MSDC Expresses Concerns with the Independent Payment Advisory Board to Members of Congress
The Patient Protection and Affordable Care Act (PPACA [P.L. 111-148]) created the Independent Payment Advisory Board (IPAB), a commission appointed by the President and empowered to make changes to reduce per capita Medicare spending that exceeds a government determined threshold. The IPAB will have unprecedented power with little oversight and judicial review will be prohibited. MSDC is concerned about rationing of care as a result of IPAB actions. The IPAB is barred from proposing modifications to Medicare that would result in changing the current system for beneficiaries, including beneficiary premiums, cost-sharing, or benefit design. Because of these restrictions, we believe the panel will reduce payments to providers and access to innovative therapies, thus limiting patient access.

MSDC Reiterates the Importance of Sustainable Growth Rate Reform to the Deficit Reduction Discussion Participants
MSDC, and other state and national medical societies, have sent a letter to President Obama, Vice President Biden, Sens. Inouye, Baucus, Kyl, Reid, and McConnell, and Reps. Cantor, Van Hollen, Clyburn, Pelosi and Speaker Boehner urging them to repeal and reform the current Sustainable Growth Rate used in Medicare. The letter addresses the need for reform, and its potential positive impact on the deficit if done properly. The letter emphasizes this need, while Congressional staffers from the House Ways and Means, and Energy and Commerce committees continue to meet to discuss possible ways to replace the SGR.
Audiologists Push to Expand Their Scope of Practice within the Medicare Program Inappropriately, MSDC Joins in Support of Patient Protection by Limiting this Expansion
On June 3, 2011, U.S. Representative Mike Ross (D-AR) introduced H.R. 2140, a bill that would inappropriately grant audiologists unlimited direct access to Medicare patients without a physician referral. The American Academy of Otolaryngology-Head and Neck Surgery (AAO-HNS) strongly opposes H.R. 2140. This is not the first time this issue has been addressed. In 2009, over 100 organizations joined the AAO-HNS in opposing nearly identical legislation. The AAO-HNS believes a physician-led hearing healthcare team with coordination of services is the best approach for providing the highest quality care to patients. To that end, the AAO-HNS initiated and actively participated in past negotiations with the American Academy of Audiology (AAA) to identify ways to increase seniors' access to our non-physician colleagues without jeopardizing patient safety. Unfortunately, the AAA ultimately withdrew its support of jointly-crafted compromise legislation and has continued its efforts to advance the recycled language included in H.R. 2140. While audiologists play a critical role in providing quality hearing healthcare, their desire to independently diagnose hearing disorders transcends their level of training and expertise. Hearing and balance disorders are medical conditions and require, by necessity, a full patient history and physical examination by a physician. Bypassing a physician evaluation and referral can lead to misdiagnosis and inappropriate treatment that could cause lasting, and expensive, damage to patients.

National Uniform Claims Committee Announces 45-day Public Comment Period on Proposed Revisions to the 1500 Health Insurance Claim Form The National Uniform Claim Committee (NUCC) has announced the opening of a 45-day public comment period, ending July 21, 2011, for proposed revisions to the 1500 Health Insurance Claim Form (1500 Form). The proposed revisions to the 1500 Form will accommodate data reporting changes in the Version 005010 837 professional electronic claim transaction and other business needs. The NUCC is conducting this survey to receive feedback on the proposed revisions and the costs and benefits of implementing the proposed revised 1500 Form. The NUCC will use this feedback in making its decision on moving forward with revising the 1500 Form. The timeframe for when a revised form would be required is not yet known. Three draft versions of the mock-up form are being made available for evaluation - a "clean", a "grid" and a "byte" version. MSDC Begins Working with Stakeholders on the DC Health Insurance Exchange
|

The District of Columbia Health Insurance Exchange is continuing to be developed through a series of hearings at the DC Council in the upcoming weeks. The bill establishing the exchange, B19-2 "The Department of Health Care Finance District of Columbia Health Insurance Exchange Act of 2011," has been introduced by Councilmember David Catania and is working its way through the Committee on Public Services and Consumer Affairs and the Committee on Health. In preparation for these hearings, MSDC has been meeting with partners at Families USA, the DC Primary Care Association and other affiliated organizations to ensure the exchange is constructed and governed properly, to the benefit or all involved and the protection of citizen-patients it is designed to serve. We have also been represented at Mayor Gray's Health Reform Implementation Committee, focusing on the governance and structure of the health insurance exchange. There are two additional upcoming meetings that will focus on aspects of the health insurance exchange, occurring on June 21 and June 29. MSDC will continue to discuss and craft the proper mechanisms for the exchange in the coming weeks. As the insurance exchange develops and the bill progresses through the Council and any changes are made, we will continue to update you on the DC Health Insurance Exchange. |

National Provider Call on Physician Quality Reporting System & Electronic Prescribing Incentive Program
CMS will host a national provider call on the Physician Quality Reporting System & Electronic Prescribing Incentive Program. Subject matter experts will provide an overview of the proposed rule (CMS-3248-P, released on Thu May 26, 2011), which addresses the proposed changes to the Medicare Electronic Prescribing (eRx) Incentive Program; a question and answer session will follow the presentation. The target audience for this call includes medical coders, physician office staff, provider billing staff, health records staff, vendors, and all Medicare fee-for-service providers.
