EPA Finalizes Deferral of Biogenic Emissions Applicability

On July 5, 2011, the Environmental Protection Agency finalized the "Deferral for CO2 emissions from Bioenergy and Other Biogenic Sources under the Prevention of Significant Deterioration (PSD) and Title V". This rule will allow facilities to be exempt from PSD and Title V permitting if their emissions are biogenic in nature.

Landfills would not be subject to permitting of CO2 from their flares or engines. EPA considers methane to be anthropogenic when generated from landfills, so methane emissions that are not combusted would still be subject to PSD and Title V. Waste-to-energy operations would not be responsible for permitting based on the biogenic source of their emissions but would be subject to permitting for the anthropogenic or fossil-fuel derived emissions that exceeded the thresholds in the regulation.

SWANA encouraged EPA to finalize this proposed rule as soon as possible, and seek the input of SWANA and its members while moving forward with developing alternative methods to accounting for biogenic emissions.

The San Francisco Department of the Environment (SF Environment), Alameda County (StopWaste.org), Palo Alto Zero Waste Program and the City of San Jose have partnered to create a new software platform for managing and sharing their recycling information. Lawrence will profile the fiscal and programmatic collaboration between project partners and preview the new online recycling database tool, scheduled to launch October 1, 2011.

The City of Santa Monica has adopted a Single-use Carryout Bag Ordinance that prohibits all retail establishments in Santa Monica from providing single-use plastic carryout bags to customers at point of sale, and prohibits the free distribution of paper carryout bags. Josephine will highlight the diversity of community partners involved with different aspects of outreach, including their pilot "Share a Bag" Program.

Helping keep neighborhoods safe is one way that Waste Management partners with municipalities. Through their WASTE WATCH Program, Waste Management provides special training to its drivers in what to look for and how to report suspicious or criminal activity. They assist local police and fire departments by acting as extra eyes and ears on local streets. Kris will profile the accomplishments of this unique driver-training program.
