MSDC News for Members: Shaping CMS's Transparency Rules; Pushing for Medicare Patient Empowerment Act

MSDC works to shape CMS's Sunshine Transparency Rules
     On February 17, MSDC, with the AMA and its federation partners, sent a letter expressing its support of the CMS's decision to delay implementation of the Sunshine Transparency Rules under the Affordable Care Act (ACA).  The ACA mandates that beginning in 2012, manufacturers of specified drugs, medical devices, and biologicals participating in U.S. federal health care programs must begin tracking any transfers of value or payments of $10 or more (as indexed by Consumer Price Index) to physicians and teaching hospitals. These reports must be submitted to the Secretary of Health and Human Services on an annual basis. The majority of the information contained in the reports will be available on a public, searchable website in 2013. In addition, the ACA mandates that manufacturers and group purchasing organizations (GPOs) must report ownership interests held by physicians and their close family members.  By delaying this implementation, physicians will have a better opportunity to shape the policies that create the processes for reporting.

Continuing to push for the Medicare Patient Empowerment Act

    The AMA and MSDC continue to educate members of Congress about HR 1700, "The Medicare Patient Empowerment Act."  This bill is based largely on policy supported by MSDC at the AMA House of Delegates meeting in 2010, and allows Medicare patients and their physicians to enter into private contracts without penalty to either party. 

     The AMA is launching a grassroots initiative to generate public support for Congressional passage of H.R. 1700 and S. 1042, the Medicare Patient Empowerment Act, introduced by Rep. Tom Price (R-GA) and Sen. Lisa Murkowski (R-AK), respectively. 

     The AMA has developed a range of resource material to support this work, including:

  • An educational slide deck, with script, for physician audiences that can be personalized by the presenter.
  • A physician-focused Frequently Asked Questions document.
  • An educational slide deck, with script, for patient audiences that can be personalized by the presenter.
  • A patient-focused Frequently Asked Questions document.
  • A short educational video for patients.
  • A downloadable patient flyer for physician offices.
  • A web-based petition for patients and physicians, which provides access to educational material and enables patients to send email directly to their legislators.  This can be accessed through a dedicated micro site at www.MyMedicare-MyChoice.org.

     MLN Matters Special Edition Article #SE1206, "2012 Electronic Prescribing (eRx) Incentive Program: Future Payment Adjustments," has been released in downloadable format.  This article is designed to provide education on future eRx Incentive Program payment adjustments for eligible professionals and selected group practices that participate in the 2012 eRx Group Practice Reporting Option, and includes information about the applicable electronic percent for payment adjustments, eligibility criteria, and how to submit a hardship request.

     

CMS Proposes Definition of Stage 2 Meaningful Use of Certified Electronic Health Record Technology     

     The Centers for Medicare & Medicaid Services (CMS) announced a proposed rule for Stage 2 requirements for the Medicare and Medicaid Electronic Health Record (EHR) Incentive Programs. Under the Health Information Technology for Economic and Clinical Health (HITECH) Act, part of American Recovery and Reinvestment Act of 2009, eligible health care professionals (EPs), eligible hospitals and Critical Access Hospitals can qualify for Medicare and Medicaid incentive payments when they adopt certified EHR technology and use it to demonstrate "meaningful use" of that technology by achieving objectives set by CMS.

     The fact sheet summarizes CMS' proposed requirements for Stage 2 of the Medicare and Medicaid EHR Incentive Programs and highlights:

  • Changes to Stage 1 Criteria for Meaningful Use
  • Greater Applicability to Specialists
  • Stage 2 Reporting of Clinical Quality Measures
  • Payment Adjustments and Exceptions
  • Extension of Stage 1

     In this proposed rule, CMS proposes several changes to existing Stage 1 criteria for meaningful use. Some of these changes would be optional for use by providers in Stage 1 but would be required for use in Stage 2. Other changes would not take effect until providers have to meet the Stage 2 criteria.

AMA Updates: Solving Physician Identity Theft; Risk-based Payment Systems; Reimbursing Medicare Patients

Physician Identify Theft is being tackled by the AMA and CMS
     The AMA has been engaged with CMS on the topic of physician identity theft. Recently, CMS launched a new program to address physician identity theft, and is continuing to work on the issue. We would like to convene an informal group of physicians who have been the victims of identity theft to voice their experience and perspective to CMS on the topic via a conference call, with follow up as necessary. Please let the AMA know if you have been victimized by identity theft and would be willing to participate in this conversation. AMA resource helps physicians prepare for success under risk-based

payment systems
     The AMA recently published a comprehensive physician resource entitled, "Evaluating
and negotiating emerging payment options." Developed by the AMA and experts in physician payment issues, this resource helps physicians take the practical steps needed to succeed under the risk-based payment arrangements that will likely become more commonplace over the next several years. It is designed to help physicians: 

  1. evaluate the risk-based payment contracts offered to them; 
  2. understand the contract negotiation process and maximize the likelihood that they will be able to negotiate acceptable contract terms; and 
  3. successfully monitor and manage risk over the course of the
    risk-based payment arrangement. 

     "Evaluating and negotiating emerging payment options" begins with an introduction outlining the differences between fee-for-service and the budget-based methodologies that underlie all risk-based payment arrangements. Subsequent chapters provide practice guidance concerning: 

  1. how physicians can determine their baseline practice costs; 
  2. ongoing fee-for-service payment issues, including issues that arise when fee schedules are based on the Medicare Resource-based Relative Value System; 
  3. pay-for-performance programs; 
  4. capitation; 
  5. shared savings (currently under development); 
  6. bundled payments; 
  7. withholds and risk pools; 
  8. risk adjustment; 
  9. stop-loss insurance; 
  10. working with actuaries; 
  11. negotiating the deal; 
  12. joint contracting/collective bargaining; and 
  13. ethical implications of financial incentives in managed care contracts.

AHRQ's "Question are the Answer" Campaign Releases New Materials
     "Questions are the Answer," a new initiative from the U.S. Department of Health and Human Services' Agency for Healthcare Research and Quality (AHRQ), is designed to improve communication between patients and clinicians to help make health care safer.
     The initiative features a website -- www.ahrq.gov/questions -- where you will find these free tools:
  • A 7-minute video featuring patients and clinicians who discuss the importance of asking questions and sharing information - this tool is ideal for a patient waiting room area and can be set to run on a continuous loop.
  • A new brochure, titled "Be More Involved in Your Health Care: Tips for Patients," that offers helpful suggestions to follow before, during and after a medical visit.
  • Notepads to help patients prioritize the top three questions they wish to ask during their medical appointment.

Overview:

  CDC estimates that influenza virus infections in the United States result in an average of more than 200,000 related hospitalizations, and between 3,300 to 49,000 deaths each year, depending upon the severity of the influenza season. Annual influenza vaccination is recommended for all persons aged 6 months and older, and is the best way to prevent influenza. However, available evidence for seasonal influenza and 2009 pandemic H1N1 consistently indicates that antiviral treatment, when initiated as soon as possible, can have clinical and public health benefit in reducing severe outcomes of influenza.  During this COCA conference call, a CDC subject matter expert will review current Advisory Committee on Immunization Practices (ACIP) and CDC guidance on the use of antiviral medications in the prevention and treatment of influenza.
