                                 Capital Costs

       A federal court recently granted a stay of execution for a Texas man who was outside a convenience store when his partner killed a clerk inside the store.  The stay was based on the man's mental competence, but the court needs to consider the broader issue of whether a person who is not the "triggerman" can be executed for a crime.  Previous court decisions have left the issue unclear.  The Virginia House of Delegates has passed bills that I have opposed that would have expanded the death penalty to include persons who were accomplices to crimes to which the death penalty currently applies.  These bills failed in the Senate or were vetoed by the Governor.
 
       Recently a report from the Urban Institute found that a capital case in Maryland costs the taxpayers approximately $3 million, on average $1.9 million more than the cost of a similar case in which capital punishment is not sought.  Maryland currently has a moratorium on executions, and the state has executed only five persons since the death penalty was allowed by the Supreme Court in 1976.  In contrast, Virginia has executed 100 persons since that time, second only to Texas with 406 executions.  No one has been able to establish a linkage between crime rates in states and their capital punishment laws.
 
       In 2000 Earl Washington, Jr. was cleared of a 1982 rape and murder to which he had confessed and was sent to death row in Virginia after DNA proved someone else had committed the crime.  Washington was mildly retarded.  Virginia is continuing its review of past cases in which DNA evidence is available for testing using the latest techniques.  Just last month the state crime lab announced that it found through DNA testing that Curtis Moore had not committed the 1975 murder for which he was convicted.  Moore was mentally ill and had been freed from prison in 1983 by a federal appeals court because his Miranda rights had been violated.  Unfortunately he died four years ago.  Only his family will have the satisfaction of knowing that he has been exonerated.
 
       Justice must be delivered, and society must be protected.  Serious questions remain about the administration of the death penalty.
 
       An alternative to the high cost of capital cases in monies expended in their being tried and in human costs to those wrongly convicted is life in prison without parole.  Current laws are not evenly applied; all the cases mentioned included someone who was mentally ill or challenged.  Our system of justice sometimes makes mistakes.  Society is protected when a life sentence without parole is administered, and the high human and dollar costs are eliminated.

Climate Change Citizen Action
 
According to the U.S. Green Building Council, recycling programs that directly involve students teach responsible environmental habits they can apply at home.  Find out what your child's school is doing to encourage recycling during the school day.

Voting Information for November 4 General Election
 
Check Your Voter Registration Status:
 
Take advantage of a new web tool to confirm your registration status, polling location, and other vital information.  Visit www.sbe.virginia.gov,  click on "Online Services" at left, and then select "Verify Your Voter Registration Status."  Don't forget that the deadline to register to vote is October 6.
 
Absentee Voting:
 
The Fairfax County Office of Elections initiative, "Voters on the Move," will inform registered voters about the options for absentee voting in this fall's November 4 General Election.  Fairfax County voters who will be commuting and working for 11 or more hours on Election Day, between 6:00 a.m. and 7:00 p.m., may qualify to vote by absentee ballot.  Information on who is eligible to vote absentee is available at www.fairfaxcounty.gov/eb/absentee.htm.
 
To make absentee voting accessible, the Office of Elections offers in-person absentee voting at the Fairfax County Government Center, 12000 Government Center Parkway, Suite 323, Fairfax, through Saturday, November 1 from 8:00 a.m. to 6:00 p.m.   Absentee Voting will also be available at seven satellite locations throughout the county on Wednesday, October 15 through Saturday, November 1.  Satellite times and locations are available at www.fairfaxcounty.gov/eb.
 
To facilitate the absentee voting process, the Office of Elections Web page, www.fairfaxcounty.gov/eb, has an interactive online absentee ballot application form.  The link allows eligible voters to complete their application directly online.  The form may then be printed, signed, and either faxed or mailed to the Office of Elections.  The Web page also includes information about absentee voting deadlines, eligibility guidelines, and voting absentee in-person.

Important Dates and Information:
 
Monday, October 6, 2008, is the final day to register to vote in the General Election on Tuesday, November 4.  If you are already registered at your current address, you do not need to register again.  Citizens needing to verify their registration status should call 703.222.0776 or go to www.sbe.virginia.gov, click on "Online Services" at left, and then select "Verify Your Voter Registration Status." 
 
Applications for mailed absentee ballots must be received by Tuesday, October 28, 2008, at 5:00 p.m.
Final day to vote absentee in person is Saturday, November 1, 2008.

Congratulations to South Lakes High School students A. J. Price (track) and Erica Shockley (volleyball), and to coach Mike Cheselka (Vienna Youth Inc. Basketball) and parent Jasmine Faubert (Herndon Optimist Youth Football) who were recently selected by the Fairfax County Athletic Council and the Department of Community and Recreation Services to win this year's Champions of Character Awards.  Winners are selected based on their contributions to youth sports in Fairfax County and their service in pursuing victory with honor.  A coach, parent, and two athletes are chosen from each magisterial district.
 
Virginia has received top honors in the nation for information security and technology management from the National Association of State Chief Information Officers (NASCIO).  Both programs received first place honors from NASCIO at its 20th annual Recognition Awards program last month in Milwaukee.  According to NASCIO, the group "honors outstanding information technology achievements in the public sector through its Recognition Awards for Outstanding Achievement in the Field of Information Technology.  Emphasis is placed on recognizing information technology initiatives which exemplify best practices, support public policy goals of state leaders, assist government officials to innovatively execute their duties, and provide cost-effective service to citizens."  For more information on NASCIO, as well as details on the awards program and recipients, visit www.nascio.org/awards/.

Join the Brain Aneurysm Race for Awareness 8k on Saturday, October 4, 8:30 a.m., starting and ending at South Lakes High School.  There will also be a 2k Fun Run.  Olympian and U.S. record-holder for the one mile run, Alan Webb, will be at the race.  This race has been organized by the family of Tim Susco, who grew up in our community and graduated from South Lakes High School.
