Proposed State Constitutional Amendments

Mark Tuesday, November 2, as Election Day on your calendar.  Polls will be open from 6:00 a.m. to 7:00 p.m.  Vote at your usual polling place; if you do not know the location, go to www.fairfaxcounty.gov/ebIn addition to the Congressional election there will be three amendments proposed for the Constitution of Virginia. 

 

The process of amending the Constitution of Virginia requires that a proposed amendment be introduced and passed in the General Assembly twice with an intervening election for members of the Assembly, and then be passed by the people in a general election.  Many voters are surprised when they see constitutional amendments on the ballot, but they actually have been under consideration for several years.  I voted for the three amendments twice in the General Assembly and recommend that they be approved in the general election.

 

The first question asks:  "Shall Section 6 of Article X of the Constitution of Virginia be amended to authorize legislation that will permit localities to establish their own income or financial worth limitations for purposes of granting property tax relief for homeowners not less than 65 years of age or permanently and totally disabled?"  The proposed amendment gives the General Assembly authority to permit localities to determine their own income or financial worth limitations for tax exemptions for persons 65 years of age or older or for persons permanently and totally disabled.

 

Another question asks:  "Shall the Constitution be amended to require the General Assembly to provide a real property tax exemption for the principal residence of a veteran, or his or her surviving spouse, if the veteran has a 100 percent service-connected, permanent, and total disability?"  The proposed amendment would require the General Assembly to pass a law exempting from local taxation the principal residence owned and occupied by any veteran with a one hundred percent service-connected, permanent, and total disability.  The veteran's surviving spouse could continue to claim the exemption so long as he or she does not remarry and continues to occupy the home as his or her principal residence.

 

The final question asks:  "Shall Section 8 of Article X of the Constitution of Virginia be amended to increase the permissible size of the Revenue Stabilization Fund (also known as the "rainy day fund") from 10 percent to 15 percent of the Commonwealth's average annual tax revenues derived from income and retail sales taxes for the preceding three fiscal years?"  The proposed constitutional amendment increases the maximum size of the Fund from 10 percent to 15 percent of the Commonwealth's average annual tax revenues from income and sales taxes for the preceding three fiscal years.  This amendment was proposed after the rainy day fund that had reached two billion dollars before the current recession had helped soften the effects of the recession, but the need for a greater cushion became obvious.

Tower Award
Delegate Plum to Receive Prestigious "Tower Award" from The Committee for Dulles 
 
The  Committee for Dulles announced that Delegate Kenneth R. "Ken" Plum will be honored with the "Tower of Dulles" award at the Committee's 44th Anniversary Gala on Friday, November 12.  The Tower of Dulles is awarded for meritorious service providing for the betterment of Washington Dulles International Airport and the Dulles Economic Corridor.  The award, presented at its Annual Gala, is the highest recognition offered by the Committee for Dulles. 

"We are honored to have Delegate Plum as this year's recipient of the Tower of Dulles," announced Committee for Dulles President, Tanya Matthews of TMG Construction Corporation.  "Del. Plum has represented the 36th District in the General Assembly for more than three decades and currently serves as House Democratic Caucus Chair.  He is Founder and Chair of the Dulles Corridor Rail Association (DCRA), a nonprofit advocacy group that since 1998 has been invaluable in garnering support for the construction of Metrorail to Washington Dulles International Airport and beyond into Loudoun County.  Today, we are witness to the success of Delegate Plum and DCRA's effors as we watch in awe this vital project march toward completion."

Previous Tower of Dulles recipients include Senator John Warner, Governor Tim Kaine, Congressman Frank Wolf, and Glenn Tilton of United Airlines.

November 2 General Election  


Registered voters who will be away from Fairfax County on Election Day, or who are unable to go to the polls because of illness or disability, may vote by absentee ballot.  If you will be commuting and working for 11 or more hours on Election Day, between 6:00 a.m. and 7:00 p.m., you may qualify to vote by absentee ballot.  Eligible voters may vote in person prior to Election Day.  Time is running out!

Climate Change Citizen Action  


The Environmental Protection Agency plans to finalize the Chesapeake Bay Total Maximum Daily Loads (TMDL) or "pollution diet" by December, 2010.  The EPA mandated TMDLs will cap the amount of nitrogen, phosphorus, and sediment loads allowed into the area waters by assigning reduction allocations to each source sector.  For Virginia TMDL information and Watershed Implementation Plan, visit www.deq.state.va.us/tmdl/chesapeakebay.html.  To submit written comments, go to www.regulations.gov and enter TMDL into the search box.  The appropriate docket will be listed as first item.  To submit written comments by mail, write to Water Docket, Environmental Protection Agency, Mailcode 28221T, 1200 Pennsylvania Avenue, Washington, DC  20460.

The Virginia Senate's Privileges and Elections Committee will hold a hearing on legislative redistricting on Thursday, November 4, 7:00 p.m. at the Herndon Town Council Chambers, 765 Lynn Street, Herndon.  Attend and share your thoughts on the process.

The Fairfax County Department of Transportation will hold a public meeting on Thursday, November 4, at the North County Government Center, 12000 Bowman Towne Drive, Reston, to discuss changes to Fairfax Connector routes 585, 595, and 597.  Schedule and route changes are proposed for all three routes due to the upcoming phased closure of Reston East Park and Ride.  Proposed changes include relocating routes 595 and 597 to Reston North Park and Ride and adding trips to Route 585 from Reston South Park and Ride to account for an expected increase in passengers using Reston South.  Members of the public are encouraged to attend this meeting.
