"The Paint Rule": Stepping Through New EPA Regulations for Auto Body Painting
by Sue Schauls, CCAR Technical Advisor The U.S. Environmental Protection Agency's (EPA) new NESHAP 6H rule will impact automotive body shops using paint that contains Hazardous Air Pollutants (HAPs), commonly found in most automotive paints, primers and clear coats.
The actual rule is 40CFR63 Subpart HHHHHH of the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Paint Stripping and Miscellaneous Surface Coating Operations at Area Sources. In most cases, state environmental regulatory agencies are administering the rule for the EPA.
Initial notification forms are due by January 11, 2010 and a notification of full compliance status is due by March 11, 2011. The rule is one of many industry specific regulations for the control of hazardous air pollutant. The 6H rule - which has come to be known in the collision repair industry as the "Paint Rule" - is specific to metal and plastic surface coating operations at area sources including manufacturing and auto body. Auto body shops are not being selectively targeted but are included in a group of rules within a broad spectrum of industries.
The rule only applies if coatings contain targeted HAPs:

Lead (Pb), (> 0.1 percent)

Manganese (Mn), (> 1.0 percent)
-
Nickel (Ni), (> 0.1 percent)
-
Cadmium (Cd), (> 0.1 percent)
-
Chromium (Cr), (> 0.1 percent)
The purpose of this rule is to reduce emissions of lead, nickel, cadmium, chromium and manganese. These chemicals are designated hazardous air pollutants known or suspected to cause cancer and other adverse health effects and can be found in paint used in the automotive refinishing industry.
The NESHAP 6H Rule requirements, include:

Notification Form by January 2010

Paint booth exhaust systems implementation of 98% efficient booth filters

Spray booths/prep stations must be used
-
Spray guns must be efficient types, such as HVLP
-
Spray gun cleaning does not allow atomization of thinner through gun for cleaning and recommends an automated enclosed gun wash
-
Painter training requires gun set-up and spray techniques training material be presented along with a hands-on requirement by January 2011
-
Final Notification of full compliance by March 2011

S/P2 User Profile:
Collex Collision Experts
[Editor's Note: This is the first in a continuing series of articles that will profile companies that utilize the S/P2 e-learning program. We commend all S/P2 users for their commitment to raising the auto repair industry's level of awareness of environmental and safety issues.]
Requiring CCAR's S/P2 (Safety and Pollution Prevention) training for all of his employees is about "walking the walk, not just talking the talk" for Rob Gagliano, Chief Operating Officer of Collex Collision Experts Inc.
Based in the Detroit suburb of Clinton Township, Michigan, Collex specializes in collision repairs for cars and light trucks. The company employs 260 people at its 11 locations in Michigan, as well as three shops in Florida: Naples, Fort Myers and Cape Coral.
Collex has been participating in the S/P2 program for five years. All Collex repair shop employees receive the S/P2 online training as part of the new-hire orientation every employee must complete, Gagliano said. New hires are required to sit with a manager and finish the S/P2 training on their first day.
S/P2 training provides a number of benefits for the company, Gagliano said. "It sets the employees' expectations from Day One," he said. "Many had no idea of what can be thrown away, what's hazardous and what isn't. It helps to let them know that we want to be in compliance with all the laws, that we're conscious about safety and the environment."

OSHA Begins National Emphasis Program on Recordkeeping to Determine Accuracy of Worker Injury and Illness Data
The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) is initiating a national emphasis program (NEP) on recordkeeping to assess the accuracy of injury and illness data recorded by employers. The recordkeeping NEP involves inspecting occupational injury and illness records prepared by businesses and appropriately enforcing regulatory requirements when employers are found to be under-recording injuries and illnesses.  "Accurate and honest recordkeeping is vitally important to workers' health and safety," said acting Assistant Secretary of Labor for OSHA Jordan Barab. "This information is not only used by OSHA to determine which workplaces to inspect, but it is an important tool employers and workers can use to identify health and safety problems in their workplaces." The inspections include a records review, employee interviews, and a limited safety and health inspection of the workplace. The NEP will focus on selected industries with high injury and illness rates. At the request of the Senate Committee on Health, Education, Labor and Pensions and the House Committee on Education and Labor, the Government Accountability Office (GAO) issued a study on the accuracy of employer injury and illness records. This NEP will help OSHA work cooperatively with the GAO. It also complements the Labor Department's Bureau of Labor Statistics' (BLS) efforts to investigate factors accounting for differences between the number of workplace injuries and illnesses estimated by BLS and those estimated by other data sources. Under the Occupational Safety and Health Act of 1970, OSHA's role is to promote safe and healthful working conditions for America's men and women by setting and enforcing standards, and providing training, outreach and education. | U.S. Labor Department Releases Updated Employment Law Guide
New version incorporates recent changes to federal employment laws
The U.S. Department of Labor has announced the availability of an updated version of its popular "Employment Law Guide," an online publication that describes the major employment laws administered by the department. The Guide helps the public - workers and employers - understand many of the laws affecting the workplace. For instance, it helps small businesses develop wage, benefit, safety and health, and nondiscrimination policies. It also benefits employees and employee representatives who need information about worker rights and responsibilities under federal employment laws.
The Employment Law Guide is a companion to the department's FirstStep overview advisor, an online system that allows employers to quickly and easily determine which federal employment laws apply to them by answering a few simple questions about relevant variables. Each chapter in the Employment Law Guide corresponds to the laws addressed in the FirstStep advisor, outlining coverage under the law; its basic requirements; employee rights; recordkeeping, reporting, notice and poster requirements; penalties and sanctions for non-compliance; relation to state, local and other federal laws; and contact information for further assistance.
