| MSDC Signs onto Letter Demanding Congressional Action to Resolve the Medicare Meltdown Crisis; Use November Elections to Fix Medicare with Senators and Representatives | |
MSDC Signs onto Letter to Congress The Medical Society of DC has joined state and national medical societies in a letter demanding a permanent fix to Medicare's flawed payment formula by Congress after this year's election cycle. The letter makes clear what Congress is risking in consequences to physicians and Medicare patients, should the status quo of "inaction" be maintained. There has been an on-going debate over how to resolve the problem of Medicare sustainability that does not limit patients' access to needed medical care. In the beginning of the letter, MSDC emphasizes the severity of Medicare's future to physicians and patients by stating, "the Preservation of Access to Care for Medicare Beneficiaries and Pension Relief Act of 2010 (P.L. 111-192) stabilized Medicare physician payments only until November 30, 2010. After that, Medicare payments for physician services will be slashed by more than 23 percent. To make matters worse, an additional cut of 6.5 percent will follow on January 1, 2011. Physician practices simply cannot absorb cuts of this magnitude in a program as important as Medicare." The letter will be sent to Congressional offices this week. On November 30, Congress' most recent Medicare payment patch will expire, exposing all Medicare-providing physicians to a 23 percent payment cut. Furthermore, the cuts are expected to increase to nearly 30 percent on Jan. 1, 2011. As this is scheduled to occur, you will also be deciding how to move your practice forward with the Medicare program. You will have the choice to become a "participating physician," a "non-participating physician" or 30-days before the beginning of the quarter, you may choose to "opt out" of Medicare entirely. We must act together to get Congress to stabilize physician payments-at least through the end of 2011-before the next cuts are allowed to take effect to avoid the payment adjustment mess from earlier this year. The next step will be for physicians to bring their own long-term improvements to the new Congress that include eliminating the SGR all together. Use the November election to secure a commitment from Congress to fix the SGR problem- attend a town hall, ask questions at a debate, call their campaign offices-anything to hold them accountable. | Update from Highmark Medicare Services: Claim Reviews and Fee Schedule Adjustments; PECOS Dark Days | Claim Review on Procedure Codes 99204 and 99205
In a recent posting to their website, Highmark Medicare Services (Highmark) announced the initiation of a new review focusing on these E&M codes given preliminary evidence that widespread problems were present with current billings. The problems cited by Highmark extended beyond the issue of support for the code selection and included a variety of citations such as signature and plan of care requirements. Highmark will be conducting a limited review of these billings. The scope of the review will be much less intensive, and therefore less intrusive, than implied by the article. Claims will be randomly selected for review on a daily basis from their entire Jurisdiction 12 area. While the specific impact cannot be precisely estimated, it is believed that this endeavor will place only relatively minor demands on the membership.
Fee Schedule Adjustments
This year has certainly been one for the books relative to the roller coaster ride otherwise known as the Medicare Physician Fee Schedule (MPFS). The highlight of activity (so far) occurred in June when first the 21% reduction fee schedule was installed followed shortly by its replacement schedule that contained a 2.2% increase. The 21% reductions only affected three days of processing by Highmark Medicare Services (Highmark). Services that were paid per this fee schedule were automatically adjusted and this activity was completed on July 9th.
The installation of the fee schedule that contained the 2.2% increase occurred on June 28th. Claims finalized on and after this date reflect the 2.2% fee schedule amounts for dates of service on and after June 1, 2010. Unlike the earlier situation, the Center for Medicare did not instruct their contractors to automatically adjust claims (in either an up or down manner). Information on this matter was published on the CMS website as part of the Medicare Learning Network Matters article number MM6973 which also contains a link to the formal Change Request document. Providers may seek recovery for fee schedule differentials by filing a petition or request for a reopening with Highmark if so inclined.
PECOS Dark Days
Due to scheduled maintenance, the Internet-based Provider Enrollment, Chain and Ownership System (PECOS) will be unavailable from Wed Sep 29 through Sun Oct 3. Internet-based PECOS allows physicians, non-physician practitioners, providers, and other suppliers to enroll or make a change to their existing Medicare enrollment information over the Internet. If you would like to enroll or make a change to your existing Medicare enrollment record, you can do either of the following: 1. Use Internet-based PECOS prior to Wed Sep 29 or after Sun Oct 3. For more information about Internet-based PECOS, see the appropriate "Getting Started" guide available in the Downloads section . There is a "Getting Started" guide for physicians and non-physician practitioners and one for provider and supplier organizations. 2. Complete and submit the paper Medicare provider enrollment applications(s) (CMS-855) along with any required supporting documentation and mail the application(s) to the appropriate Medicare carrier, fiscal intermediary, or A/B MAC. High-Risk Pool Opens Enrollment for DC
The District of Columbia's Department of Health Care Finance (DHCF) announced the availability of the Pre-Existing Condition Insurance Plan (PCIP) through the US Department of Health and Human Services (DHHS). The program provides affordable health insurance for District residents unable to purchase health coverage in the commercial marketplace because of a pre-existing medical condition. After exploring the feasibility of a District-run program, DHCF informed DHHS that it would join the 23 participating states utilizing the federal option. The program is administered by GEHA, a health insurance carrier under contract with the DHHS. The PCIP was established by the federal health reform legislation, the Affordable Care Act (ACA), it is a transitional program that provides coverage until the health insurance exchanges are launched in 2014. The health insurance exchanges will offer subsidized health coverage in all states to residents without insurance coverage, regardless of their medical condition. Through the ACA, states were offered the option of administering a PCIP program using federal funds or allowing the federal government to run a program. As of September 15, 2010, District residents can apply for the program, with coverage starting as soon as October 1, 2010 for applications submitted and approved prior to September 30, 2010. District ranks 49th of 51 for Electronic Prescribing Use
According to Surescripts LLC, a company that operates the nation's largest e-prescribing network, and their annual Safe-Rx Awards, the District ranks 49th out of 51 states/districts in the United States in use of electronic prescribing for prescriptions. The only two states falling below the District are Alaska and North Dakota. E-prescribing has been identified as one of the measures of the "meaningful use" requirement for Electronic Medical Record to qualify for the financial incentives for Health IT implementation through Medicare. |
| Update from the AMA: October 5th Deadline for UnitedHealth Group Claims; AMA Seeks Nominations for The Joint Commission Board of Commissioners |
UnitedHealth Group UCR Settlement update
Pursuant to Court Order, all Class Members have until October 5, 2010 to file their claim form to be eligible to receive monies from the Settlement Fund. When Class Members submit requests for claims data from the Claims Administrator, as described in the Class Notice at pages 4 and 8, or submits the claim information request form on page 15 they will be assigned an Initial Claim Number, which will satisfy the filing deadline. Once Class Members receive the requested claims data, they should submit their claim form directly to the Claims Administrator at the address shown, using the Initial Claim Number for identification purposes. After the October 5, 2010 deadline, and after all requested claims data has been provided, the Claims Administrator will send a Deficiency Letter to any Class Member who has been assigned an Initial Claim Number but who has not yet submitted a complete and signed claim form, as well as to any Class Member whose submitted claim form is deficient in some manner. The Deficiency Letter will notify the Class Member of what has to be submitted as well as a new due date by which such new information must be supplied. All deficiencies in Class Members' submissions to the Claims Administrator, including the lack of complete and signed claim forms for those class members assigned an Initial Claim Number, and the absence of all necessary evidence, must be resolved by the due date set out in the Deficiency Letter in order for Class Members to be eligible to receive their Recognized Losses from the Settlement Fund. Please note that the deadline for filing claim forms for those Class Members who did not submit requests for claims data to support their claims remains October 5, 2010.
AMA Seeking Nominations for AMA Seat on The Joint Commission Board of Commissioners - Deadline October 8, 2010
The American Medical Association (AMA) is seeking nominations for one of its open seats as an AMA non-Trustee Commissioner on The Joint Commission's Board of Commissioners. Given the AMA's advocacy efforts for the practicing physician, nominees from all specialties and areas of practice experience will be considered.
Nominee(s) must be active members of the AMA and be willing to serve a minimum of one three-year term beginning January 1, 2011 through December 31, 2013. The AMA non-Trustee Commissioner will be limited to serve three terms for a maximum tenure of nine years.
The AMA Board of Trustees will review the nominations and appoint one AMA non-Trustee Commissioner during its November Board meeting. To ensure consideration, nominations must be received by Friday, October 8, 2010. All nomination materials must be submitted via email (not via fax) including the completed nomination form, CV (no longer than three pages), letters of endorsement/support, and other relevant information. DC Psychiatric Society - a chapter of the Washington Psychiatric Society - held its annual meeting at the MSDC offices
The annual meeting of the DC Psychiatric Society, (a chapter of WPS), was held September 15, 2010 at MSDC. This professional meeting was attended by about thirty colleagues, including Residents from St. Elizabeth's, GWU, Howard & Georgetown, as well as senior WPS leaders, NIH Clinical Research Center staff and two sponsoring organizations, NIH Federal Credit Union and Cbeyond. This unique event rekindled the DC Psychiatric Society's tradition of collaboration with MSDC, and included Dr. Annelle Primm, Deputy Medical Director of the APA, as keynote speaker who spoke on HIV/AIDS in our Community. The 5th anniversary of the first DC PGYI & PGYII meeting in 2005 at the Cosmos Club was also celebrated. That meeting grew into the Career, Leadership & Mentorship program, which has demonstrated the creative and effective leadership of our budding new generation of leaders.
Many thanks and warmest congratulations to Drs. Hind Benjelloun, David I. Driver, Kayla Pope, Ashley Hilliard and to MSDC staff Barbara Allen & Chris Lee as well as to Edward Shanbacker, MSDC Executive Vice President who delivered this memorable evening.

MSDC continues to participate in local health care reform initiatives, including the Health Reform Implementation Committee, the District's Regional Health Information Organization and Health Information Exchange
Work is on-going within the District to successfully implement the changes occuring to our health care system under the Affordable Care Act. MSDC continues to participate with the Mayor's Health Reform Implementation Committee, and is working to serve on the Delivery System Subcommittee.
The DC RHIO's Governance and Sustainability Workgroup, under DCPCA, has just finalized its planning sessions and will be submitting a progress report to the Office of the National Coordinator for Health IT this week.
The Department of Health Care Finance is overseeing the development of the District's Health Information Exchange. MSDC continues to serve on their Steering Committee, which is entering its second month of operation. |
| President's Report - Looking forward, Looking Back |

Now that the academic calendar has started, the pace in Washington has picked up for the sprint to the end of the year. It has been an interesting year, to say the least. We are facing numerous challenges and opportunities.
These are uncertain times for the practice of medicine, and we see dramatic changes here locally and nationally. Over the past several years we have seen the corporatization/industrialization of health care here in the Washington, DC area. We have seen the expansion of Johns Hopkins, Universal Health Care, Medstar Health, HCA, INOVA and so on. There are benefits and concerns with all of these changes. Across the country there have been reported conflicts between medical staffs and hospital administrators. So far, we have not seen these problems in our area. With good communication and working together, hopefully these potential conflicts can be avoided. MSDC can play a critical role in this area and we should reach out to medical staffs across the city by attending their quarterly staff meetings and including members from of all the hospitals in our operations at the Society. I have always wanted to see a "Council of Medical Staff Presidents" that could interface with MSDC leadership to hear directly from the physician elected officials of each hospital. It is important that private practice doctors are not crushed as we enter the next decade of DC health care.
The membership can always benefit from activities and products that help them with their practice. As such, we should try to partner with the Medical Society of Virginia and Maryland MedChi. A regional alliance will also be a benefit to all 3 Societies. In this spirit, I will be attending a "Health Information Technology" meeting offered by the Medical Society of Virginia and attending the swearing in of the 163 President of Maryland MedChi. Our AMA Delegation is perfectly positioned to network with members of Congress on National issues, and other State and Specialty Societies to bring the BOD opportunities to reach out to these groups. President to President interaction is an effective way to tackle tough issues in the future.
Networking and alliances are critical locally as well. We have developed an important relationship with DC MedChi, DCHA, and other health care partners across the city. It will be critical to work both with an independent DCDOH, DC Committee on Health, Board of Medicine, the Mayor's Office and City Council. We have seen unprecedented foolish cuts in DC Medicaid that threatens access to health care to the most vulnerable members of our city. Vincent Gray, as Chairman of the City Council, has a good working relationship with MSDC. I recently served on a panel with him at the Chamber of Commerce Meeting on Health Care and emphasized the financial benefit to the city of passage of meaningful MLR. MSDC must be in the forefront of all health care activities in the District. As such, we must always take the high road, and let others join us there. Politics should be set aside, and we must advocate for our members and their patients.

The Office of the National Coordinator for Health Information Technology (ONC) named InfoGard Laboratories, Inc., San Luis Obispo, Calif. as an ONC-Authorized Testing and Certification Body (ONC-ATCB). The addition of InfoGard Laboratories, Inc. as an ONC-ATCB provides more options for EHR vendors to have their products tested and certified for compliance with the standards and certification criteria that were issued by the U. S. Department of Health and Human Services earlier this year. Certification of EHRs is part of a broad initiative undertaken by Congress and President Obama under the Health Information Technology for Economic and Clinical Health (HITECH) Act, which was part of the American Recovery and Reinvestment Act (ARRA) of 2009. HITECH created new incentive payment programs to help health providers as they transition from paper-based medical records to EHRs. Incentive payments totaling as much as $27 billion may be made under the program. Individual physicians and other eligible professionals can receive up to $44,000 through Medicare and almost $64,000 through Medicaid. Hospitals can receive millions. To qualify for the incentive payments offered by the Centers for Medicare & Medicaid Services (CMS) providers must not only adopt, but also demonstrate the meaningful use of, certified EHR systems. ONC authorized the first two ONC-ATCBs in late August, 2010. Additional applications are under review.
