2011 Amended Budget
At the end of each year, the BMSA's Board of Directors usually passes an amendment to balance the budgeted vs. actual operating and reserve expenditures. At their January 2012 board meeting, the BMSA Board of Directors amended the final 2011 budget. The 2011 assessment of $296.00 was separated into 18% in the operating and 82% in reserves. The vacant lot and sub-association assessment of $148.00 was also separated into 18% operating and 82% reserves. For information on the 2012 budget, Click Here. |

New Monument Creek Delegate
Monument Creek Village has elected Ms. Bernita Grove as their new Delegate and Battlement Mesa Service Association Board Member. She replaces Dora Rayne who resigned from the Delegate position in September 2011. Bernita has been a Battlement Mesa resident since June 2004 and is a 2nd generation resident of Colorado. Prior to her retirement she was a school administrator, middle and high school principal and taught English and Speech. She spent the majority of her career on Colorado's Front Range in Westminster and Boulder but also worked for a few years at Bend Senior High School in Bend, Oregon. Bernita earned her BA and Administration degrees from Colorado State University and her MA from the University of Denver. She is an avid gardener and loves to read. When she was asked why she was interested in serving on the BMSA board, she replied, "because I love my neighborhood" and that "it is a good way to give back to the community." For information about Monument Creek Village, go to www.BattlementMesaColorado.com then click on "Government Services" then on "HOA Information and Services" then on "Monument Creek" or just Click HERE. Clark's Market News
Clark's Market is delighted to announce a brand new concept for its Battlement Mesa store: "The Drop Zone." The back half of the store will now be devoted to unprecedented bargains, straight from our warehouse, and passed on directly to its customers. Tom Clark stated that, "It is our objective to be responsive to the feedback of the Battlement Mesa Commuity. We will maintain all of our top selling items in our regular grocery section, but our new "Drop Zone" will be full of deeply discounted pallet items. We are pleased and excited to have this new format debut on February 20th." For more information on Clark's Market CLICK HERE,

Covenant Corner
In the spirit of educating more and enforcing less, Covenant Corner is a regular feature in the Battlement Mesa Newsletter. Experience has taught us that most people will comply with the covenants if they know what the covenant says.
In this issue, we'll explore the rule regarding trash carts. Restrictions on garbage and trash are covered in Article VIII, paragraph 8.7. "No refuse, garbage, trash, lumber, grass, shrub or tree clippings, plant waste, compost, metal, bulk materials, scrap, refuse or debris of any kind shall be kept, stored or allowed to accumulate on any part of the Service Association Area, except within an enclosed structure or appropriately screened from view, except that any container containing such materials may be placed outside at proper times for garbage or trash pickup."
First, it is important to understand what "the Service Association Area" means. Although the term is defined in Article I, paragraph 1.37 of the covenants, the definition isn't especially helpful since the area has been expanded over the years. In general, any area that is within the Battlement Mesa Planned Unit Development (PUD) is regulated by the covenants.
Secondly, since Article VIII, paragraph 8.7 doesn't define "placed outside at proper times," on December 20, 2005 the BMSA Board of Directors adopted a Resolution of Rules and Regulations which explains this term. This section of the Resolution says,
"a. The proper time to place the container outside for pickup is no sooner than twelve (12) hours prior to trash pickup and;
b. The proper time to return the container to its storage area is no later than twelve (12) hours after trash pickup."
Lastly, although the regulations don't require it, since it reduces the likelihood that bears will be attracted to the smell of trash, we prefer for trash carts to be stored in the garage rather than behind a fence. Help save the bears: Store your trash cart in your garage.
