What a wonderful Summer -- and now the Cape's Shoulder Season!

While we [and my law business] are all concerned that our US economic recovery is too slow, hopefully each had a profitable Summer.

Good Tax News -- Really!

Sometimes Washington does something right!  Here's the deal.  If you add [or previously added - even for the summer period] a new employee this year who was "unemployed," you as the employer will not have to pay the 6.2% Social Security tax on the employee's 2010 wages.  Of course there is a new W-11 form the employee must provide and there are some likely inapplicable limitations.  But knowing that you may save $6.20 on every $100 of wages paid may provide the incentive needed to get some of our men and women back to work.

If such an employee has come and gone, or you've already filed the necessary Forms 941, you can still get the credit.  Call or e-mail me to find out how.
Drive, Don't Text!

That's the new bumper sticker.  Beginning October 1, it is illegal to drive and text in Massachusetts [and if you're under 18, cell phone or similar devices use while driving is prohibited]!  Common sense to most -- but that's the new law.

As a business owner, you should communicate this to all employees and I recommend adopting these prohibitions as a policy!  This should help if an employee gets in an accident while doing what's prohibited -- the polcy ban was not followed.  Make sure the policy covers personal cell phones and other devices as well as any issued by the business.

CORI Law Changes

Check your employment application forms NOW!  If it asks for criminal conviction information on the form either throw the forms away or cross out the requirement.

Another Massachusetts law change now prohibits seeking this information at the application stage of the hiring process.  You may, however, do a CORI check before offering a job to learn of felonies in the prior 10 years and misdemeanors in the last five.  If you decline to hire based upon CORI obtained information, you are required to give the applicant a copy of the CORI report.
