The Labour Relations Act and the Code of Good Practice are very clear on what is required of business owners and managers in the retrenchment process. Since retrenchment is a "no fault" dismissal - it is essential that all possible alternatives to dismissal are explored and that the employees to be dismissed are treated fairly.
In addition to the risk of not following the correct procedures during a retrenchment process, HR professionals also need to be aware of the other negative effects that this process can cause.
