reorganization plan to be presented by him to the Board of Trustees. Comments

The Grievance reads as follows:
Description of Grievance:
On Tuesday, September 28, 2010, at the
Faculty Senate Meeting UT President, Dr. Lloyd Jacobs, admitted that he did not
consult the Faculty Senate on the matter of restructuring the university. This is in direct violation of the UT-AAUP Collective Bargaining Agreements
(Tenured/Tenure Track and Lecturers'), which state in part,
"The Employer will
effectively consult with and seek the advice of the Faculty Senate on matters
of institutional planning.",
"Decisions made by
the administration, under this article, shall be fully reported and explained
to the Faculty Senate in written detail in order to allow the Faculty Senate to
understand the rationale of a given decision."

Article 7 of the Tenured / Tenure Track Contract
And Article 7 of the Lecturers' Contract
Remedy Sought:
That the president consult with and seek
advice of the Faculty Senate on the matter related to restructuring the
University of Toledo and that President Jacobs fully report and explain the
restructuring to the Faculty Senate in written detail.
Furthermore, there is to be a stay in the
implementation, approval and final reporting of any reorganization plan pending
consultation with the Faculty Senate and a full written report including
financial implications to the Senate.
The above is to happen before the
reorganization plan is submitted to the UT BOT.
