| MSDC News for Members: Fighting a 20% DC Medicaid Physician Payment Clawback; Pushing for Medicare Patient Empowerment Act |

MSD Continues to fight the "Clawback" of 20% of Medicaid Payments Made to Physicians in 2011
In a transmittal dated February 2, 2012, the Department of Health Care Finance announced its intent to implement a 20% rate reduction effective March 1, 2012. All Medicaid claims submitted on or after that date are being processed with a Medicaid fee schedule paying 80% of the Medicare rate. This is consistent with the FY 2011 Budget Act passed by the Council in spring of 2010. The Medicaid payment reduction contained in that budget was strongly opposed by the Medical Society at the time, citing its effect of placing our City's most vulnerable citizens at greater risk of losing access to much-needed medical care.
However, the DC Department of Health Care Finance also plans to implement a physician payment recovery program affecting all physicians who have accepted Medicaid payments from January 1, 2011 through February 29, 2012. This "Medicaid Clawback" program requires physicians to refund the DC Medicaid program 20% of all payments received during that time frame, and represents a terrible threat to Medicaid's relationship with District physicians that puts DC patients' access to health care in jeopardy.
While the DC Council approved the Medicaid rate change, it did not approve this Medicaid Clawback program. If a private health insurance plan attempted such a recoupment program, they would be in violation of current District law addressing health insurance plans. Currently, MSDC is exploring legal options to prevent the implementation of the Medicaid Clawback program, but continues to work with the Department of Health Care Finance and CMS to address the issue. Additionally, we have been in constant communication with several coalition partners, including the AMA, DCHA, GW MFA and MedStar Health, to engage the proper regulatory and legislative authorities in an effort to stop the clawback effort and avoid the negative consequences that would occur for the District's Medicaid patients.

Continuing to push for the Medicare Patient Empowerment Act
The AMA and MSDC continue to educate members of Congress about HR 1700, "The Medicare Patient Empowerment Act." This bill is based largely on policy supported by MSDC at the AMA House of Delegates meeting in 2010, and allows Medicare patients and their physicians to enter into private contracts without penalty to either party.
The AMA is launching a grassroots initiative to generate public support for Congressional passage of H.R. 1700 and S. 1042, the Medicare Patient Empowerment Act, introduced by Rep. Tom Price (R-GA) and Sen. Lisa Murkowski (R-AK), respectively.
The AMA has developed a range of resource material to support this work, including:
- An educational slide deck, with script, for physician audiences that can be personalized by the presenter.
- A physician-focused Frequently Asked Questions document.
- An educational slide deck, with script, for patient audiences that can be personalized by the presenter.
- A patient-focused Frequently Asked Questions document.
- A short educational video for patients.
- A downloadable patient flyer for physician offices.
- A web-based petition for patients and physicians, which provides access to educational material and enables patients to send email directly to their legislators. This can be accessed through a dedicated micro site at www.MyMedicare-MyChoice.org.

| From CMS: Upgrade to HIPAA v. 5010 Deadline Extended to June 30 |

ICD-10: It's Closer Than It Seems - Steps to Take to Refine your Version 5010 Upgrade
The V. 5010 upgrade deadline has been extended through Saturday, June 30. You should begin finalizing your upgrade to V. 5010 if you have not yet done so. Once you have finished your upgrade to Version 5010, you'll need to ensure your system continues to run properly. Providers should look for the following indicators to make sure there are no problems with their system upgrade:
- An Increase in Rejections or Denials of Claims - An increase in rejections or denials of claims may be an indication that there is not sufficient or correct data provided to meet Version 5010 standards. Partners, such as payers, also have a part in correcting this issue, since forwarding, converting, or formatting data can result in rejections or denials. Monitor your claims closely to determine the reasons for rejection or denial of claims and coordinate with payers to ensure that data is properly processed to avoid claim delays.
- Issues with Non-Electronic Funds Transfer (non-EFT) Payments - Version 5010 includes changes to claims formatting, including a full nine-digit zipcode and inclusion of provider billing address. Submitting claims with only a five-digit zipcode will result in rejection. If your practice has not submitted the correct billing or mailing address as part of your Version 5010 claim, your non-EFT payments or Explanation of Benefits (EOBs) information may be mailed to the wrong physical location. Make sure to coordinate with your payers to verify how they use enrollment information and process claims data, as this will also be affected by the mailing address on file. Being diligent in tracking your claims and remittances (EOBs) will help identify and address any issues that may arise.
- Formatting Discrepancies with Partners - Your trading partners should also have upgraded to Version 5010; however, your organization may interpret the new standards differently than your external partners, which can result in rejected claims. You should coordinate with your payers and/or clearinghouse to determine any gaps or discrepancies in claims submissions. You and your partners should monitor claims that are automatically transferred between payers and address new response formats or data as claims are processed.

| AMA Updates: IPAB Repeal; Electronic Funds Transfers |

IPAB repeal bill passes U.S. House, moves on to the Senate
Early this afternoon, the U.S. House of Representatives passed H.R. 5, the "Preserving Access to Healthcare Act" by a vote of to 223 to 181. This legislation combines two AMA-supported bills: the "Medicare Decisions Accountability Act" (H.R. 452), and the "Help Efficient, Accessible, Low-cost, Timely Healthcare (HEALTH) Act" (also H.R. 5). Seven Democrats voted yes while 10 Republicans voted no and 4 Republicans voted present.
H.R. 452, originally introduced by Rep. Phil Roe, MD (R-Tenn.), would repeal the Independent Payment Advisory Board (IPAB). This legislation was combined in the Rules Committee with the HEALTH Act, which provided savings that are more than sufficient to offset the estimated $3.1 billion cost of repealing the IPAB. The HEALTH Act, originally introduced by Rep. Phil Gingrey, MD (R-Ga.), contains a wide range of AMA-supported medical liability reforms, including a $250,000 cap on noneconomic damages. The version of the HEALTH Act that was included in the combined bill did not include provisions that would permit the introduction of evidence of income from collateral sources at trial, reflecting modifications made by the House Judiciary Committee.
H.R. 5 is not likely to be considered by the Senate in its current form.
During the debate, several additional amendments of interest to physicians were also approved:
An amendment offered by Rep. Paul Gosar (R-Ariz.), which would restore the application of antitrust laws to the business of health insurance by amending the McCarran-Ferguson Act, was accepted by voice vote.
Rep. Charlie Dent (R-Penn.) offered an amendment that would address the crisis in access to emergency care by extending liability coverage to on-call and emergency room physicians under the Federal Tort Claims Act, which was accepted by voice vote.
An amendment offered by Reps. Cliff Stearns (R-Fla.) and Jim Matheson (D-Utah) would grant limited civil liability protection to health professionals that volunteer at federally declared disaster sites, and was accepted by a vote of 251 to 157.
AMA offers physician practices updated EFT resource
The key to matching the electronic funds transfer (EFT) payment with the electronic remittance advice (ERA) is the TRN-Reassociation Trace Number (TRN) that is passed from the payer to the payer's bank and to the practice's bank and to the practice. The Health Insurance Portability and Accountability Act (HIPAA) Transaction and Code Set regulation requires the payer to place the same TRN in both the ERA and in the associated HIPAA-mandated EFT format (ACH CCD+ Addenda Record) that it forwards to the bank. The NACHA Operating Rules then require that the bank provide the TRN to the practice, when requested. The practice and its bank should discuss the best way to deliver the addenda record information.
When choosing to participate in EFT, a physician practice should advise its bank where to send the ACH CCD+ Addenda record information that includes the TRN key and discuss options for delivering the addenda record informationand any associated fees. Those considering transitioning from paper explanation of benefits (EOB) to accepting ERAs, and/or from accepting checks to accepting EFTs, should access the AMA's Electronic Remittance Advice Toolkit or AMA's Electronic Funds Transfer Toolkit, which includes the "ACH Primer for Healthcare: A Guide to Understanding EFT Payment Processing" developed by NACHA - The Electronic Payments Association. The EFT toolkit also includes a recently updated resource, "Questions to ask a bank before signing an EFT agreement."
