The online, manual and posting of EE Reports is now open.  The online reporting runs from 1 September 2012 to 15 January 2013. The manual and posting of EE Reports deadline is 1 October 2012.

We approach Employment Equity primarily from a workforce readiness approach taking into account the urgent need to bring about transformation through the implementation of progressive affirmative action measures, motivated less by the "threat" of penalties or written undertakings (Section 7, General Administrative Regulations, 2009) than the requirement to develop the skills and competencies necessary for the organisation to fulfill its transformation and BBBEE mandate.

 
  1. In the development of the current plan we will take cognizance of, amongst others, the following:The General Administrative Regulations, 2009 published on 14 July 2009;
  2. Labour Court rulings on various aspects pertaining to the implementation and enforcement of employment equity plans and affirmative action measures pertaining to Employment Equity;
  3. Legislative enactments and Codes of Good Practice;
  4. External resources informing employment equity plans and the setting of numerical targets;
  5. Numerical targets and affirmative action measures set by the organisation;
  6. Any applicable Broad Based Black Economic Empowerment Charter and/or the Generic Scorecard and Charter

The proposal incorporates the development of the following material:-

  • Audit of existing policies and status of any current Plans / EEA Reports
  • Development of outline for EE Plan as well as recommendations
  • Development of action plan based on agreed recommendations
  • Recommendations for Human Resource Policies supporting EE Plan and strategy (as per DOL EE Audit)
  • Employment Equity Manual for use by consultative forum
  • Summation of EE Plan into format utilized by Department of Labour

All policies and procedures will be provided on MS Word and in Adobe Acrobat format on CD ROM. Included on the CD-ROM will be all statutory employment legislation, regulations and forms.

Changes to the Code of Good Practice on HIV, AIDS and World of Work Gazetted

A code of good practice on HIV, AIDS and the world of work has been gazetted on the advice of the Commission for Employment Equity in terms of section 54(1)(a) of Employment Equity Act 55 of 1998.

According to a preamble to the code, the 2000 code of good practice on key aspects of HIV, AIDS and employment was reviewed in order to align it to International Labour Organisation (ILO) recommendations.

 

The revised code seeks to assist employers, workers and their organisations in developing appropriate approaches to managing HIV and AIDS, TB and sexually transmitted infections (STIs) in the world of work "within the framework of decent work in both the formal and informal sectors and in the public and ... private sectors".

 

An introduction to the code states that one of the most effective ways of reducing and managing the impact of HIV and AIDS in the workplace is through the implementation of gender-sensitive workplace HIV and AIDS policies and programmes.

Amongst other things, these should:

  • eliminate unfair discrimination and stigmatisation in the workplace based on real or perceived HIV status, including issues relating to HIV testing, confidentiality and disclosure;
  • promote access to education, equitable employee benefits and employment protection;
  • manage grievance procedures in relation to HIV and AIDS; and
  • create a safe and healthy working environment.

The code applies to all employees working under all forms of employment and arrangements in all workplaces and all sectors of economic activity, as well as to people in the armed forces and uniformed services.

 

It also covers people in training, interns and apprentices, volunteers, jobseekers and job applicants, and laid-off and suspended workers.

EE CD ROM

 

 

1 October 2012 to 16 January 2013 is the compulsory Employment Equity reporting period for all designated employers.

  

If your company employs more than 50 employees or has a total annual turnover above the thresholds specified in the Act (commencing at R5m), your organisation is defined as a designated employer.

Legal compliance argument

  

All employers who employ more than 50 employees or who have a turnover in excess of the amounts specified in the Employment Equity Act are legally obligated to comply with Chapter III of the Employment Equity Act, whilst all employers regardless of their size and turnover are obligated to comply with Chapter II of the Act.

 

As such these employers are required by law to submit statutory employment equity reports; compile and implement an employment equity plan; conduct employment equity and diversity awareness training, compile workforce profiles which are representative of designated employees (Africans, Indians, Coloureds, White Women and People with Disabilities) amongst the economically active population.

 

Failure to comply with the provisions of the Act will result in the Department of Labour issuing compliance orders, and if non compliance persists, approach the Labour Court to enforce such compliance orders. The Labour Court is further entitled to issue financial penalties for such non-compliance, ranging from R100,000 to R500,000 and up to R900,000 for repeated non compliance.
