Medical Liability Protection Bill Moves Forward in the US House; AMA Hosts EHR Webinar Today at 5pm
  • American Medical Association     On July 18, the Energy and Commerce Committee approved H.R. 1745, the "Family Health Care Accessibility Act," by voice vote. The bill, which was introduced by Representatives Tim Murphy (R-PA) and Gene Green (D-TX), would amend the Public Health Service Act to provide federal tort claims act (FTCA) liability protection for volunteer practitioners at community health centers.
  •      The AMA will host a webinar today, August 16th, from 5-6:30 pm on the new Medicare and Medicaid Electronic Health Record (EHR) Incentive Program. The featured presenter will be Karen Trudel, the Deputy Director of the Office of E-Health Standards and Services (OESS) at the Centers for Medicare and Medicaid Services (CMS), the office charged with oversight of these programs.  If you can't listen in live, go ahead and register. We'll send you a post-event e-mail with the materials and a link to the AMA's webinar archive.
Remembering Peter J. Cohen, MD, JD
Dr. Peter Cohen     We are deeply saddened to convey to you that Peter J. Cohen, MD, JD, passed away on Saturday, August 14. We are told that he died after suffering a massive stroke on hemodialysis.  We are truly devastated by this news since Dr. Cohen was a good friend and a tremendous support to those in recovery.  He was always incredibly understanding but firm. He was a role model and inspiration to many, showing that living sober and free of alcohol and drugs was a gift that the program of Alcoholics Anonymous could give.
     Dr. Cohen was a true believer that physicians who had substance abuse problems deserved treatment and deserved  to heal and continue practicing medicine. He also believed that those who became sober should give back to our community. Dr. Cohen not only volunteered to be on the MSDC Physician Health Program but gave freely of himself on that committee for many, many years. Dedicating hours and hours of his time to serve physicians who needed and benefited from his help.  Dr. Cohen served his last years on the MSDC PHP Committee as chairman and did so with the greatest of distinction. We are blessed to have been his friend and to have known him. He remains a role model.
     Dr. Cohen was and will always be in our hearts. May he rest in peace.

MSDC Joins Other State and National Medical Societies for Legislative Advocacy and Policy Roundtable
MSDC stripped     MSDC Executive Vice President, K. Edward Shanbacker, joined other State and National  Medical Society leaders to discuss upcoming issues in organized medicine and public advocacy.  The recently passed Patient Protection and Affordable Care Act (PPACA) was heavily discussed and scrutinized among those in attendance.  Other topics covered include:
  • Medicaid expansion, budgeting and physician payment
  • Aggressive private payer reform at the state level
  • Scope of practice with various allied health roles
  • Medical Liability Reform and it's legislative potential

NIH Awards $38 Million to Joint Clinical Effort between Georgetown University Medical Center and Howard University
     In support of a critical partnership between Georgetown University Medical Center and Howard University, the National Institutes of Health (NIH) has awarded a $38 million Clinical and Translational Sciences Award to aid the universities' effort to transform health care and preventive practices in communities through medical discoveries made in laboratories and clinical settings.  
     The two Washington institutions will form the Georgetown-Howard Universities Center for Clinical and Translational Science (GHUCCTS).  The $38,217,660 grant will be provided to the universities over five years, beginning July 2010.
     As part of the GHUCCTS, researchers will collaborate with MedStar Health/MedStar Research Institute in Hyattsville, Md., Oak Ridge National Laboratory in Oak Ridge, Tenn., and the Washington DC Veteran's Affairs Medical Center to form one of the nation's largest biomedical and clinical research networks.
     The Center will be led jointly by Joseph Verbalis, MD, professor of medicine and chief of the Division of Endocrinology and Metabolism at Georgetown, and Thomas Mellman, MD, professor of psychiatry and associate dean for clinical and translational research at Howard.  They will serve as principal investigators.
     GHUCCTS activities will include supporting clinical research, community engagement, research training and career development, regulatory support, and technology development.

CMS Issues Final Rule for Payment Error Rate Measurement for Medicaid and CHIP
CMS logo     Tthe Centers for Medicare & Medicaid Services (CMS) have issued the final regulations that will fully implement improvements to the Payment Error Rate Measurement (PERM) for Medicaid and the Children's Health Insurance Program (CHIP). 
     PERM measures improper payments in Medicaid and CHIP and produces national-level error rates for each program.  These reviews are conducted to determine whether the sampled cases meet applicable Medicaid and CHIP fee-for-service, managed care, and eligibility requirements.
     With comments received from states, advocacy groups, and educational institutions, the final regulation implements changes to both programs required by the Children's Health Insurance Program Reauthorization Act (CHIPRA) of 2009, and makes other operational changes to the programs based on stakeholder feedback.  The rule changes the process for reviewing cases in which states have used simplified enrollment efforts such as self-declaration for eligibility cases; eliminates duplication of effort between eligibility reviews administered in the same fiscal year; extends the timeframe for providers to submit documentation; and provides states additional time to submit corrective action plans.

ProAssurance     Medication errors are a common source of medical malpractice lawsuits. The most frequent prescribing mistakes include:
  • incorrect or inappropriate dose;
  • use of an inappropriate medication;
  • failure to monitor for drug side effects; and
  • lapses in communicating with patients (e.g., failing to update medication histories or drug allergies, or not emphasizing side effects to the patient).
     Most medication-related lawsuits are triggered by simple mistakes.

American Diabetes Association to Hold "Stop Diabetes! Hero Awards" Dinner
      The American Diabetes Association will be hosting their inaugural event for the National Capital Area ADA, the "Stop Diabetes! Hero Award" dinner, on Tuesday, November 9th, 2010.  The awards will honor individuals, companies and organizations that, by their actions and/or service, exemplify the mission of the American Diabetes Association.  Nominations may be submitted to identify those individuals, companies and organizations that are worthy candidates.
    Here are two of the awards and criteria for which we are seeking your nominations:
    SHARE Award - Individual that meets at least 2 of the following criteria:
  • Has committed high number of hours volunteering, teaching for ADA events/programs in the Washington, DC metro area;
  • Has provided significant support for the ADA within the past calendar year or has effectively lead a campaign to raise support on behalf of the ADA;
  • Has been a leader in the development of a resource (program, training, etc.) with direct benefit to those affected by diabetes;
  • Has been an outspoken advocate for funding for diabetes research;
  • Has assumed a leadership role in the community addressing some of the primary issues related to diabetes, including obesity and healthy lifestyles.
      GIVE Award- An organization, group or company that meets at least 2 of the following criteria:
  • Has demonstrated through volunteer activities a commitment to Stop Diabetes!;
  • Has provided significant support for the ADA over the past calendar year;
  • Has established a resource(program, training, etc.) that has direct benefit to those with diabetes;
  • Has taken a leadership role in public education on diabetes awareness;
  • Has been an outspoken advocate in support of funding for diabetes research

  •      Geeta Nayyar, MD, has been selected for a position on the American College of Rheumatology's Committee on Government Affairs for a 3-year term (2010 - 2013). This  term is scheduled to begin at the ACR Annual Scientific Meeting in November, following approval by the ACR board of directors this month.  The Committee on Government Affairs develops effective liaisons with governmental and nongovernmental research support agencies, congressional members and staff, and with organizations concerned with public policy aspects of health-care delivery and health care financing; and monitors not-for-profit issues of concern to the College. Congratulations on your appointment, Dr. Nayyar!
