We Begin 2012

The holidays are officially over and we welcome 2012. As a Chapter, we sure did close 2011 with a bang. Our tremendous holiday gala and networking celebration was attended by over 375 people at the Sobel Building in the heart of the San Francisco Design Center. We successfully raised $2,000 for Saint Anthony Foundation. In addition to the charitable contribution, the focus of the event was networking, brand awareness and membership. A tremendous thank-you to Sally Power and the Programs and Locations Committee for their efforts in putting this event together. and Tenants of the Sobel Design Building, with an extra special thank you to Andrea Sipe from The Sliding Door Company, for their contributions in making this event a huge success.
The SFBA NARI Board and Executive Committee met on January 7 for our annual Strategic Planning meeting. The results of this meeting will be driving the direction of our Chapter for the upcoming fiscal year. More information to follow in the coming months. We will continue to look for ways to benefit our existing members and to recruit new members.

| Fabulous Holiday Networking Gala and Party | | |
Sobel Building Was Buzzing With Holiday Spirit
The Sobel Building was busy with folks networking and enjoying great food and wonderful libations for the first annual Sobel Building Holiday Networking Gala and Party, sponsored by SFBA NARI, Arcadia, Domicile, Golden State Flooring, IMD, Kreiss, PAK Oriental Rugs, Sierra Select, Studio Becker and The Sliding Door Company. Close to 400 people were in attendance. All the showrooms were decorated and guests were going to the various showrooms to have their maps stamped for the door prize drawing that was held, distributing some wonderful gifts. Our charity for the event was the St. Anthony Foundation in San Francisco, and guests brought non-perishable donations of food as well as purchased tickets for the door prizes. For all these efforts, $2,000 was raised to benefit St. Anthony Foundation.
We look forwarding to making this Holiday Networking Gala and Party an annual event. Thanks to all the industry partners for making this event a success!

Recruit New NARI Members ~ Reap Real Rewards
How to Participate
Recruit new NARI members to receive cash rewards. Previous members are considered new only if they have been inactive for over a year.
Eligibility
All active individuals from NARI member companies in good standing have an opportunity to receive cash for recruiting new members. Honorary Lifetime members are also eligible.
Program Period
Credit will be given for new member dues payments received at NARI National between October 1, 2011 and September 30, 2012, and accompanied by recruiter identifying information.
Rewards
All recruiters have a chance for rewards depending on the number of new members recruited.
To be eligible for compensation from the Member Recruitment Incentive Program, a Recruitment Verification Form must be completed by NARI members for any new members recruited. The form is available below. Please see the form for a complete list of program rules and regulations. Please return the form to NARI National via email, fax or the US postal service.

Checks will be made payable to individuals and mailed directly on a quarterly basis as award levels are reached. Chapters will be notified so they may announce at monthly meetings and provide local recognition. The individual with the most new recruits will be awarded an additional $500 and will be presented with a certificate of honor at the Fall House of Delegates meeting.In the case of a tie for the most members recruited, the additional $500 reward would be presented to the individual with the most recruits, whose new-member information and payment arrived at the national office earliest.

What To Do When A Complaint is Made Against Your Surety Bond

A complaint against your surety bond by a disgruntled client is similar to a complaint by a client to the Contractors State License Board. Unhappy, but it happens. One should be informed on how the process works in the case you are on the receiving end of such a complaint. Please note that, as with all of my articles, my discussion is a summary in nature - a heads up. Always be protective and proactive about your legal rights, including contacting your attorney - especially if this happens to you.
What is a Surety Bond? The Contractors State License Board requires a surety bond in the amount of $12,500 for the issuance of an active contractor's license, reactivation of a license, and for the maintenance of an actively renewed license. The bond is for the benefit of consumers who may be damaged as a result of defective construction or other license law violations.
A surety bond is really a contract among at least three parties: the principal (the contractor), the obligee (the homeowner client), and the surety (who ensures that the principal's obligations will be performed). In this agreement, the surety agrees to uphold - for the benefit of the homeowner client - the contractual promises made by the contractor if the contractor fails to uphold its promises.
A claim/complaint against you surety bond is often made in conjunction with a complaint made to the Contractors State License Board. Some homeowners see this claim as a free shot against the contractor; unlike a legal complaint for which they must pay their attorney, it is a way to sock it to the contractor at no real cost to themselves.
Please Note. Surety bonds are not insurance. The surety does not have a high fiduciary obligation to its principal that an insurance carrier has to its insured. They are liable to the claimant if the claimant can establish a breach of duty resulting in damages, and/or the matter is uncontested. As the principal, the contractor is then obligated to reimburse the surety company for any losses, costs, and attorney fees incurred.
The Complaint Process. Once a complaint is made by the homeowner, usually within two weeks of receiving it the surety sends a letter notifying the contractor. (Complaints are handled based on the order they are received.) The letter informs you of the homeowner's allegations. If in responding the contractor can establish that this is a contested matter, then the surety will usually stay its action on the claim until there is a definite resolution of factual issues. These include a court verdict or arbitration award.
To dispute the claim, one must respond back in writing to the surety company - usually within 15 days - stating your side of the story and provide supporting documentation.
The Moral. These surety fellows are not your pals, believe me. These matters are much easier to resolve early in the process, so it is in the contractor's best interest to cooperate and provide the information requested. It is imperative that you get back to them promptly and give a thorough response. If you do not, you run the risk of being presented with a hefty bill from your surety bond company.
