MSDC Petitions Council to Block Loss in Medicaid Funding of $10,627,000
|
 MSDC has raised concerns over the Mayor's proposed FY 2011 Budget for the Department of Health Care Finance (DHCF) to the DC Council, specifically, Councilmember David Catania, the Chair of the Committee on Health. Included in the proposed DHCF budget is a 20% cut in Medicaid reimbursement rates. Such a regressive cut would decrease local funding of Medicaid beneficiaries by $2,450,000 and incur an additional loss in Federal matching funds of $8,177,000 - resulting in a total reduction of $10,627,000 in reimbursed medical care. In 2008, MSDC successfully lobbied to have the Medicaid rates increased to match Medicare rates to encourage expansion in the District's Medicaid program by physicians. The rate increase went into effect just over one year ago, in April 2009. Backtracking on the great improvements made in our District's Medicaid program is a serious blow to the health of patients in the District.

MSDC Joins as Co-Plaintiff in Lawsuit Against FTC Over "Red Flags Rules"

The Medical Society of DC has joined with the American Medical Association and other national associations as a named plaintiff in a lawsuit against the Federal Trade Commission to enjoin the "Red Flag Rules" currently required for physicians' medical practices. The suit will be filed in the
United States District Court for the District of Columbia and prepared by the AMA's Litigation Center. In 2003, Congress amended the Consumer Credit Protection Act, 15 U.S.C. § 1681m(e), to
require the FTC and five other federal agencies to issue joint regulations to
detect, prevent, and mitigate identity theft with regard to the extension of
"credit" by a "creditor." The regulations require businesses to
adopt written policies to detect and prevent identity theft and then
review those policies annually to make sure they are being followed. According to the FTC,
physicians, who do not receive full payment for their services at or before the
time they perform those services, are creditors and must comply with the
statutory and regulatory requirements. This requirement is an example of one more pointless distraction from medical practice. The FTC has continually delayed the deadline for
compliance with its regulations, resulting in a June 1, 2010 deadline. However, this habitual delay is not an acceptable outcome. On November 30, 2009, the
American Bar Association secured a declaratory judgment and an injunction in the
DC District Court to prevent enforcement of the FTC red flags regulations
against attorneys. The FTC has appealed the ABA suit, but an encouraging precedent is set for a favorable outcome for physicians.

CMS Change Request 6278 May Lead to Billing Gap; Complaint Form Developed to Inform CMS of the Error
| The CMS Change Request
(CR) 6278 form asking physicians to update their status in Medicare - whether revalidating their participation, or selecting to opt-out - is required for all physicians who see Medicare patients. Due to billing and timing issues, some physicians have reported a gap in their ability to get reimbursed for Medicare patients, should they opt-out. The AMA and Federation Societies have engaged CMS on enrollment problems physicians have experienced over the past
several years. Accordingly, the AMA has created a complaint form which physicians can complete and email back to us at
MedicareProblems@ama-assn.org should they experience any billing problems related to their choice to opt-out of Medicare. Any forms they recieve will be forwarded onto CMS. Also, please note that the AMA has a webpage
dedicated to enrollment issues which can be found at www.ama-assn.org/go/regrelief(select Medicare enrollment) which includes plain English information to help
physicians navigate the enrollment requirements. We will continue to update the
webpage as new policies are finalized.

Medicare & Medicaid Services' (CMS) Provider Communications Group will host
a national provider conference call on the 2010 Physician Quality Reporting
Initiative (PQRI) and Electronic Prescribing Incentive Program (eRx). In order to receive
the call-in information, you must register for the call. Registration will close
at 1:30 p.m. EDT tomorrow, Tuesday, May 11,
2010, or when available space has been filled. Lunch Time

teleconference will cover timely claim filing requirements as well as timely
appeal requirements. We will also review the new timeframes associated with

Organ
Donation - Pushing the
Boundaries
|
The United Network for Organ Sharing (UNOS), established by
Congress in 1994 to administer organ transplantation, reports that since the first
successful kidney transplant in 1954, 466,555 lives have been saved through organ
transplant. From January through November, there were 26,081 transplants in 2009
alone. The problem, if there is one, is that organ transplantation is now
considered the optimal solution for the medical problems of many patients. The supply of
donated organs cannot meet the demand for them. Even though about 74 patients
receive transplants each day, an additional 19 die waiting for an organ. As of
February 16, 2010, organ waiting list totals were:
- Kidney - 83,306
- Liver - 15,768
- Heart - 3,083
But even the fortunate recipients who receive organs are not
always satisfied with the outcome or the donation process. In fact, there is some
speculation that organ transplantation may be a new target for professional liability

Medicare Payment Cuts of 21+% Begin in Two Weeks
|
June 1, 2010 remains as the date for the
21.2% payment cut. This cut is likely to have a ripple effect, with many private
insurers and state Medicaid programs aligning their payment rates with Medicare
rates. Please join in our campaign to gather 1 million signatures to "Stop the Medicare Meltdown." Add your name to the petition and share it with your friends,
family, colleagues, staff, and patients. The petition asks Congress to
develop a rational Medicare physician payment system that automatically keeps up
with the cost of running a practice and is backed by a fair, stable funding
formula. Remember, even if you don't take Medicare, the SGR affects TriCare and most commercial insurance

WASHINGTON, DC- MAY 10, 2010- First

industry-wide campaign designed to raise awareness about the need to protect

May 2010, the fourth annual Disability
Insurance Awareness Month (DIAM) is being coordinated by the nonprofit Life
and Health Insurance Foundation for Education (LIFE), located in Washington,
