H-1B Cap Latest Count As Of 11/2/2011:
Regular cap count: 50,800 (out of 65,000 cap)
Master degree cap count: 20,000 (out of 20,000 cap)
Attention H-1B employers:
As of USCIS's most recently issued count (11/2/2011), there are approximately 15,000 slots left. Our attorneys estimate that USCIS will only be accepting H1-B cap-subject petitions for ten more days, and as such, if you are planning to file any H-1B petitions in this year's cap, please contact our office to initiate as soon as possible.
Once this year's cap has closed, USCIS will stop accepting new, subject to the cap petitions until April 1, 2012, and the earliest start date for employees filed in next year's cap will be October 1, 2012.
If you're considering filing additional cap-subject cases but are unsure of the details, we can file LCAs for $75 each, and if you choose to proceed with the petition, the $75 fee will be counted towards the H-1B legal fee.
To increase your chances that the LCA is certified in time to file the petition with USCIS before the cap is filled, we request that you initiate any LCAs no later than Tuesday, 11/8/2011.
To file the LCA, we only need the worksite address, the job title, salary, and start date. Please note that LCAs can cover multiple worksites, and multiple employees using the same worksite, title, and salary.
