Member, whereby they ring a bell during different times during the hour, giving each winner their moments. Recruit New NARI Members ~ Reap Real Rewards
How to Participate
Recruit new NARI members to receive cash rewards. Previous members are considered new only if they have been inactive for over a year.
Eligibility
All active individuals from NARI member companies in good standing have an opportunity to receive cash for recruiting new members. Honorary Lifetime members are also eligible.
Program Period
Credit will be given for new member dues payments received at NARI National between October 1, 2011 and September 30, 2012, and accompanied by recruiter identifying information.
Rewards
All recruiters have a chance for rewards depending on the number of new members recruited.
To be eligible for compensation from the Member Recruitment Incentive Program, a Recruitment Verification Form must be completed by NARI members for any new members recruited. The form is available below. Please see the form for a complete list of program rules and regulations. Please return the form to NARI National via email, fax or the US postal service.

Checks will be made payable to individuals and mailed directly on a quarterly basis as award levels are reached. Chapters will be notified so they may announce at monthly meetings and provide local recognition. The individual with the most new recruits will be awarded an additional $500 and will be presented with a certificate of honor at the Fall House of Delegates meeting.In the case of a tie for the most members recruited, the additional $500 reward would be presented to the individual with the most recruits, whose new-member information and payment arrived at the national office earliest.

A Look At Recently Joined SFBA NARI Members

Nancy Madynski of W.A. Rose Construction recently joined our NARI chapter. A native San Franciscan, she is a graduate of the University of San Francisco with a degree in Environmental Sciences, and the Construction Practices Program at San Francisco State University. After a brief stint at the Environmental Protection Agency, she became the office manager for a general contractor and worked her way up to project manager. She has worked for several building contractors, including Winans Construction and Fisher Development, for whom she traveled the country managing the construction of Gap, Pottery Barn and Apple stores.
She was out of the paid workforce in the years following the birth of her son, but she could not stay away from construction; wheeling his baby carriage by local building sites so she could see what was going on. During that time, she joined the Steering Committee of the Friends of Dolores Park and was deeply involved with the recently completed $3.5M reconstruction of the playground there.
Nancy now does business development and project management for W.A. Rose Construction, which is owned by another member of our Chapter, Roberts Electric. W.A. Rose Construction has 6 employees and does commercial (primarily tenant improvement), institutional (churches) and residential work. The company recently completed a large office space in San Francisco and is nearing the end of a Greene and Greene remodeling project in the Sunset . Nancy joined SFBA NARI for the camaraderie and training opportunities. When not engaged in building, she enjoys yoga, tennis, and hiking.

Standard and Enhanced Web Subscription Programs

Members, we hope that you are pleased with the look of our new web site, and we hope that you will find the site easier to navigate and that overall it has a much cleaner and sharper look.
Your SFBA NARI membership automatically includes a Standard Directory Listing on our website. Your standard listing includes your company name, address and phone number. It also includes a link directly to your company website, the ability for website visitors to directly email you, and five category specialty listings. Consumers, looking for a remodeling professional, can find your company using one of three search engines utilized by the website on the "Find a Professional" page. There is an alpha search, a city search, and a category search. You are automatically listed in the alpha search by company name, and the city search by your company city. Your company will also be found in the category search by choosing up to 5 category specialty listings provided to you, at no charge, with your membership.
The Enhanced Web Subscription Program includes all of the choices described above, plus five additional category specialty listings, for a total of 10 listings, a 25 word description of your company, and your company logo. The cost of the Enhanced Web Subscription program is $190 per year.

How Long Should Documents and Records Be Kept?

I recently had an architect client ask me," How long do you reco mmend keeping documents, and which ones are critical?" These questions are both good ones and cans of worms. (It is also an ongoing and thorny issue with other professions, including law.)
A Need to Keep Records? Like most good questions/cans of worms, I am not sure if there is a single hard and fast answer. But the threshold question is - should you keep records at all?
While seemingly a silly query - "of course one should" - there are a number of people who don't, and at least some attorneys who agree with this. I think one should. If an issue comes up in five years and you have no records, you are at a real disadvantage.
Statutes. There also appears to be some statutory authority to do so. Business and Professions Code Section 5536.3 states plans and drawings must be made readily available to a homeowner and/or insurance company in the event of a natural disaster. However, it does not address how long one must keep these records. I think a reasonable interpretation of this law is that while it does not create an independent requirement to keep records it certainly encourages it.
One statue that does give guidance is California Civil Code Section 337.15. This states that the statute of limitations for bringing an action for latent construction defects is ten years from substantial completion. Thus, if one has legal exposure for 10 years it makes infinite sense to keep records for at least that long.
Just to be on the safe side, I advise my construction clients to retain records for 11 or 12 years. Sometimes lawsuits are filed on the very last possible day and then not actually served on the defendants until later. Further, often other construction professionals are later brought into these defects lawsuits by a cross-complaint by the original defendant. This also can take some time to play out.
Critical Documents. So what do you keep? Construction documents encompass a broad range of materials, including building plans, estimates, contracts, subcontracts, supply orders, purchase orders, change orders, photos, et seq.
However, critical documents are in the eye of the beholder. A litigation attorney would probably say keep everything. I think initially whatever you have in the file at the end of the job is what you keep. As time goes by and you need to free up the storage space, it would be reasonable to do a bit of prudent weeding.
Emails/Electronic Files. Rapidly replacing the old fashioned letter, emails can be a pain because there is often so many of them. Stored on a disk with the file might be the easiest way to handle this aspect of keeping documents.
Although I am not a litigator, I am pretty sure electronic files suffice as opposed to keeping the hard copies. Indeed, one can now do most of the litigation filing of documents with courts electronically.
When to Clean Out? I think if one decides to keep paperwork for the suggested 11 or 12 years, you could safely toss most of it at the 11 or 12 year mark. You have exercised prudent and reasonable care. But keep the client thank yous and other mash notes to remind you in your dotage of jobs well done. The older we get the better we were.
