ILA Executive Board Determines Positions on Key Bills
| On
Friday, 12 February, the ILA Executive Board reviewed more than twenty key
library bills and determined the association's position on these
bills. ILA is monitoring and tracking more than sixty different legislative
proposals in the 2010 Spring Session. Please click to see the complete list.
ILA Supports House Bill (HB) 6196 amends the Illinois Local Library Act by requiring
the corporate authorities of an incorporated town, village, or township to levy
taxes sufficient to pay the costs incurred by the library for payments under
the Illinois Pension Code and providing that the moneys collected for those
purposes shall be transferred to the library within 30 days after receipt by
the corporate authorities. House sponsor: Rep. Bob Biggins, R-41, Elmhurst.

Bill (HB) 5345 and Senate Bill (SB) 3195 both amends the Property Tax Extension
Limitation Law in the Property Tax Code by providing that the extension
limitation may not be less than 1 percent. House sponsor:
Linda Chapa LaVia, D-83, Aurora, and Senate sponsor: William Delgado, D-2, Chicago.

Bill (HB) 5779 amends the Property Tax Extension Limitation Law in the
Property Tax Code by providing that the extension limitation may not be less
than 2 percent. House

Bill (SB) 2575
amends the Property Tax Extension Limitation Law in the Property Tax Code. It exempts, from the definition of "aggregate
extension," all contributions to a pension fund created under Article 3,
Article 4, or Article 7 of the Illinois Pension Code. Senate Sponsor:
Sen. James F. Clayborne, Jr., D-57, East St. Louis.
Senate
Joint Resolution Constitutional Amendment 94 and House Joint Resolution Constitutional
Amendment 52 both
resolutions propose to amend the Local Government Article of the Illinois Constitution
by requiring the state to reimburse units of local government for increased
expenses resulting from activities mandated by the General Assembly or State
executive action. It exempts
mandates requested by a local government or predating the effective date and
makes unfunded mandates unenforceable unless passed by three-fifths of the
members elected to each house of the Illinois General Assembly and specifically
characterized as non-reimbursable.

Bill (HB) 4852 creates
the Local Government Consolidation Commission Act of 2010. It establishes a commission of
legislative members and local government representatives appointed by the
governor to report to the governor and Illinois General Assembly on
consolidating local governments.
It provides for support of the commission by the Illinois Department of
Commerce and Economic Opportunity.
The proposed legislation repeals the Local Government Consolidation
Commission Act. House

(D-63, Woodstock). The board voted to support a library representative be
appointed to the Commission.

Bill (HB) 4961 amends
the Illinois Historic Preservation Act and the State Finance Act by providing
that the Illinois Historic Sites Fund and the Presidential Library and Museum
Operating Fund are not subject to sweeps, administrative charges, or
charge-backs or any other fiscal or budgetary maneuver that would in any way
transfer any amounts from those Funds into any other fund of the State. House sponsor: Raymond Poe, R-99, Springfield.
House Bill (HB) 5467 amends the Illinois Local
Library Act and the Public Library District Act by providing that, if a
nonresident fee is calculated based on the assessed valuation of the
nonresident's principal residence, then that calculation must take into
account any exemptions that apply to the residence under Article 15 of the
Property Tax Code. House
sponsor: Rep. Elizabeth Coulson,
R-17, Glenview. The board was
supportive of this bill, but does not think it is necessary, further
research is required.
Finally, the IL Executive Board supports the exploration of a two-tier pension system for the state.
ILA Is Opposing
House
Bill (HB) 5116
amends the Property Tax Code by providing that, if in any taxable year, the
county assessor of any county determines that housing values in that county
have declined by 10 percent or more in any 12-month period ending during that
taxable year, the county assessor may declare a housing assessment emergency in
that county for that taxable year.
It further provides that the housing assessment emergency shall be
lifted whenever the county assessor determines that housing values have
returned to the level established in the 12-month period prior to the
declaration of the housing assessment emergency. Finally, it provides that, if a housing assessment emergency
is in place, the county assessor may use changes in the fair cash value of any
parcel of residential property located within the jurisdiction of the assessor
when determining the fair cash value of any other parcel of residential
property located within the jurisdiction of the assessor, regardless of size,
value, or geographic location of the property. House Sponsor: Rep. Sandra M. Pihos, R-42, Glen
Ellyn.

Bill (HB) 6242 creates
the Social Networking Website Access Restriction Act by providing that an owner
of a social networking Web site must obtain and maintain in a database the
written permission of the parent or guardian of each minor who is allowed
access to the social networking Web site.
It provides that an owner of a social networking Web site must give each
parent or guardian unlimited access to the Webpage profile of the minor under
his or her supervision. The bill
provides that an owner of a social networking Web site must implement
procedures for verification of the age and information of anyone having a
webpage on the social networking Web site; provides that an owner of a social
networking Web site must also verify the status of the parents or guardians who
have granted permission to a minor to host a social networking Web site;
prohibits registered sex offenders from hosting or accessing a social
networking Web site; and provides that operators of a social networking Web
site must allow the parent or guardian of the minor unrestricted access to the
profile webpage of the minor at all times. It amends the Consumer Fraud and Deceptive Business
Practices Act by providing that a knowing violation by an owner or operator of
the Social Networking Web site Access Restriction Act is an unlawful practice
within the meaning of the Consumer Fraud and Deceptive Business Practices Act. House sponsor: Rep. Tom Cross, R-84, Plainfield.

Bill (HB) 6104 amends
the Criminal Code of 1961 by providing that it is a petty offense with a $500
fine for a sex offender to knowingly be present in any public library unless
the offender has permission to be present from the head librarian on duty the
day the offender plans to attend or the offender is a parent or guardian of a
person under 18 years of age present in the library. The bill provides that notification includes the nature of
the sex offender's visit and the hours in which the sex
offender will be present in the library.
And, it provides that the sex offender must notify the head librarian at
least two hours prior to entering the library and again when he or she departs
from the library property. House

Bill (HB) 5320
amends the Harassing and Obscene Communications Act. Includes additional
factors that constitute violations of the Act by harassment through electronic
communications. It establishes
penalties for these additional offenses.

Illinois, in the amount of $13,350,000 be issued for the purpose of (i)
erecting a building in the Village of Manhattan, Illinois, to be used as a
library, furnishing necessary equipment therefor and acquiring library
materials (such as books, periodicals, films and recordings) and electronic
data storage and retrieval facilities in connection therewith and (ii)
remodeling and improving a building in the Village of Elwood, Illinois, to be
used as a library and furnishing necessary equipment therefor?"
Mercer Carnegie Public
Library District Mercer Bond Library Failed "Shall
the bonds of the Mercer Carnegie Public Library District, Mercer County,
Illinois, in the amount of $2,800,000 be issued for the purpose of repairing,
remodeling, improving and building an addition to the existing library
building, constructing site improvements, furnishing necessary equipment and

Sheldon Public Library
District Iroquois Tax Library Passed "Shall
the annual public library tax rate for the Sheldon Public Library District,
Sheldon, Illinois, be established at 0.25% of full, fair cash value instead of
at 0.15%, the maximum rate otherwise applicable to the next taxes to be
extended?"
Sugar Grove Public
Library District Kane Tax Library Failed "Shall
the limiting rate under the Property Tax Extension Limitation Law for the Sugar
Grove Public Library District, Kane County, Illinois, be increased by an
additional amount equal to 0.10702% above the limiting rate for library
