for this year will be Membership. We have put together an outstanding Membership Committee that will be organized as follows: Adam Haedt (Caesarstone) will be responsible for prospecting, Chip Doyle (Sandler Training) will be responsible for conversion and orientation, and Dave Freer (Collier Warehouse) will be responsible for retention and will also serve as the Committee Chair. The overall goal is to increase membership by two every month. The enthusiasm and ideas surrounding how to attract new members and also how to enhance the benefits toward new and existing members is unprecedented within this Committee. We would encourage all existing members to consider themselves as advocates of NARI and to also think of ways they can contribute as informal members of the Membership Committee. NARI

National is placing the same level of commitment to this function of the organization.
Additional strategic planning was dedicated to the Programs & Locations, Marketing and Business Development Committees. For Programs & Locations, we set an overall goal of 50 attendees per meeting. We wanted to continue to build on the incredible success of last year. For Marketing, we will focus on leveraging the newly launched website as a source for developing business for our Members and to also create revenue for the Chapter. We also set the goal of launching a pilot program for job site barbecues in which the Chapter will assist in promoting NARI at the location of a Member's completed job site. For Business Development, we set the goal of raising $15,000.00 for the Chapter, leveraging the use of the recently completed Sponsorship Opportunity Package.
In the next month, most or our Members, who are on an April 1 annual renewal cycle, will be receiving their renewal notices. The Chapter's leadership is committed to understanding how we can enhance Member benefits. Please be proactive in sharing your ideas in how we can better serve you. Our hope is that your membership, from a Local and National level, has resulted in tangible improvements to your business.
NARI National recently conducted a study which was compared against the Home Improvement Research Institute's (HIRI) "Remodeling Professional Study Data for Generalists." The net results of this comparison is that NARI members are more successful in just about every significant business metric. The article can be read in the January/February 2012 issue of Remodelers Journal. We felt that this was as compelling of a justification for both becoming a Member and for maintaining your Membership.
Many thanks to our January meeting host, California Closets with Lynell Dow and her staff, and speaker David Fogt, Enforcement Chief of the Contractors State License Board. It was a great meeting.
We look forward to seeing everyone at the February 8 Chapter Meeting being held at Blue Blum Design, an SFBA NARI member, where Owner and Lead Designer Scott Martin will lead a synergy-related discussion on how to effectively offer cost effective solutions for designer kitchens for your clients.

| Great Kickoff to New Year at California Closets | | |
January 2012 Chapter Meeting Recap

A wonderful time was had by all at the January 2012 Chapter meeting. Our host was California Closets, at their new showroom on Fourth Street in Berkeley. It was a wonderful gathering at a marvelous showroom.
David Fogt, Enforcement Chief of the Contractors state License Board (CSLB), gave an insightful presentation on a variety of issues from consumer complaints to the CSLB to unlicensed contractors and partnering opportunities to combat the underground economy.
Our sincere thanks to Mr. Fogt for traveling all the way from Sacramento to speak present important and timely information and to Lynell Dow and her team from California Closets for their wonderful hospitality in hosting our Chapter meeting. |

Recruit New NARI Members ~ Reap Real Rewards
How to Participate
Recruit new NARI members to receive cash rewards. Previous members are considered new only if they have been inactive for over a year.
Eligibility
All active individuals from NARI member companies in good standing have an opportunity to receive cash for recruiting new members. Honorary Lifetime members are also eligible.
Program Period
Credit will be given for new member dues payments received at NARI National between October 1, 2011 and September 30, 2012, and accompanied by recruiter identifying information.
Rewards
All recruiters have a chance for rewards depending on the number of new members recruited.
To be eligible for compensation from the Member Recruitment Incentive Program, a Recruitment Verification Form must be completed by NARI members for any new members recruited. The form is available below. Please see the form for a complete list of program rules and regulations. Please return the form to NARI National via email, fax or the US postal service.

Checks will be made payable to individuals and mailed directly on a quarterly basis as award levels are reached. Chapters will be notified so they may announce at monthly meetings and provide local recognition. The individual with the most new recruits will be awarded an additional $500 and will be presented with a certificate of honor at the Fall House of Delegates meeting.In the case of a tie for the most members recruited, the additional $500 reward would be presented to the individual with the most recruits, whose new-member information and payment arrived at the national office earliest.

Contractors State License Board Enforcement Chief
David Fogt Speaks

On January 12, 2012, David Fogt made a presentation at the monthly NARI dinner meeting. A former contractor, he is a 22-year employee of the Contractors State License Board (CSLB). He spoke on a broad range of topics, including unlicensed contractors.
Mr. Fogt presented some basic facts. There are 302,000 licensed contractors working in an admittedly slack economy. There may be as many as an additional 60,000 unlicensed contractors also working as part of California's destructive shadow economy.
Over 20,000 complaints are received a year by the CSLB. There are 130 investigators. 70% of the complaints are against remodel contractors.
Consumer Complaints to the Board: The Process
Once received, the Board first reviews a complaint to determine if it has jurisdiction. If so, it then sends a contact letter to the contractor requesting a response. Next, mediation is attempted. If the dispute cannot be resolved in mediation and further investigation is warranted, it is passed on to an investigator. The batting average of success of closing files is seventy percent within sixty days.
CSLB Arbitration
CSLB arbitration proceedings were also discussed as a means of dispute resolution. Mr. Fogt discussed the process and stated one great advantage - it is paid for by the Board, as opposed to private arbitration where the parties must pay. (My personal experience with CSLB arbitration has been positive.)
Eternal Questions
The inevitable queries about T&M were asked - acceptable or not? The answer was that the Business and Professions Code states the contract must have a fixed price, in "dollar and cents."
In response to a follow-up question, Mr. Fogt did say that if a contractor has a "not to exceed" amount in dollars and cents - a specific sum - that would constitute compliance providing interim payments do not exceed the value of work performed.
If the bane of remodel contractors occurs - new conditions such as dry rot - what to do? Mr. Fogt said new conditions are properly subject to change orders. If a client won't agree to the change order, then termination is an option.
Unlicensed Contractors
Much of the presentation regarded unlicensed contractors - the problem and the current attempts at solutions. The Board has 30 investigators that work as the Board's SWIFT team chasing these fellows. Complaints and leads are encouraged. Upon receiving these, they attempt to go to the job site of the unlicensed contractor immediately.
The Board stings alone result in over 1,000 formal disciplinary actions a year, the majority of violators are arrested and released with a Notice to Appear in criminal court.
What is new and showing success is the Contractors State License Board's partnering with other various governmental agencies who also have an interest in shutting down the underground economy. Among the various agencies participating in joint task forces with the Board are the Department of Insurance, EDD, Division of Labor Standards Enforcement and a number of county district attorneys.
Mr. Fogt noted that some counties are more cooperative than others. He felt the relationship with some large counties could be more active and productive. (San Francisco District Attorney - are you listening?)
The Contractors State License Board is not only always receptive to tips and complaints, but also further suggestions as to how to chase the bad fellows.
