Since we published last month's newsletter outlining a few ways in which Illinois is attempting to change its rules on Medicaid eligibility, you may wonder what hasn't changed about qualifying for Medicaid benefits in Illinois. One method of Medicaid eligibility that Illinois has contemplated eliminating entirely, but still currently allows, is the special needs pooled trust for disabled people over the age of 65.
 
Erin's Corner: Planning for Disasters

One of the aspects of my work with Dutton & Casey, P.C. isall firm photo "life care planning"...helping people plan, as much as possible, for events in their lives. In addition to legal and financial planning, one aspect to think about and plan for is disasters. Unfortunately, natural disasters (floods, heat waves, excessive snow, etc.) and man-made disasters (oil leak in Golf Coast, etc.) occur. The time to think about how you, and those who you care about, can plan for unexpected events is now. The American Red Cross, AARP, and other agencies who focus on disaster planning have created a series of publications and how-to-guides that are available, at no-cost, at:

I urge you to take time, now, when events are "calm,"to plan ahead.

Health Reform Law's             Pre-Existing Condition Plan Kicks In

Many Americans, including baby boomers too younghealth care reform image for Medicare and disabled adults of any age, have been unable to obtain private health coverage at any price because of a pre-existing health condition. As part of the roll-out of the new health reform law, the U.S. Department of Health and Human Services (HHS) has announced the establishment of a new Pre-existing Condition Insurance Plan that will offer coverage to these previously uninsurable individuals. 

Steinbrenner Fourth Billionaire in 2010 to Escape Taxes, If Not Death
New York Yankees owner George Steinbrenner is all firm photothe fourth known U.S. billionaire to die during 2010, according to Forbes magazine. Why is this significant? Because there is no estate tax in 2010, meaning that the U.S. Treasury has lost billions in tax revenues unless Congress acts between now and the end of the year to reinstate the tax retroactively.

Nursing Home Residents Have Rights!  

Many people incorrectly believe that once someone nursing home - wheelchairenters a nursing home, their freedom is over. In fact, nursing home residents have many rights, and it is important to know those rights and to be able to enforce them.

Nursing home residents' rights are protected under federal law. In broad terms, nursing homes are required to ensure that every nursing home resident be given whatever services are necessary to function at the highest level possible.
