Richmond Bar Association Awards Pro Bono Attorney Award for the 2011-2012 Year to Lakshmi Challa

Challa Law Offices team is proud of their Managing Partner Lakshmi Challa who was awarded the 2011-2012 recipient of the John C. Kenny Pro Bono Award. The award is presented annually to an individual or law firm that demonstrates a dedication to furthering the delivery of pro bono legal services to the poor and underserved in the Richmond Metro area. The Association conveyed the award to Ms. Challa on Thursday, January 19, 2012 at the RBA's monthly luncheon meeting at the Omni Hotel in Richmond Virginia.

 

In 2009, working with the Virginia Poverty Law Center, Ms. Challa established the immigrant Victims of Domestic Violence Project. This project provides pro bono legal assistance to undocumented immigrants who are victims of domestic or sexual violence in obtaining legal status in the U.S. without reliance on their abusers.

Since the clinic's inception two years ago, Ms. Challa and those attorneys she has recruited and trained to assist her in the clinic have helped over fifty women remain in the United States, work legally, and provide for their families and their children. Since 2009, Ms. Challa and the Challa Law Offices have dedicated over 1,000 hours to the success of this program. Ms. Challa has changed the lives of victims of domestic violence, giving them an opportunity to lead a life free from fears of domestic violence and deportation.

Ms. Challa has also been of great assistance to Commonwealth Catholic Charities, an organization offering numerous support services to individuals and families throughout Virginia. Ms. Challa offers her support specifically with respect to unaccompanied minors who are brought into the United States. In addition, she is a member of the Board of Directors for the Virginia Poverty Law Center and has done pro bono work for the Red Cross.

Consulate in Chennai, India No Longer Processes Immigrant Visa Applications Effective 01/01/2012

 

The U.S. Consulate General in Chennai will no longer process Immigrant Visa petitions as of January 1, 2012. The U.S. Embassy in New Delhi and U.S. Consulate in Mumbai will become the only acceptance centers in India for Immigrant Visas. The Immigrant Visa allows an individual to live and work in the United States on a permanent basis, as well as provides the immigrant the opportunity to work towards U.S.citizenship. Examples of Immigrant Visa based petitions are those that work toward family reunification of parents, children and siblings. These petitions also include Fiancée and the unique employer category, where one's employer can petition for the individual and their dependents to immigrate to the United States.

This change affects only the locations for processing of Immigrant Visas; it does not change the law or policy for visa processing. Applicants currently in the process of petitioning for an Immigrant Visa may contact ChennaiIVU@state.gov for clarification on their status

We Can't Wait: President Obama Takes Actions to Increase Travel and Tourism in the United States

President Obama will sign an Executive Order and announce new initiatives to significantly increase travel and tourism in the United States. The U.S. tourism and travel industry is a substantial component of U.S. GDP and employment, representing 2.7% of GDP and 7.5 million jobs in 2010 - with international travel to the United States supporting 1.2 million jobs alone. The travel and tourism industry projects that more than 1 million American jobs could be created over the next decade if the U.S. increased its share of the international travel market. Today's announcement offers important steps to bolster job creation through a range of steps to better promote the United States as a tourism destination and improve secure visa processing. This is the most recent of a series of executive actions the President has announced to put Americans back to work and strengthen the U.S. economy.

 

Today's announcement calls for a national strategy to make the United States the world's top travel and tourism destination, as part of a comprehensive effort to spur job creation. The number of travelers from emerging economies with growing middle classes - such as China, Brazil, and India - is projected to grow by 135%, 274%, and 50% respectively by 2016 when compared to 2010.  Nationals from these three countries contributed approximately $15 billion dollars and thousands of jobs to the U.S. economy in 2010. 

 

The Department of State has made tremendous progress in processing non-immigrant visas from these key markets, allowing them to issue more than 7.5 million visas in the last fiscal year, a 17% increase from the previous fiscal year.

 

Identification of Foreign Countries Whose Nationals Are Eligible to Participate in the H-2A and H-2B Nonimmigrant Worker Programs        

 

Under Department of Homeland Security (DHS) regulations, U.S. Citizenship and Immigration Services (USCIS) may approve petitions for H-2A and H-2B nonimmigrant status only for nationals of countries that the Secretary of Homeland Security, with the concurrence of the Secretary of State, has designated by notice published in the Federal Register. That notice must be renewed each year. This notice announces that the Secretary of Homeland Security, in consultation with the Secretary of State, is identifying 58 countries whose nationals are eligible to participate in the H-2A and H-2B programs for the coming year. New countries on this year's list include Haiti, Iceland, Montenegro, Spain, and Switzerland.

 

DATES: Effective Date: This notice is effective January 18, 2012, and shall be without effect at the end of one year after January 18, 2012.

 

This notice does not affect the status of aliens who currently hold valid H-2A or H-2B nonimmigrant status. Persons currently holding such status, however, will be affected by this notice at the time they seek an extension of stay in H-2 classification, or a change of status from another non-immigrant status to H-2 status, or a change of status from H-2A to H-2B (and vice versa).

 

An H-2A visa allows a foreign national entry into the U.S. for temporary or seasonal agricultural work  and The H-2B nonimmigrant program permits employers to hire foreign workers to come temporarily to the U.S. and perform temporary nonagricultural services or labor on a one-time, seasonal, peak load or intermittent basis.

Government Allows Intra Company Changes of Employment; Bangalore and Chennai Unveil Online Registration Pilot - India

 
Foreign workers can change employers within the same corporate family, the Indian government has announced. Bangalore and Chennai are piloting an online foreign registration system, and Bangalore will now accept visa extension applications up to 60 days in advance - four weeks earlier than under prior procedures.

Changes of Employer within the Same Corporate Family: Foreign nationals working in India with an employment visa may change employers without having to leave the country and reenter with a new visa, as long as the new employer is within the same corporate family.

To qualify for visa portability, the foreign national must be moving between a holding company and one of its subsidiaries or between two subsidiaries of the same registered holding company. The holding company must control the membership of the subsidiary's board of directors or more than half of its equity shares in capital, or the subsidiary and the holding company must both be subsidiaries of the same parent entity.

India/China EB-2 Priority Dates Advance While EB-3 Shows Continued Modest Advancement

 

EB-2 priority dates for India and China will make a significant advancement, a twelve month difference from January, according to the Department of State's December Visa Bulletin.

EB-3 priority dates for professionals and skilled workers shows little improvement.

The February 2012 EB immigrant priority date cut-offs will be:
