Medicare Updates: HIPAA Version 5010; Electronic Prescribing Incentive Program Feedback Reports

Relaxation of Version 5010 Testing Review Requirement

     The Centers for Medicare & Medicaid Services (CMS) announced on Friday, December 23, that it would allow Medicare Administrative Contractors (MACs) to have the ability to relax the testing review requirement stated in the Medicare Claims Processing Manual, Chapter 24 General EDI and EDI Support Requirements, Section 50.5 EDI Testing Accuracy. This announcement allows trading partners to request transition into version 5010 production status without the full review of electronic test claims.

2012 Electronic Prescribing (eRx) Incentive Program Payment Adjustment Feedback Report Update
     The Centers for Medicare & Medicaid Services would like to advise providers, due to the high volume of significant hardship exemption requests received it is no longer technically feasible for CMS to provide a 2012 Electronic Prescribing (eRx) Incentive Program payment adjustment feedback report as originally intended.
     As CMS continues to explore alternative means to notify eligible professionals that they are subject to the 2012 eRx payment adjustment, we urge you to review your remittance advices for claims submitted for dates of services on or after January 1, 2012.
     Eligible professionals and group practices (GPRO) participating in the eRx GPRO that receive the 2012 eRx payment adjustment will see the term "LE" on their remittance advice for all Medicare Part B services rendered January 1-December 31, 2012.
     The remittance advice will also contain the following Claim Adjustment Reason Code (CARC) and Remittance Advice Remark Code (RARC): 

  • CARC 237 - Legislated/Regulatory Penalty. At least one Remark Code must be provided (may be comprised of either the NCPDP Reject Reason Code, or Remittance Advice Remark Code that is not an ALERT)
  • RARC N545 - Payment reduced based on status as an unsuccessful e-prescriber per the Electronic Prescribing (eRx) Incentive Program

     If an eligible professional or group practice that participated in the eRx GPRO receives the payment adjustment in error (e.g., the eligible professional or group practice submitted a hardship exemption request that is ultimately approved by CMS), the claim will be reprocessed to return the 1.0% and the remittance advice for the reprocessed claim will include the following codes and messages: 

  • CARC 237 - Legislated/Regulatory Penalty. At least one Remark Code must be provided (may be comprised of either the NCPDP Reject Reason Code, or Remittance Advice Remark Code that is not an ALERT)
  • RARC N546 - Payment represents a previous reduction based on the Electronic Prescribing (eRx) Incentive Program

Should the District consider an ban on all cell phone use while driving?
     On Tuesday, December 13, the National Transportation Safety Board (NTSB) released a recommendation to ban all cell phone use by drivers.  The recommendation cites an NTSB study on the effect of distracted driving, and includes all cell phone use except manufacturer-installed in-car phone systems and cell phone use by passengers.
     The District already has a handheld cell phone use ban in place.  Should the DC City Council consider expanding the handheld cell phone use ban to follow the NTSB recommendation and include all cell phone use by drivers, including handheld and hands-free?

AMA Updates: HIPAA Version 5010 Enforcement Flexibility; Working For Administrative Simplification

CMS Announces HIPAA 5010 Enforcement Flexibility
     CMS is the federal agency charged with oversight of HIPAA standards. AMA and others advocated to CMS that overall lack of industry readiness should not compromise physician cash flow following the January 1, 2012 compliance date. For this reason, CMS has indicated they will not levy any enforcement actions for the first three months of 2012 while HIPAA covered entities continue to work towards compliance. What this means is that the HIPAA 5010 compliance date remains January 1, 2012 and all physicians and other HIPAA covered entities should continue to make every effort to comply with the use of the new standards, but that CMS will not take any enforcement action during this period.

 

Medicare's Plans:

     Medicare, as the largest insurer that is required to comply with HIPAA requirements, has indicated that it is continuing to work with those who submit claims directly to them (Submitters). "Submitters" include clearinghouses, third party billers, and physicians who submit claims directly (without the use of a third party or clearinghouse) to Medicare. Every submitter is required to test with Medicare before claims can be processed using the 5010 format. Medicare remains focused on ensuring all Submitters have tested successfully and that claims processing is not interrupted. What this means for physicians:

     Direct Submitters

If you are a physician who sends claims directly to Medicare ("Submitters") without the use of a billing service or clearinghouse:

  • If you HAVE NOT tested by December 31, 2011: You are required to submit a "transition plan" to your Medicare contractor that details your plans for moving to 5010 and when you think you will be able to test with Medicare.  You will have 30 days to do this once you have been contacted by your Medicare contractor.
    • No prescribed format for transition plan: It can be sent via letter, email, or fax and can be a brief explanation of your transition plans
    • Keep evidence plan was submitted: Submitters are strongly encouraged to retain evidence that a plan was sent (i.e. return receipt email, fax transmission confirmation, copy of an email, etc.)
    • All submitters must test: Unless submitters have tested with their Medicare contractor, even if you submit compliant 5010 transactions, your claims will be rejected
  • If you HAVE tested successfully by December 31, 2011: You will be contacted by Medicare and told you have 30 days to move over to use of the 5010 standards. Submitters that have not yet tested with Medicare prior to the compliance date will be contacted and asked to submit the transition plan described above.

      Physicians who use a clearinghouse or billing service to submit their claims

     If you are a physician who relies on a billing service or clearinghouse to submit your claims to Medicare, you are NOT required to file a transition plan to Medicare. The entity they use to submit their claims is the Submitter and is the one required to submit a transition plan. These physicians should contact their billing services or clearinghouses to determine their ability to generate the physician's claims and other transactions using the Version 5010 format.

AMA testifies before NCVHS to promote administrative simplification

     In mid-November, the AMA was called to testify before the National Committee on Vital & Health Statistics (NCVHS), a federal advisory committee to the U.S. Department of Health and Human Services on the Health Insurance Portability & Accountability Act (HIPAA), on several possible additional standards that could significantly reduce administrative hassles for physicians. The AMA testified on the need for national standards governing claims attachments, claims edits, payment rules, provider enrollment and audits. The Affordable Care Act (ACA) called for several of these standards, and the AMA has long championed greater uniformity in each of these areas. The AMA has been called upon numerous times by NCVHS to provide critical input on HIPAA standards development. Access copies of the AMA's testimonies to learn more.
